STIPULATION AGAINST LIENS
WHEREAS, William M. Bierly and Laureen A. Bierly of Cumberland County, Pennsylvania, is~
about to execute contemporaneously herewith, a contract with of Custer Homes, Inc. of, ~9 Lau;~l
P--q~mVGir~c, Dauphin County, Pennsylvania 17110, for thc erection of a single family dwelling home
upon a tot of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being
designated as Lot No. 9, Sterling Glen. See Exhibit "A".
NOW, -,~ Q?~r/f / z ~ ,2002, at the time of and immediately before execution
of the principal contract, and before any authority has been given by the said Custer Homes, Inc., to
commence work on the said building, or pumhase materials for the same in consideration of the making
&the said contract with Custer Homes, Inc. and the further consideration of One Dollar to Custer
Homes, Inc. paid by William M. Bierly and Laureen A. Bierly, it is agreed that no lien shall be filed
against the building by the contractor, or 9ny sub-contractor, nor by any of the material men or workmen
or any other person for any labor, or materials purchases, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.

ALL that certain tract of land as hereinafter identified being
Lot No. 9 appearing on the Final Subdivision Land Development
Plan for Sterling Glen, (hereinafter "Plan"), dated January 17,
2002 approved by the Board of Supervisors on March 13, 2002 and
recorded on May 29, 2002, in the Office of the Recorder of Deeds
of Cumberland County in Plan Book 85, Page 67, more specifically
bounded and described as follows:
BEGINNING at a point on the right-of-way of Cobblestone Court at
the dividing line between Lot No. 9 and Lot No. 10 as appearing
on the hereinbefore identified Plan; thence continuing along the
dividing line of Lot No. 9 and Lot No. 10 as appearing on the
aforesaid Plan, North 26 degrees 16 minutes 47 seconds East for a
distance of 150 feet to a point at the dividing line between Lot
No. 9 and lands now or formerly owned by Phico Realty Corporation
as appearing on aforesaid Plan; thence continuing along the
dividing line between Lot No. 9 and lands now or formerly of
Phico Realty Corporation South 63 degrees 43 minutes 13 seconds
East for a distance of 108.79 feet to a point at the dividing
line between Lot No. 9 and lands now or formerly owned by W.
Thomas and Terry L. Bryan, Jr. as appearing on aforesaid Plan;
thence continuing along the dividing line between Lot No. 9 and
lands now or formerly W. Thomas and Terry L. Bryan, Jrl South 04
degrees 28 minutes 01 second East 244.05 feet to a point at the
dividing line between Lot No. 8 and Lot No. 9 as appearing on
aforesaid Plan; thence cohtinuing along the dividing line between
Lot No. 8 and Lot No. 9 on the aforesaid Plan North 06 degrees 31
minutes 28 seconds West for a distance of 125.04 feet to a point
on a cul-de-sac of Cobblestone Court as appearing on aforesaid
Plan; thence continuing along the cul-de-sac of Cobblestone Court
as appearing on aforesaid Plan along a curve having a radius of
50.00 feet and an arc length of 80.23 feet the delta angle 91
degrees 56 minutes 12 seconds to another point on the right-of-
way of Cobblestone Court as appearing on aforesaid Plan; thence
continuing along the right-of-way of Cobblestone Court as
appearing on aforesaid Plan North 63 degrees 43 minutes 13
seconds West for a distance of 59.89 feet to a point, the place
of BEGINNING.
Said being Lot 9 as appearing on aforesaid Plan containing .6773
acres or 29,505 square feet, more or less.
