Defendant AFFIDAVIT I, William Young, M.D. being duly sworn according to law do hereby depose and say that I am a physician providing medical services at the state Correctional Institution at Camp Hill, Camp Hill, Pennsylvania, that I am authorized to make this affidavit and that the facts set forth herein are true and correct to the best of my knowledge, information and belief: 1. I am licensed in accordance with the laws of the Commonwealth of Pennsylvania to practice medicine and have been so licensed since 1986. I am a contract physician for the Department of Corrections at the state correctional Institution at Camp Hill and have been so contracted for twenty-one (21) months. 2. Mr. Torres is incarcerated at the State Correctional Institution at Camp Hill has been on a hunger strike and refusing since November 17, 1995. During that time period he has refused to take any solid food or liquidS of any kind. 3. Mr. Torres has been regularly seen by a physician on an almost daily basis throughout the hunger strike. 4. I have examined Hr. Torres myself during this time period. .. 5. Mr. Torres has been intormed by medical statt members ot the potential dangers ot continuing to retu.e to eat and that the institution would .eek a court order permitting us to involuntarily administer hydration, nutrition and other medical treatment in order to prevent irreparable harm trom occurring. 6. I examined Mr. Torres this morning, November 20, 1995, at the state Correctional Institution at Camp Hill. At that time he showed signs of dehydration, including dry skin, dry mucus membranes, chapped and crusted lips, ditticulty standing and walking. 7. Unless Mr. Torres is administered hydration, nutrition and medical treatment as soon as possible, he will likely sutfer severe dehydration and protein deprivation, possibly resulting in coma, cardiac arrest, brain damage and possibly death. 8. A court order only permitting forced nutrition and hydration is likely to result in Mr. Torres slipping into a coma. 9. A court order only permitting forced medical treatment is likely to result in Mr. Torres suffering brain damage. 10. It is our plan upon the court's approval of this request, to administer hydration and nutrition through a nasal gastric tube and to provide whatever other medical treatment is deemed necessary in order to prevent Mr. Torres from suffering irreparable harm as described above. The Department is an executive agency with the responsibility of administering the state correctional system inClUding the state Correctional Institution at Camp Hill. 4. Defendant Andrew Torres is an inmate presently incarcerated at the state Correctional Institution at Camp Hill. 5. Torres has been on a hunger strike for approximately three (3) days during which time he has refused to take any foods or liquido. 6. It appears from Torres' conduct and behavior that he is not presently commitable under the Mental Health Procedure. Act, 50 P.S. 557101 At atg. Torres' medical condition has been monitored on a continuous basis .ince the beqinninq of this hunqer .trike. It i. the opinion of Dr. Younq that Torres is in iminent danqer of severe dehydration and severe protein deprivation. Without the forced infusion liquids and protein supplements, he is in danqer of qoinq into coma or cardiac arrest, possibly resultinq in death. Without intervention in the form of forced hydration and nutrition as soon as possible, Torres will likely suffer .evere and irreparable harm, includinq death. Plaintiff is the Commonwealth of Pennsylvania, Department of Corrections, State Correctional Institution at Camp Hill. 3. The Department is an executive agency with the responsibility of administering the state correctional system including the state Correctional Institution at Camp Hill. 4. Defendant Andrew Torres is an inmate presently incarcerated at the state Correctional Institution at Camp Hill. 5. Torres has been on a hunger strike for approximately three (3) days during which time he has refused to take any foods or liquids. 6. It appears from Torres' conduct and behavior that he is not presently commitable under the Mental Health Procedures Act, 50 P.S. 557101 at aIQ. 7. Torree' medical condition has been monitored on a continuous basis since the beqinninq of this hunqer strike. i ... v' \ 8. It is the opinion of Dr. Younq that Torres is in iminent danqer of severe dehydration and severe protein deprivation. Without the forced infusion liquids and protein supplements, he is in danqer of qoinq into coma or cardiac arrest, possibly resultinq in death. 9. without intervention in the form of forced hydration and nutrition as soon as possible, Torres will likely suffer severe and irreparable harm, includinq death. 10. AFFIDAVIT I, William Young, M.D. being duly sworn according to law do hereby depose and say that I am a physician providing medical services at the State correctional Institution at Camp Hill, Camp Hill, Pennsylvania, that I am authorized to make this affidavit and that the facts set forth herein are true and correct to the best of my knowledge, information and belief: 1. I am licensed in accordance with the laws of the Commonwealth of Pennsylvania to practice medicine and have been so licensed since 1986. I am a contract physician for the Department of corrections at the state Correctional Institution at Camp Hill and have been so contracted for twenty-one (21) months. 2. Mr. Torres is incarcerated at the state Correctional Institution at camp Hill has been on a hunger strike and refusing since November 17, 1995. During that time period he has refused to take any solid food or liquids of any kind. 3. Mr. Torres has been regularly seen by a physician on an almost daily basis throughout the hunger strike. 4. Mr. Torres has been informed by medical staff members of the potential dangers of continuing to refuse to eat and that the institution would seek a court order permitting us to involuntarily administer hydration, nutrition and other medical treatment in order to prevent irreparable harm from occurring. 6. I examined Mr. Torres this morning, November 20, 1995, at the state Correctional Institution at camp Hill. At that time he showed signs of dehydration, including dry skin, dry mucus m8lllbranes, chapped and crusted lips, difficulty standing and walking. 7. Unless Mr. Torres is administered hydration, nutrition and medical treatment as soon as possible, he will likely suffer severe dehydration and protein deprivation, possibly resulting in coma, cardiac arrest, brain damage and possibly death. 8. A court order only permitting forced nutrition and hydration is likely to result in Mr. Torres slipping into a coma. 9. A court order only permitting forced medical treatment is likely to result in Mr. Torres suffering brain damage. 10. It is our plan upon the court's approval of this request, to administer hydration and nutrition through a nasal gastric tube and to provide whatever other medical treatment is deemed necessary in order to prevent Mr. Torres from SUffering irreparable harm as described above.
