lIarbaugh defaulted on his rent payment,s at least "" time!'!. Each

b. PartLal payment
c. No payment
d. Wrote checks that were returned for lack of funds. (3)

In September, October, and November, i995, rent payments have been
on time and Ln full.
Mr. lIarbaugh's lease( origLnal term: [,lulY, 199" to 31 July, 1995)
stipulates that at expiration, that it shalt continue on a month-
to-month basis, to be terminated by 30 day's notice from either party.
On 11 ^ugust, 1995 we notified Mr. lIarbaugh of our desire t.hat he
vacate the prQmises by 17 SeptQmbC!r, 1995..
On 1 septemlx!r, 199'i, Hr. lIarbauqh r(!(IUQsted an extension and
reconsideratLon. We granted an extension to 16 October, 1995 and
promised to rl'!vLew our decision wL th hLm On I October, 1995. On
1 October, 1995 WI'! revL"wacl the sLtuation with ~'r. lIarballgh and
repeated our raquest that w..e he Vilcat" by 16 october, 1995.

COMES NOW the defendant, David Harbaugh, by counsel, Philip
C, Briganti, Esquire, Legal Services, Inc., and respectfully
petitions this Honorable Court as follows:

from plaintiffs a residence located at 522 W, simpson street,
Mechanicsburg, CUmberland County, PA 17055.
2. On October 4, 1995, plaintiffs filed a Landlord and
Tenant complaint before District Justice Ronald E. Klair (~
Mill.r. 3r. and Ralnh W. Miller v. David Harbauah, LT-300-95),
seeking possession of the rental premises and alleged damages for
injury to the property.
3. On October 17, 1995, District Justice Klair entered a
judgment in favor of Plaintiffs, awarding them possession of the
rental premises and a monetary judgment in the amount of $300.00,
plus costs.
4. On November 16, 1995, Defendant filed a timely appeal
from said judgment to this court, which was docketed as the
above-captioned matter.

5. At the time he filed his appeal, Defendant filed an
Affidavit with the Prothonotary stating that his rent was $340.00
per month, and that his rent was paid through November 30, 1995.
6. However, the Prothonotary inadvertently failed to sign
the ".uper.edea. box" on the Notice of Appeal, which indicates
that the Notice of Appeal operates as a supersedeas to the
di.trict ju.tice judgment for possession.
7. Each month thereafter, as permitted by Rule 357 of the
CUmberland County RUles of Procedure to obtain a supersedeas of
the di.trict justice judgment for possession, Defendant has paid
hi. monthly rent into escrow with the Prothonotary. A true copy
of the docket sheet evidencing Defendant's rent escrow payments
i. attached hereto, incorporated by reference and marked as
D.f.ndant's Exhibit "A".
WHEREFORE, Defendant requests that this Court enter an Order
granting a .upersedeas of the district justice judgment for
po.....ion, in accordance with Rule 357 of the Cumberland County
Rule. of Procedure,

COMES NOW the d.fendant, David Harbaugh, pursuant to Rule
237.3 of the Pennaylvania Rule. of civil procedure, by counsel,
Philip C. Briganti, Eaquire, Legal Services, Inc., and requests

1. sinc. in or about December, 1990, Defendant has leased
fro. plaintiff. a reaidence located at 522 w. Simpson street,
M.chanic.burg, cumberland county, PA 17055.
2. On October 4, 1995, plaintiff. filed a Landlord and
Tenant complaint before Di.trict Juatice Ronald E. Klair (~
Mill.r. Jr. and Ralah w. Mil1.r v. David Harbauah, LT-300-95),
.e.king po.....ion of the rental premia.. and alleged damages for
injury to the property.
3. On October 17, 1995, Di.trict Ju.tice Klair entered a
judgment in favor of plaintiffS, awarding them possession of the
rental premi.e. and a monetary judgment in the amount of $300.00,

4. On November 16, 1995, Defendant filed a timely appeal
from said judgment to this court, which was docketed as the
above-captioned matter.
5. plaintiffs filed a complaint in this action on November
30, 1995, and filed a Supplemental Complaint on December 4, 1995,
both of which were .erved on Defendant.
6. However, Plaintiffs did not attach the notice to defend
prescribed by Pa. R.C.P. No. 1018.1 to their complaint or
supplemental complaint.
7. pur.uant to Pa. R.C.P. No. 1026(a), because of
Plaintiff.' failure to attach the notice to defend, Defendant was
not required to respond to Plaintiffs' complaint or supplemental
Complaint.
8. Nonethele.., on or about February 7, 1996, Defendant
filed with the Prothonotary's Office a response to Plaintiffs'
Complaint and Supplemental complaint, which was placed in the
court file but inadvertently never docketed by the Prothonotary's
Office, and served a copy of this response upon Plaintiffs by
certified mail, return receipt requested. A copy of said
re.pon.e, as well as the Domestic Return Receipt, is attached
hereto and marked as Defendant's Exhibit "A".
9. On February 5, 1996, despite having never attached a
notice to defend to their complaint or Supplemental Complaint,
and having received Defendant's written response, plaintiffs
.erved Defendant with an "Important Notice" regarding the
po..ibility of the entry of a default judgment, and on March 27,
1996, filed a praecipe for default judgment with the
prothonotary.
10. The notice regarding the possibility of entry of a
default judgment fails to comply with Pa.R.C.P. No. 237.5, in
that it does not advise Defendant that he failed to enter a
written appearance personally or by attorney, or failed to file
in writing with the Court his defenses or objections to the
claim. .et forth against him. A copy of the notice is attached
hereto and marked a. Defendant's Exhibit "B".
11. On March 27, 1996, the prothonotary's Office entered a
default judgment against Defendant in the amount of $372.50,
de.pite Plaintiffs' failure to comply with the above-described
procedural requirements, and despite Plaintiffs' failure to
certify in their praecipe for default judgment that a written
notice of intention to file the praecipe wa. mailed or delivered
to Defendant and their failure to attach a copy of the notice to
the praecipe, as required by Pa. R.C.P. No. 237.1 before the
prothonotary could enter a default judgment against Defendant.
12. A. set forth in Defendant's Amended Answer to
Plaintiff.' complaint, which is attached hereto and incorporated
herein by reference, Defendant has meritorious defenses to the
claim. set forth in PlaintiffS' complaint and supplemental
complaint.
WHEREFORE, Defendant respectfully requests that this
Honorable court strike or open the default judgment entered
against him on March 27, 1996, stay execution of the judgment

STIPULATION FOR JUDGMENT
AND NOW, this ;( ni day of /hay , 1996, the
plaintiffs, F.B. Miller, Jr. and Ralph Hiller, and the defendant,
David Harbaugh, hereby enter into this Stipulation for Judgment
and agree to the following terms:
1. The default jUdgment entered against Defendant in the
above-captioned case on Harch 27, 1996, shall be stricken.
2. Defendant shall be permitted to continue occupyin~ the
premises he leases from Plaintiffs, located at 522 W. Simpson
Street, Hechanicsburg, Cumberland County, Pennsylvania 17055,
until June 30, 1996.
3. Plaintiffs shall be granted a judgment for possession of
said rental premises, which shall be enforceable on or after July
1, 1996, in the event Defendant has not moved out by that date,
4. The Prothonotary shall release to Plaintiffs forthwith
all sums paid into escrow by Defendant, totaling $1700,00, which
Plaintiffs shall accept in complete satisfaction of all rent owed
or claimed to be owed by Defendant through and inclUding April
1996.
5. Defendant shall pay directly to Plaintiffs, and not into
escrow with the Prothonotary, rent in the amount of '340.00 for

Hay 1996, and '350,00 for June 1996, on or before the tenth
(10th) day of each of these months. However, in the event
Defendant surrenders the premises to plaintiffs before June 30,
1996, he shall only be liable for prorated rent until he leaves,
and plaintiffs shall return to him any rent he may have overpaid.
6. The supersedeas of the district justice judgment for
possession shall remain in effect, unless terminated by this
Court after notice and hearing upon Defendant's failure to pay
rent as set forth above in Paragraph 5.
7. plaintiffs shall retain Defendant's security deposit in
the amount of '340.00, in complete satisfaction of any and all
claims for damages to the rental premises which occurred prior to
the date of this Stipulation.
8. Plaintiffs and Defendant, except as provided herein,
hereby waive, forgive and discharge each other from any and all
claims whatsoever arising from their landlord/tenant relationship
which occurred prior to the date of this Stipulation.
9. Plaintiffs and Defendant agree that the terms of this
Stipulation shall be entered as an Order of Court.
