WHEREAS, Harry Clark, t/d/b/a, Joy-Ark Builders ("Contractor")
entered into a contract dated october 11, 1995, with Edward G.
Montgomery and Jacqueline A. Montgomery ("Owners") to provide
materials and perform labor necessary for the erection and
construction bf an improvement consisting of two story residential
dwelling in accordance with the specifications and plans, and in
accordance with any change orders which OWNER may hereafter make
upon a property known as Lot Number 195, Black Latch Lane in the
subdivision of Allendale, Camp Hill, Cumberland County, Pa. 17011.
The legal description to said property is recorded in Deed Book
, Volume
, Page
of the records of the Recorder of Deeds
in cumberland County.
It is hereby stipulated and agreed by and between the parties,
as part of the October 11, 1995, contract and for the consideration
therein set forth,
that neither the contractor, nor any
subcontractor, materialman, or other person furnishing labor or
materials to the contractor or any subcontractor of the contractor
under the contract shall file a mechanics' lien claim for work done
or materials furnished to the improvement of the property or any
part thereof.
This stipulation is intended to be filed with the Prothonotary
of Cumberland County prior to the commencement of work under this
contract in accordance with the requirements of the Mechanics' Lien
Law of 1963, 49 P.S. Section 1402.
