WILLIAM FAHNESTOCK tldIb/a FAHNESTOCK'S LAWN LANDSCAPING & SNOW REMOVAL, by and through his attorneys, IRWIN, McKNIGHT & HUGHES. making this Complaint and averring as follows: 1. Plaintiff, C. William Fahnestock, is an adult individual who is the owner of Fahnestock'a Lawn Landscaping & Snow Removal with hi8 principal business address being P. O. Box 126. Plainfield. Cumberland County. PeMsylvanla 17081. 2. Defendant, Bradley A. Farner, is an adult individual who owns B. A. Farner CUltom Homel, with his principal place of business located at 304 A Hillcrest Drive, New Cumberland, Cumberland County, PeMsylvania 17070. 3. During the spring of 1995, defendant orally contracted with plaintiff whereby plaintiff was to perfonn the necessary landscaping services to install newly seeded yards on various properties where the defendant was constructing new residential homes. 2 ,. Speclfical1y, defendant contracted with plaintiff to perform such landscaping services on those properties which were known as Tagliaferro, a new residence on Limestone Road and for that property located at 34 Hunter Drive, all such properties being located within Cumberland County, pennsylvania. 5. In reliance upon the agreement between the parties, plaintiff proceeded to box, power rake. fertilize. seed and straw all of the landscaping for those properties known as Tag1iaferro and Limestone Road. 6. Plaintiff completed the landscaping services requested by defendant for Tagliaferro and Umeatone Road on or about April 24, 1995. At that time, plaintiff sent to defendant a billing ltItement for services rendered in cOMection with the completed landscaping services, a true and correct copy of said statement is attached hereto as Exhibit "A". 7. In accordance with the request of the defendant, plaintiff boxed, power raked, spread top soil and brought straw to the site located at 34 Hunter Drive at which time defendant informed plaintiff to halt all landscaping services 10 that defendant could obtain more topsoil. 8. At the time defendant requested that plaintiff halt all landscaping services. plaintiff forwarded to defendant a billing statement for services to date for 34 Hunter Drive, a true and correct copy of which is attached hereto as Exhibit "B". 3 . . .' ., 9. Plaintiffs bUlill8 statement for the Tagliaferro landscaping services performed was in the amount ofS926.2S as set forth on Exhibit " A" as attached hereto. 10. Plaintiffs billing statement for the Limestone Road property for landscaping aervicea performed wu $I,030.7S as set forth on Exhibit "A" attached hereto. 11. Plaintiffs billing statement for landscaping services performed by plaintiff at 34 Hunter Drive wu a total sum ofSS08.oo which is set forth on Exhibit "8" attached hereto. 12. The total sum of all three properties as set forth on Exhibits "A" and "8" attached hereto represented a total sum due ofS2,46S.oo due to plalntiffftom defendant. 13. After numerous demands, the defendant made a payment on account for the above- mentioned invoices in the amount of $I,S38.oo, leaving a principal balance due to plaintiff by defendant ofS927.oo. 14. After July 19, 1995, defendant has made no further payments toward his outstanding debt due to plaintiff for the landscaping servict~ performed by plaintiff upon request of defendant. IS. Plaintiff fully performed and completed his obligations under his agreement with the defendant. 4 . . .' 16. Plaintiff has made numerous attempts to contac.t defendant to collect the amounts due In accordance with the landscaping services performed by plaintiff for defendant as stated above. 17. Despite plaintift's repeated demands, defendant has failed and refused to pay the amount which he owes to plaintiff, which constitutes a material breach of the oral contract between plaintiff and the defendant. 18. Defendant's breach has caused injury to the plaintiff in the principal amount ofS927.00, the remaining amount due for the landscaping services provided by plaintiff for defendant with regard to the above-mentioned properties. 19. The agreement for services and the actual services between the parties hereto were entered into In Cumberland County, Pennsylvania. 20. Defendant's breach of the agreement between the parties occurred in Cumberland County, Pennsylvania. 21. As set forth on each billing statement tendered by plaintiff to defendant, interest sha1l accrue at a rate of I V,,% per month. s .. . .
