11. Admitted,
12, Denied for the reason that the Plaintiff performed
additional work as claimed and billed for the in the complaint in
that:
a, as per the Zegers' instructions,
substituted for the two nine foot garage
costing the same amount for which they
reduction; and
b. one door was substituted, but one additional door was
added above and beyond the one claimed in this subparagraph;
13 (a-g) . Denied because with respect to a and b, the
Defendants were not charged as the exhibit attached to the
Complaint shows and admitted with respect to c-g, to the extent
they show part of the bill (omitting the permit and inspection
fee) .

door, none in the doors installed by the Plaintiff.
h, The Zegers indicated to the Plaintiff that he should
leave the unfinished portion of the porch undone,
i, Denied for the reason that the Plaintiff never had
any contact with the access panel to the tub.
j, The Plaintiff checked for leakage and found none
before he left.
k, Relandscaping was not included in the contract and
additions to it and is not the responsibility of the
Plaintiff,
16. Admitted as to incorporation, but denied as to the truth
of the averments of paragraph 13.

Defendants answer Plaintiff's complaint as follows:
1.) After reasonable investigation Defendants are without
knowledge or information sufficient to form a belief as to the
truth of the averment - his name could be Clipp or Cross as
al:'eged.
2.) Admitted.
3.) Denied and on the contrary the contract was executed
by Keith Zeger and not Melanie zeger.
4.) It is admitted that the work called for in the
original contract was modified, some work was deleted and some
was added, but it is denied that Exhibit B itemizes said changes.
5.) Admitted.
COUNT I
6.) Paragraph of incorporation.
7.) It is denied the Defendants breached the contract and
on the contrary, the Plaintiff has been paid all money owed as
more specifically set forth under New Matter.

9,) It is denied that any services were rendered by
plaintiff which were not either pursuant to the contract
(Complaint Exhibit A) or modifications thereof,

NEW MATTER
11.) Plaintiff was paid $23,929.00 in cash by Keith Zeger
for the work done pursuant to the contract of June 5, 1995.
12.) prior to making the final payment, Keith Zeger and
Plaintiff agreed the modifications to the contract which reduced
the scope of the work for which Plaintiff was paid in full
amounted to $1,883.00 and consisted of:
a.) Garage door eliminated

14.) At the time of final payment the Plaintiff and Keith
Zeger agreed the benefits to plaintiff and the benefits to Keith
Zeger were approximatelY equal and the final payment was tendered
by Keith Zeger and accepted by Plaintiff in full satisfaction of
all claims between the parties.
WHEREFORE, Defendants move for.~ismissal of the complaint.
COUNTERCLAIM
15.) plaintiff did not perform the work contemplated by the
agreement in a workmanlike manner in that:
a.) The ridge vent was not properly installed and as a
result no air passed through the vent. 'l'he cost
of repairs was $64,00.
b.)
Bathroom heater did not function and required a
new thermostat which cost $18,00 and required one
hour for installation,
c.) The window screen was torn and the estimate to
repair is $10.00.
d.) The brick work was not cleaned. cleaning required
two hours of labor and the Muriatic acid cost $10.00.

e.) Garage door leaked. Repairs took 8 hours and
concrete patching material cost $20.00,
f.) stove pipe vent was not finished. Plywood, siding
material and paint cost $32.00 and required 4 hours
to repair.

Pocket door latch required replacement, The new
latch cost $18,00 and required 4 hours to install.
Side of existing porch was not finished. siding
and drip edge cost $18.00 and required two hours
to install.
Access panel to tub was broken. Repairs took one
hour and the cost of adhesive was $4.00.
The door to the storage area beneath the house
addition leaked and required 2 hours to repair.
Weather stripping and threshold cost $10,00.
Re-Iandscaping lawn damaged by Plaintiff. Grass
seed cost $35.00, straw cost $20.00 and 24 hours
was spent in the re-Iandscaping.

In the event it is determined no agreement existed as
alleged in paragraph 13, Defendant claims $1,883.00 of Plaintiff
as set forth in Paragraph 12.
WHEREFORE, Defendants move for judgment in the amount of
their costs, to wit, 48 hours labor and $253,00 cost of
materials plus $1,883.00, a total of $2,136.00 together with
interest and costs.
