COMPLAINT
1. Thia action is brought in the court'. original
juriadiction.
2. plaintiff i. the coaonwealth of Pennaylvania, oepen-nt
of correctiona, state correctional Inatitution at C..p
Hill.
3. The Depart.ent i. an executive agency with the
reaponaibility of adaini.tering the atate correctional
ayatem including the state correctional In.titution at
Camp Hill.
4. Defendant Helaon i. an inmate pre.ently incarcerated at
the State correctional Inatitution at ca.p Hill and
auffera from diabetea/.ellitu. and i. inaulin dependent.
5. Nelaon haa been on a hunger atrike and refuaing hia
inaulin shota aince November 12, 1995, during which ti..
he haa refuaed to take any aolid food..

6. Nelaon has not indicated to medical peraonnel and other
inatitutional peraonnel of the reaaona for hia hunger
.trike or hi. refuaal to take hia insulin ahota.
7. It appeara from Nelson's conduct and behavior that he is
not preaently committable under the Mental Health
procedurea Act, 50 P.S. 557101 at aIg.
8. Nelaon'a medical condition ha. been monitored on a
continuoua bada .ince the beginning of thia hunger
.trike and hia refusal take his inaulin ahota.
9. A phyaical examination was conducted on November 16, 1995
by Dr. Young, a contract physician providing medical
.ervicea at SCI-Camp Hill. Dr. Young'. medical
examination revealed that Nelson is SUffering from some
dehydration. It waa also determined that if Nelaon began
eating without taking his inSUlin injections Nelson may
.lip into a coma. It wa. also determined that if Nelaon
began taking his insulin injections without eating Nelson
may auf fer brain damage.
10. Nelaon has refuaed to submit to any laboratory tests that
would assist in determining the exact extent of hie
deteriorating physical condition.
11. It ia the opinion of Dr. Young that Nelson is in imminent
danger of irreparable harm, if he continues to refuae to
eat and take his insulin shots. Without the forced
infuaion of liquids and protein supplements and forced
medical treatment, he is in danger of SUffering brain
.
da..ge, going into coma or cardiac arre.t, po..ibly

12. Without intervention in the fo~ of forced hYdration,
nutrition and medical treat.ent a. .oon a. poa.ible,
Nel.on will likely aUffer .evere and irreparable ha~,
including death.
13. It i. impo.aible to predict at what point Nel.on'.
condition .ay re.ult in irreparable harm, therefore,
i..ediate intervention i. nece..ary.
14. The effect of a hunger .trike upon the inmate population
at the in.titution, a. well a. the .edical and other
.taff, i. highly damaging; it place. other inmate. under
.tre.., may lead to copycat behavior, and may cau.e
inmate. to believe that the priaon .taff i. hopeful that
a given inmate will not .urvive; it i. al.o demoralizing
to the pri.on medical .taff.
WHEREFORE, based on the foregoing, the Commonwealth of
Pennaylvania, Depart.ent of Correction., state Correctional
In.titution at Camp Hill requeats this court to enter an order
granting the following relief:
A. Authorizing the plaintiff through medical .taff to
involuntarily administer medical treatment including but
not limited to nutrition, hydration and in.ulin
injections as may be necessary to pre.erve the safety,

APFIDAVIT
I, william Young, M.D. being duly aworn according to law do
hereby depoae and aay that I a. a PhraiCian providing .edical
.ervice. at the state correctional In.t tution at camp Hill, Ca.p
Hill, PeMaylvania, that I .. authorized to uke thia affidavit and
that the facta aet forth herein are true and correct to the beat of
.y knowledge, information and belief:
1. I a. licenaed in accordance with the law. of the
Co..onwealth of Pennaylvania to practice medicine and
have been ao licen.ed aince 1986. I a. a contract
phyaician for the Depart.ent of correctiona at the state
correctional Inatitution at ca.p Hill and have been ao
contracted for twenty-one (21) montha.
2. Mr. Nelaon ie incarcerated at the State correctional
Inatitution at camp Hill and .uffera fro.
diabetea/aellitua and is inaulin dependent ha. been on a
hunger atrike and refuaing hia inaulin ahot. aince
November 12, 1995. During that ti.e period he haa
refuaed to take any aolid food. He haa had miniul
liquid intake throughout that ti.e period.
3. Mr. Nelson haa been regularly aeen by a phyaician on an
almoat daily baai. throughout the hunger atrike.
4. I have examined Mr. Nelson myself during thia time
period.

5. Mr. Nelaon haa been informed by medical ataff .embera of
the potential dangera of continuing to refuae to .at and
to take hia inaulin ahotG and that the inatitution would
aeek a court order permitting ua to involuntarily
actalniater hydration, nutrition and other medical
treatment in order to prevent irreparable harm from
occurring.
6. I examined Mr. Nelaon this afternoon, November 16, 1995,
at the state correctional Inatitution at Camp Hill.
7. Unleaa Mr. Nelaon ia adminiatered hydration, nutrition
and aedical treatment aa aoon aa poaaible, he will likely
auf fer severe dehydration and protein deprivation,
poaaiblY reaulting in coma, cardiac arrest, brain damage
and posaiblY death.
8. A court order only permitting forced nutrition and
hydration is likely to result in Mr. Nelson alipping into
a coma.
9. A court order only permitting forced medical treatment ia
likely to reault in Mr. Nelaon SUffering brain damage.
10. Mr. Nelaon haa been engaging in hunger atrikea and
refuaal of his inaulin periodicallY over the recent paat.
11. While in the Montgomery County priaon Mr. Nelaon atopped
eating and taking hi. inaulin from October 9, 1995 to
November 3, 1995. During thia period Mr. Nelaon'a only
aource of liquid intake was orange juice.
12. On November 11, 1995, Mr. Nelson waa hoapitalized for
hyperglycemia for engaging in the hunger strike and
refuaing his inSUlin.
13. It ia also notated in mr. Nelson'S inatitutional file on
Auguat 25, 1995, that Mr. Nelson was refuaing to eat.
it ia further noted that he began eating on August 28,
1995.
14. It is our plan upon the court's approval of this requeat,
to administer hydration and nutrition through a naaal
gastric tube and to provide whatever other medical
treatment is deemed necessary in order to prevent Mr.
Nelson from SUffering irreparable harm as described
above. In addition we plan to monitor hia condition
through laboratory testing.
