Finkenbinder ("Owner") entered into a contract dated U~~ ' 1995, ("Contract"), with Christopher L' a e y, t/d/b/a C.T. stavely Construction Contractor") to provide materials and perform labor necessary for the erection, construction, alteration or repair of a dwelling house, situate upon that certain lot' or piece of ground located in West PAnnsboro Township, Cumberland County, Pennsylvania, and more particularly described as followSI (SBE ATTACHBD SCHBDULE "A") NOW, THBREFORB, it is hereby stipulated and agreed by and between the said parties, as part of the contract and for the consideration therein set forth, that neither the undersigned contractor, any subcontractor or material man, nor any other person furnishing labor or materials to the said contractor under the Contract shall file a lien, commonly called a mechanics' lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County prothonotary for the County of Cumberland, Commonwealth of Pennsylvania in accordance with the requirements of Section 402 of the Mechanics' Lien Law of 1963, Pa. stat. Ann. tit. 49, Section l402 (Purdon 1965) of the Commonwealth of Pennsylvania in such case provided.
