NOW come the petitioners, James R. Bankert and Judy 0, Bankert, by their attorney,
Harold S. Irwin, III, and present the following petition for custody, representing as follows:
\, The petitioners are James R. Bankert and Judy 0, Bankert, adult individuals
residing at 645 Baltimore Pike, Gardners, Cumberland County, Pennsylvania \7324.
2. The respondents, Melisa Sue Kellison and Roberto Jimenez Alonso, are adult
individuals having an address ofP, 0, Bolt 752, Biglerville, Cumberland County, Pennsylvania
17307.
3. Respondent Marco A, Tapia is an adult individual whose present whereabouts is
unknown, but which is believed to be in Meltico.

4. Respondents Melisa Sue Kellison and Robert Jimenez Alonso are the natural
parents oftwo minor children, namely Cassandra Marie Kellison (age 1. born December 31, 1993)
and Leticia Jimenez Alonso (age II months, born December 1 S, 1994).
S. Respondents Melisa Sue Kellison and Marco A Tapia are the natural parents of
one minor child, namely Arnol Tapia (age 3, born April 23, 1992).
6. All of the children which are the subjects of this petition resided with respondent
Melisa Sue Kellison until recently when she requested petitioners to assume custody of the
children.
7. The children have resided with the petitioners since that time, subject to brief
periods of visitation with respondent Melisa Sue Kellison on a mutually agreeable basis.
8, Cumberland County Children and Youth Services (hereinafter CCCYS) has
indicated that unless respondents make appropriate arrangements for the care and custody of
these children that CCCYS will intervene to take protective custody of the children.
9. CCCYS has also indicated that it is in agreement with petitioners taking over the
custody of the children,
10. Petitioners believes and therefor aver that the best interests and pennanent welfare
of the children requires that the petitioners have legal and physical custody of the children, subject
to periods of visitation of the children by their Mother, or by their Father in the company of their
Mother, at petitioners place of residence and on advance notice ofatleast 24 hours to petitioners
by the respondents, and on the mutual agreement of the parties from time to time.

THIS STIPULATION AND AGREEMENT entered into this [(!:' day of Ubn_L~
1995, by and between JAMES R. BANKERT and JUDY D. BANKERT (hereinafter referred
to as "Petitioners") and MELlSA SUE KELLISON and MARCO A. TAPIA (hereinafter
referred to as "Mother" and "Father", respectively).
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Mother and Father are the natural parents of one minor child, namely
Arnol Tapia (age 3, born April 23, 1992).
WHEREAS, the parties wish to enter into an agreement relative to the custody of the
children.
NOW. THEREFORE, in consideration of the mutua! covenants, promises and
agreements as hereinafter set forth and intending to be legally bound, the parties hereto agree as
follows:
1. , The Petitioners shall have legal custody ofthe child.
2. The Petitioners shall have physical custody of the child, subject to periods of
visitation of the child by their Mother, or by their Father in the company oftheir Mother, at
petitioners place of residence and on advance notice of at least 24 hours to petitioners by the
respondents, and on the mutual agreement of the parties from time to time.
J. The parties will keep each other advised immediately relative to any emergencies
concerning the child while he is in their custody and shall take any necessary steps to ensure that
the health, welfare and well being ofthe child is protected.
4. The parties shall do nothing that may estrange the child from each other or hinder
the natural development of the child's love or affection for the other party.
5, Any modification or waiver of any of the provisions of this agreement shall be
effective only if made in writing and only if executed with the same formality of this agreement.
6. The parties agree that in making this agreement there has been no fraud,
concealment, overreaching, coercion or other unfair dealing on the part ofthe other.

7. The Father's present whereabouts is unknown, but he is believed to reside in
Mexico at this time. Mother desires that the Court enter an order as provided herein without the
execution of this agreement by the Father who has abandoned the child.
8, The parties desire that this agreement be made an order of Court through the
Court of Common Pleas of Cumberland County, and further acknowledge that the Court of
Common Pleas of Cumberland County has jurisdiction over these issues and shall retain such
jurisdiction should circumstances change and either party, including the absent Father desire
further or require further modification of said Order.

hereof, set forth their hands and seals the day and year herein set forth.

STIPULA TION AND AGREEMENT
THIS STIPULATION AND AGREEMENT entered into this ~day of ,In. . L. .
1995, by and between JAMES R. BANKERT and JUDY D. BANKERT (hereinafter referred
to as "Petitioners") and MELlSA SUE KELLISON and ROBERTO JIMENEZ ALONSO
(hereinafter referred to as "Mother" and "Father", respectively).
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Mother and Father are the natural parents of two minor children, namely
Cassandra Marie Kellison (age I, born December 31, 1993) and Leticia Jimenez Alonso (age 11
months, born December 15, 1994); and
WHEREAS, the parties wish to enter into an agreement relative to the custody of the
children,
NOW. THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth and intending to be legally bound, the parties hereto agree as
follows:
I. The Petitioners shall have legal custody of the children.
2, The Petitioners shall have physical custody of the children, subject to periods of
visitation of the children by their Mother, or by their Father in the company of their Mother, at
petitioners place of residence and on advance notice of at least 24 hours to petitioners by the
respondents, and on the mutual agreement of the parties from time to time.

NOW come the petitioners, James R, Bankert and Judy D. Bankert, by their attorney,
Harold S. Irwin, Ill, and present the following petition for modification of custody, representing
as follows:
1. The petitioners are James R. Bankert and Judy D, Bankert, adult individuals
residing at 64S Baltimore Pike, Gardners, Cumberland County, PeMsylvania 17324.
2, The respondents, Melisa Sue Kellison and Roberto Jimenez Alonso, are adult
individuals residing in Bendersville, Adams County, Pennsylvania. and Melisa Sue Kellison has a
place of employment at Rice Fruit Company, Gardners, Adams County, PeMsylvania 17324.
3. Respondent Marco A, Tapia is an adult individual whose present whereabouts is
unknown, but which is believed to be in Mexico.
4. Respondents Melisa Sue Kellison and Robert Jimenez Alonso are the natural
parents of two minor children, namely Csasandra Marie Kellison (age 2, born December 31,1993)
and Leticia Jimenez Alonso (age 1\ months, born December IS, 1994).
S. Respondents Melisa Sue Kellison and Marco A. Tapia are the natural parents of
one minor child, namely Arnol Tapia (age 3, born April 23, 1992).
6. All of the children which are the subjects of this petition resided with respondent
Melisa Sue Kellison until recently when she requested petitioners to assume custody of the
children,
7. The children have resided with the petitioners from the end of September, 1995
through January 21,1996, subject to periods of visitation with respondents.
8. On December IS, 1995, this Court granted legal and physical custody of the
children to the petitioners, upon entry of a stipulation and agreement between the parties at that
time,
9. On January 2\, 1996, respondents demanded termination of the prior custody
agreement and the return of the children, made thrests to petitioners and otherwise made life
intolerable for petitioners, such that peti\ioners returned the children to respondents.
10. Respondents have refused to execute an agreement formally accepting the return
ofthe children and terminating the legal and physical custody rights or obligations on the part of
petitioners.

11. Cumberland County Children and Youth Services has refused to become involved
in this mailer at this time, despite repeated efforts on the part of petitioners to have CCCYS
provide assistance in resolving this situation.
12. Under the present circumstances, petitioners desire that any custody obligations
imposed on them by their acceptance of custody and the prior Order of Court confirming custody
in them be terminated as the natural parents refuse to permit the children to reside with petitioners
and petitioners fear retribution by the respondents ifthey seek enforcement of the current Order
of custody,
WHEREFORE. petitioner respectfully requests that the court enter an order providing
for the legal and physical custody of the children be returned to the respondents, thereby
terminating the prior agreement and order of Court,

AND NOW, this ay of March, 1996, upon consideration of the
attached Custo y Conciliation Report, it is ordered and direoted as
follows:
1. This Court's prior Orders of December 15, 1995 inoorporating
a Stipulation and Agreement regarding custody in the above
case are hereby vacated. Petitioners, James R. Bankert and
Judy D. Bankert, shall hereafter have no legal obligation with
respect to custody of Cassandra Marie Kellison, Leticia
Jimenez Alonso, and Arnol Tapia.
2. Counsel for the petitioners shall serve a copy of this Order
and the attached Custody Conciliation Report on the parents of
the children by regular mail.

CONCILIATION CONFERBNCE SUMMARY REPORT
IN ACCORDANCB WUH CUMBBRLAND COUNTr CIVIL RULE OF PROCBDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The information pertaining to the children who are subjeot of
this litigation is as follows:
Cassandra Marie Kellison, born Deoember 31, 1993
Letioia Jimenez Alonso, born December 15, 1994
Arnol Tapia, born April 23, 1992
2. A Conoiliation Conference was held on March 1, 1996, with the
following individuals in attendance:
Mr. and Mrs. James R. Bankert, with their counsel Harold
Irwin, Bsquire.
3. This is a situation where Mr. and Mrs. Bankert took oustody of
the above-mentioned minor children. This was by a Stipulation
and Agreement signed by the Mother and the Father of two of
the children. The Father of the third child is residing in
Mexico and has never signed any consent. By Stipulation and
Consent Agreement, this Court issued an Order December 15,
1995, giving the Bankerts custody of the three minor children.
4. The Bankerts now appear before the Conciliator and indicate
that the Mother, Melisa Sue Kellison, has taken custody of the
children after disputes arose between the parties. The
Bankerts desire at this time merely to have the prior Order
vacated so that there is no suggestion that they have any
obligation to the children at this time.
