Andes, Esquire, and Husbllnd by pstsr J, Russo, Esquire, hays sach sxchanged full snd complete Information as to the property, assats, and liabilities ownsd and owed by each and have dlsclossd to each other and to thsir rsspectlve attorneys full information ss to ths finsncisl status of both partlss hersto; and WHEREAS, ths parties hsreto hays mutually entsrsd Into an sgreement for ths division of thsir assets, ths provision for the Iisbilitiss they owe, and provision for ths resolution of their mutual dlffsrsncss, sfter both psrties hays had full and smple opportunity to consult with thsir respectlvs attorneys, and the partlss now wish to hays that agresmsnt rsducsd to writing, NOW, THEREFORE, the parties hereto, in consideration of ths above recitsls, the mutually made and to be kept promises set forth hereinafter, and for other good and valuable 1 ~ , . , consldsratlons, and Intsndlng to be legally bound snd to Isgally bind thslr hsirs, succsssors, assigns, snd personal rspressntatlves, do hereby covenant, promise, and agres as follows: 1, RESIDENCE. Husband covenants and agress to convey to Wife, as her sols and separats propsrty, ths rsal estate presently owned by the partlss hsrsto as tenants by ths entlrstles and bsing known as 66 Old Fsderal Road, Camp Hill, Cumbsrland County, Pennsylvania, subjsct, howsvsr, to all liens, encumbrancss, sasemsnts, and rsstrictlons presently existing therson, In furthsrance of this Agresmsnt, Husband rsprssents that he has, as of the date of this Agrsemsnt, exscutsd, acknowledgsd, and dslivsrsd to his attorney, a dssd to said rssl estats, convsylng ths same as above dsscrlbed to Wife, and agrees that said dsed shall be hsld In escrow by his attorney psnding the filing by both parties of the consents and other documsnts nscessary to conclude ths divorcs action between the partiss, at which tlms Husband's attornsy shall, without furthsr dlrsctlon or authorization from Husband, dsliver the said dssd to Wifs's sttorney or such othsr person as Wife may designats, so that the desd can bs recorded at or shortly before the time of sntry of a finsl decrse In divorce, 2, MORTGAGE ON RESIDENCE, In consldsration of ths convsyance of rsal sstate as above dsscrlbsd, Wife hsrsby covenants and agrees to sssume and pay in full ths remaining barancs of ths mortgags now existing and pressntly constituting a Iisn upon and encumbsring the ssms premlsss, In accordancs with ths tsrms snd provisions of ths mortgags, such mortgage being owsd and payabls to Mschsnics Savings & Loan, and Wife further agrses and covsnants that shs will Indemnify and savs Husband harmless from any and all liability, expense, cost, or loss whatsosver as a rssult of her non-paymsnt of or non-psrformsnce of said mortgage and said mortgage conditions. 3, WIFE'S AUTOMOBILE, The partiss agres that Wife shall rsmaln ths sols ownsr of a csrtain 1989 Dodge Dynasty sutomoblls, Husband does hereby waivs, release, and rslinqulsh any and all claim to or interest In said motor vehicle. If the title to the said vehicle is encumbsred by any debt or obligation, Wife agrees that she shall be sol sly responsibls for 2 i . i / and shall pay and satisfy said obligation, In accordancs with Its terms and provisions, and shalllndsmnlfy snd save Husband harmless from any loss, cost. or slCpsnss caussd to him by hsr failurs to maks payment of such debt, 4, HUSBAND'S AUTOMOBILE, The p&rtles sgree that Husband shall remain the sole ownsr of s certain 1988 Ford Rangsr pickup truck. Wifs doss hereby walvs, relsase. and relinquish any and all claim to or Interest In said motor vshlcle. If ths title to the said vehicle Is encumbered by any dsbt or obligation, Husband agrees that he shall be solaly responsible for and shall pay and satisfy said obligation. In accordance with its terms snd provisions, and shalllndsmnlfy and savs Wifs harmlsss from any loss, cost, or elCpsnss caused to hsr by his fallurs to make payment of such debt. 6. ~ISCELLANEOUS ASSETS TO WIFE, Husband does hereby grant. convsy. transfer. ssslgn. and deliver and sst-ovsr unto Wlfs the following assets. which said asssts shall be and remain the sole and ssparate propsrty of Wits hsrsafter, frse of sny c1sim by or Interest of Husband, regardless of whsthsr such assets wsrs desmed by slthsr of the parties to be marital propsrty or non-maritsl property before: A, Wife's account In ths Byerly Insurancs Agents & Brokers, Inc.. 401 (kl Bsnsflt Plan. B, Wifs's sccount within the Bysrly Insursnce Agents & Broksrs. Inc,. Employss Stock Ownsrshlp Plsn. C, Any and all savings, chscking, snd other bank accounts titled or hsld in Wifs's Individual name at tha pressnt time. And furthsr, Husbsnd doss hsreby waive, release. relinquish. and surrender forsver any and all claim to or Intsrest In said sssets, which shall bs and rsmaln ths sols and seperats property of Wifs hereafter, 6, MISCELLANEOUS ASSETS TO HUSBAND, Wifs does hersby grsnt. convey. transfer, sssign, snd deliver and set-over unto Husband the following asssts, which said assets shall be and rsmaln the sole and separate property of Husband hereafter, frss of any J I , . claim by or interest of Wits, regardless of whether such assets were deemed by slther of the parties to be morltal property or non-marital property before: A, Ths sevsrance pay received by Husband In February of 1998 from PP&L, Inc" at ths time of his retlrsment, which said severancs pay was, prior to tax, in the amount of $44,198,00 and, aftsr taxss wore wlthhsld, was approximately $27,500.00, B, Husband's account within ths Pennsylvania Powsr & Light Company Employsss Stock Ownsrshlp Plan, C, Husband's account within the PP&L Resourcss, Inc" Stock Dividend Rsinvestmsnt Plan. D. Husband's policy of insurance on his life issued by Nationwide Insurance Company, and ths cash value of that policy which Is approxlmatsly $3,200,00, E, Husband's Qualiflsd Individual Retlrsmsnt Account with CaVA Flnanclsl Lifs Insurance Compsny, F. Any and 011 savings, checking, and other bank accounts t1tlsd or hsld In Husband's Individual name at the present time. And furthsr, Wifs does hereby wsive, rslsase, relinquish, and surrender forsver any and all claim to or Intsrest In said asssts, which shall be snd remain the sole and separate propsrty of Husband hersafter, 7, PP&L SAVINGS PLAN, The psrties acknowlsdgs that Husband Is a participant In ths Psnnsylvanla Power & Light Company Employse Savings Plan and that his bensflts within thst Plan had a value, as of 31 March 1998, of approximately $365,000.00, of which approximately $323,800.00 wers marital propsrty. With regard to that account, ths partlss have agreed, and the parties will do, as follows: A, Husband shall, by a Qualified Domestic Relations Order, transfsr and rollover Into an account within the Pennsylvania Power & Light Company 4 , , . Employes Savings Plan in Wlfs's Individual name or, If permitted by ths terms of said Plsn, into an Individual retlrsment account In Wife's ssparats name, funds having a value, as of 1 July 1 998, of One Hundred Thirty-Six Thousand Two Hundrsd Fivsand 79/100 ($136,20~79l Dollars, plus the sernlngs, 0" "'~(;,..uo.-. '11A3 JW. intsrest, and othsr Increass"tn valus of th se funds from 1 July 1998 until such time as that transfer 15 complste. Husband shall be responsible to obtain and enforcs the Qualified Domsstlc Relations Ordsr at his own expense. B. Ths balance of the funds In Husband's account within the ssid Plan shall bs and remain ths sols and separate assst of Husband, free of any further claim by Wife. The parties agrse that they shsll maks, execute, acknowlsdge and dellv~r all documents, and complete all actions reasonably required of thsm, to implement ths terms and provisions of this paragraph as efficiently snd effectively as possible. 8. PENNSYLVANIA POWER AND liGHT PENSION PLAN. The partlss acknowlsdge that Husband is a particlpsnt In the retlremsnt plan operated by his formsr employer, Pennsylvania Power and Light Company and was a participant In that retirsmsnt plan for most of the marriage, The partlss furthsr acknowledge that Husband elsctsd an sarly retirsment under the Displacsd Managers Policy of PP&L In February of 1998. The parties have furthsr acknowledged that 91 ,17 percent of all bensfits hs has received or 15 entitled to receive from that plan are marital property snd subject to equitable distribution In ths dlvorcs action now psndlng betwesn the psrtlss. In light of the abovs, ths parties have agrssd, and shall do, ths following with regard to Husband's psnsion: A, Wife shall be designated, Irrsvocably, the sole bensficlary of a fifty (50%1 percsnt joint and survivor annuity undsr the pension, so that she rscelvss fifty (50%) percent of Husband's total bsneflts for the balance of hsr IIfs after Husband's death, 5 I . B. The psrtiss shall divide snd distributs Husband's pension benefits so that Wifs receives forty-fivs and six-tenths (45,6%) percent of all bensfits due Husband, on a monthly or annual basis, including any cost of living sllowances or other increases in such amounts at any time in ths future, Ths parties spsclflcally agres that, undsr the pension plan as it now exists, Wife shall rscsivs the following monthly payment pursuant to this agrsement: (1) From 1 August 199B until Husband's 62nd birthday, ths sum of Ons Thousand Thres Hundred Fifty-One and 39/100 ($1,351,391 Dollars; (2) From Husbsnd's 62nd birthday until his 65'h birthday, ths sum of One Thousand Forty-Ssvsn and 24/100 ($1.047,24) Dollars; and (3) Thereafter, until Husband's death, ths sum of Nine Hundrsd Thirty-Six snd 42/100 ($936.42) Dollars. Whils the partlss acknowlsdge that Wife cannot assign her right to recsive Husband's pension bensfits to a third party pursuant to PP&L's Pension Plan structure, the psrtles both acknowledge that It is thsir intention that ths partlss' thrss children shall receive the funds payabls to Wife pursuant to this sub- paragraph B(B) In the event that Wife predeceasss Husband, Therefore, the parties hersby specifically agree that, should Wifs prsdecease Husband, sach of thsm, snd particularly Husband as the survivor, shall taks sll actions ressonably nscsssary to implsment that intsntlon and to pay ovsr to the partiss' three chlldrsn ths funds which wers bslng psld to Wife Immedlatsly prior to hsr dsath pursuant to this sub-paragraph BIB). including direct paymsnt by Husband to ths three children In the evsnt that the funds which had bsen paid to Wits ars paid directly to Husband following his death. 6 t C, Ths balance of the benefits or payments from the psnsion plsn shall be paid to and shall be the sole and ssparate property of Husband hersaftsr. The parties shall implsment ths provisions of this paragraph by obtaining a Qualified Domestic Rslations Order, serving it upon ths appropriate authorities at the PP&L Retirement Plan, and sselng to it that such order is implsmented and the payments are made directly to Wlfs. Husband shall bsar ths expenss of obtaining snd implementing ths QDRO and the partlss agrss that thsy will make, execute, acknowledge and dslivsr sny and all documents and taks all actions rsasonably necessary to implsment the terms and provisions of this parsgraph of this sgresment. The parties furthsr agree that, commencing with 1 August 1998, Husband shsll pay directly to Wife, from the funds hs receives from the said pension plan, the amount of One Thousand Three Hundrsd Fifty-One snd 39/100 ($1,351.39) Dollars Isss ths fedsrallncoms taxss withheld on that payment by ths psnsion plan bsfors the payment Is mads to Husband, for every month he receivss thoss pension paymsnts prior to ths dats that Wifs's portion of those pension payments, as provided in this paragraph, ars paid directly to Wife. 9. CASH PAYMENT, Husband shall pay to Wife, immediatsly upon the sxscution of his agrsemsnt and prior to the filing of ths conssnts in ths divorce action, ths sum of Eightssn Thousand ($18,000.00) Dollars, all of which shail represent squitsble distribution nd shall not be alimony. Wife acknowledges that $4,800.00 of this payment is for her hars of Husband's PP&L pension payments for the months of February through July, 1998, fter giving Husband credit for payments hs made on the mortgage against the family ssldsncs during that same period of time. 10. PERSONAL PROPERTY. Husband shall have, from the family residsnce, thoss tsms listed on Schsdule A which is attached to and made a part of this agreement. Wife hall, prior to ths filing (If the consents to conclude the divorce, make such Items available at he garags of ths family residence for Husband to pick up at a time to be schedulsd by 7 , Husband and Wife at thsir mutual convenience, The partiss agrse that they will cooperats to make the exchange and dsllvery of those documents sfflciently, Otherwise, ths parties hereto mutually agree that they have sffected a satisfactory division of the furniture, household furnishings, appliances, and othsr household and personal property betwssn thsm and they mutually agree that each party shall, from and aftsr the dats hersof, bs the sole and separste owner of all such tangible personal property presently In his or hsr possession, whether said property was heretofore owned jointly or Individually by the partlss hereto, and this agrsemsnt shall have the effsct of an assignment or rsceipt from sach party to the other for such property as may bs in ths individual possessions of sach of the parties hereto, the effsctive date of ssid bill of sale to bs contsmporansous with the dato of the execution of this Agrsement. 11. WAIVER OF ALIMONY AND SUPPORT. The parties acknowlsdgs that thsy ars aware of ths Incoms, education, Income potential, and asssts and holdings of the other or have had full and ampls opportunity to becoms familiar with such items. Both partlss acknowledgs that they srs sble to support and maintain themselvss comfortably, without contribution from ths othsr beyond that as provided for in this Property Settlsment Agrssment, upon the Incoms and asssts ownsd by esch of them. The parties hersby accspt the mutusl covenants snd terms of this Agresment and the benefits and propsrtles passed to them hersunder in lieu of any and all further rights to support or alimony for themself, counssl fess, and alimony pendente lite at this time and during any snd all further or futurs ctions of divorce brought by either of ths parties hsreto and the parties do hersby rsmlse, eleass, quit claim, and rsllnquish forever any and all right to support, alimony, alimony sndente Iits, counsel fses and expenses beyond thoss providsd for hersin, during ths sndency of or ss a result of any such actions, as provided by the Divorce Code of snnsylvanla or any other applicable statuto, at this timo and at any tims In tho future, 12, WAIVER OF FURTHER EQUITABLE DISTRIBUTION, The parties acknowledge hat sach of tham havs had a full and ample opportunity to consult with counsel of thsir B , cholcs regarding thsir claims arising out of the marriage and dlvorcs and that thsy have specifically reviswed their rights to the equitable distribution of marital propsrty, Including rights of discovery, the right to compel a filing of an Inventory and Appraissmsnt, and ths right to have the court rsview the assets and claims of ths parties and decide them as part of the divorce action, Being aware of those rights, and bslng aware of the marital propsrty ownsd by sach of ths partiss, the partiss hersto, in consldsratlon of the othar tsrms and provisions of this agrssment, do hereby wsive, releass and quitclaim any furthsr right to havs this court or any other tribunal equitably distribute or divids their marital propsrty and do hsrsby furthsr waivs, releass snd quitclaim any and all claim against or Interest in assets now currsntly in ths possession or held in the nams of the other, it being thsir intention to accspt the terms and provisions of this agreemsnt in full satisfaction of sll of thsir claims to the marital property of the parties and the equitable distribution of the sams, 13, WAIVER OF FURTHER FORMAL DISCOVERY. The partlss hereby rspressnt that thsy havs agrsed to ths foregoing division or distribution of property in an sffort to resolve sll dlsputss rslating to thsir marital property and obligations and to maks an squltable distribution of thsir marital propsrty as contemplated by ths Divorce Code of Psnnsylvania, The parties scknowledge that thsy have the right to ask a court of appropriate jurisdiction to make squitable distribution of their marital property and to sngags In formal litigation to have the court do so. Because of the division or distribution of marital propsrty to which they have agreed, as provided for in this Property Ssttlsmsnt Agreement, and knowing their rights to have ths court equitably distributs or divids their marital property fOllowing litigation by the parties, the partlss hersto do hereby waive and release any right to hsvs the court make such squitable distribution or for them to litigate any claims rslating to equitable distribution In the divorcs action contsmplated by ths parties, 14, WAIVER OF ESTATE CLAIMS, Husband releases his inchoate intestate rights in he sstate of Wife and Wifs releases her Inchoats intestats rights in the estate of Husband, nd sach of the partlss hersto by thsse prssents for himself or herself, his or her hslrs, ~ t sxecutors, administrators, or assigns, does remiss, relsase, quit claim, and forever discharge the othsr party hsreto, his or hsr heirs, executors, administrators, or assigns, or any of thsm, of any and all claims, demands, damages, actions, causss of action or suits of law or in equity, of whatsoevsr kind or nature, for or because of any matter or thing done, omitted, or suffsred to be dons by such othsr party prior to the date hsreof; except that this releass shall In no way exonerate or dischargs either party hsrsto from ths obligations and promlsss mads and impossd by reason of this agrsement and shall in no way affsct any causs of action in absolute divorce which sither party may have against the othsr. 15. WAIVER OF OTHER CLAIMS. Except as hsrein otherwise provldsd, esch party hersto may dlsposs of his or her propsrty in any way, and each party hersby sxprsssly waivss and rslinquishes any and all rights he or she may now have or hereafter acquire, under ths prssent or futurs laws of sny Jurisdiction, to share in the propsrty or the sstats of the othsr as a rssult of ths marital relationship, including, without limitation, ths right to equitable division of marital propsrty, alimony, slimony pendente lite, and counsel fees, xcspt as providsd for otherwise in this Agreement, dowsr, courtssy, statutory allowancs, widow's allowancs, right to taks in intestacy, right to take against the will of the other, and ight to act as administrator or exscutor of the other's estats, and sach will, at ths request f ths othsr, exscuts, acknowledge, and delivsr any and all instrumsnts which may be scsssary or advisabls to carry into effect this mutual waiver snd relinquishmsnt of all such nterssts, rights, end clsims, 16, DISCLOSURE OF DEBTS. The parties hereto mutually represent to ths other hon nslther of them has incurred any debts in the name of the othsr not previously isclossd or provided for in this agreement. Each of the parties hereby reprssents to the thsr that neithsr ons of them have incurred or contracted for dsbts in ths name of the othsr r for which ths othsr is or would bs legally liable from and after ths date of the parties' eparatlon, Both parties hereto mutually agree and promise that neither will contract or thsrwise incur debts in the other's or Joint names without the prior permission and consent 10 of the othsr party hsrsto, Both partlss hsreto repressnt and warrant to ths othsr party that they havs not so contrscted any debts unbeknownst to the other up to the time and date of this Agrsemsnt, 17, DISCLOSURE. Both of the parties hersto reprssent to the other that they havs made full disclosurs of the asssts and income and income sources ownsd, controllad, or enJoysd by eithsr of them and that neithsr party hereto has withhsld any flnancisl information from ths othsr, Each of the parties rsprssents thst thsy havs revlswsd this information with an attornsy of their choice, or had ths opportunity to review this information with an attorney of their choice and voluntarily decided not to do 50. 18. CONCLUSION OF DIVORCE. The parties acknowlsdge that this agresment 15 mads in contsmplatlon of the conclusion by both of thsm of an action In divorce which has bssn filsd or will be filed shortly by one of the parties hsreto. Both of the partlss hereto agree that they shall, contemporansously with the exscution of this agrssmsnt, sxecute and dslivsr to thslr rsspective attorney or attorneys, an Affidavit of Consent undsr Section 3301 (cl of the Divorcs Code, consenting to the entry of a final dscres In divorce, and a alver of further notice for the entry of such decree. Both parties agrse that they shall ccept the tsrms and provisions of this agreement in full satisfaction of sny claims they may avs under the Divorce Code of ths Commonweaith of Pennsylvania, including, but not Imitsd to, alimony, alimony pendente lite, counsel fess, equltsble distribution, and the like, 19, BREACH AND ENFORCEMENT, In the event that any of the provisions of this gresmsnt are brssched or violated by either of the parties, the other party shall bs sntitled o enforcs this agreement by an appropriate action in law or in equity or to take any other ctlon to which thay ars lawfully entitled to enforce this agreement or otherwise protect hsir rights. In ths evsnt that such action is commenced by one of the parties and the other arty is found to have brsached or violated any of the terms and provisions of this greement, the party hsving so violated or breached the agreement, shall be responsible for 11 .. and shall promptly pay upon demand ths reasonable attorney's fees incurred by the other party to snforce thslr rights hersundsr, 20, CHOICE OF LAW, This Agrsemsnt shall be Intorprsted, applisd and enforcsd In accordancs with ths laws of, and by the courts of, ths Commonwsalth of Pennsylvania. 21. SEVERABILITY, If for any rsason whatsoever any part of this Agrsement shall bs declarsd void or Invalid, only such part shall be desmsd void and In sll othsr rsspscts this Agresmsnt shall rsmaln valid and fully snforcsable. 22. NON.WAIVER. An affidavit under Section 3301(d) was filed by the plaintiff on December 1, 1997, averring that the parties separated on or about November 30, 1995. Mr. Andes has indicated that he is going to discuss with his client the possibility that she may file an affidavit of consent so that the divorce can conclude under Section 3301(C). Mr. Scheuren did file an affidavit of consent on March 17, 1997. The divorce complaint also raised the economic issue of equitable distribution. On February 13, 1996, wife filed an answer and counterclaim in response to the complaint and raised on her own behalf the economic claim of equitable distribution and the additional claims of alimony, alimony pendente lite, and counsel fees and expenses. Counsel have advised that we will most likely need to have testimony on the factor of marital misconduct as that factor affects wife's alimony claim. The basis of the allegation apparently is an alleged extra marital relationship which husband had prior to the parties' separation. Mr. Russo has suggested a list of witness today; Mr. Andes is going to perhaps engage in some discovery to determine the testimony that the witnesses will offer on this limited issue. We will schedule a separate hearing on the marital misconduct factor. The parties were married on May 26, 1962, and we have three dates of separation which counsel are going to try to resolve, those dates being November 28, 1995, November 30, 1995, and December 29, 1995. The November 28 date is the date that the complaint was filed; the November 30 date is the date stated in the affidavit under Section 3301(d) filed by husband; and the December 29 date is the date that wife claims that the parties actually physically separated and discontinued residing in the same residence. The parties are the natural parents of three children, all of whom are emancipated. There is a child, James, who may on occasion reside with the mother. Husband is 59 years of age and resides at 508 Ellen Road, camp Hill, Pennsylvania, with a female friend. He has an as.ociates degree through a correspondence course and was an engineer/contiultant with PP&L. At the time that he was employed he was grossing biweekly around $2,450.00. Counsel for husband is going to get updated information on his pension payments since he has retired. According to Mr. Russo he did not officially begin receiving payments until some time in the winter of 1998. Mr. Scheuren has not raised any health issues other than the fact that counsel indicated he may have some limited hearing problems. Hr. Russo also indicated that he did not believe his client was going to enter the job market again and was going to remain in a retired status. Wife is 54 years of age and resides at 66 Old Federal Road, Camp Hill, Pennsylvania, where she lives alone with the occasional Sharing of the residence with the son James. Wife is a high school graduate and works as a receptionist for Byerly Insurance Agents & Brokers, Inc. She reports a gross annual income of $22,198.00 and a net monthly income of $1,252.76. Wife has medical insurance coverage through her employment and has not raised any health issues. Neither party is receiving nor paying spousal support or alimony pendente lite. Wife is residing in the marital home at 66 Old Federal Road, camp Hill, Pennsylvania, which counsel have stipulated has a value of $185,000.00. As of December 31, 1995, the balance on the mortgage was around $49,000.00. Counsel are going to get an updated statement on the mortgage payoff as of the date of the hearing. Wife has indicated that she would like to remain in the house. The mortgage payment currently to Mechanics Savings and Loan Association is $547.71 monthly, but that does not include taxes and insurance. According to counsel, husband was making the mortgage payments until December of 1997 which was considered in the decision by wife not to file any claims for spousal support or alimony pendente lite. Since December 1997 wife has been responsible for the payments. The parties own two vehicles, one being a 1989 Dodqe Dynasty which wife has valued at $5,000.00 and husband has valued at $8,500.00. This vehicle is in wife's possession. Huaband has in his possession a 1988 Ford Ranqer pickup truck which he has valued at $4,600.00 and wife has valued at $4,000.00. There is a third vehicle in husband's possession, a 1995 Dodqe Caravan which he claims is worth around $13,000.00 which is the amount of money that is due to buy the car under the terms of the lease if he chooses to retain the vehicle. Consequently, for purposes of equitable distribution, the Caravan may have no value. Wife is participatinq in a stock Ownership Plan with her employer as well as a 401(k). Mr. Andes has provided some tiqures for the values of those plans in his pre-trial statement but we all aqree he needs to qet updated values. Accordinq to Mr. Russo, the parties still have a checkinq and savinqs account at PP&L Credit Union. Mr. Russo has stated in his pre-trial statement that the checkinq account has a value of $45.80 and the savinqs account has a value of $428.22. Mr. Russo has indicated that those accounts still exist and neither party has been usinq the accounts. Husband, as indicated, is retired from PP&L and has a payment monthly from his pension from PP&L. We need to establish the amount of money he is receivinq monthly and also account for any monies he has received from the date of s~paration to the date of hearinq to allow wife a credit since the payments that he has been receivinq are marital property. Husband also has the benefit of a savinqs plan with PP&L and an Employee stock Plan and Dividend Reinvestment Plan. Counsel are qoinq to qet updated statements on those plans so they can be utilized in the equitable distribution computation. There will be no need to have any valuation done, however, of the pension plan since, as noted, it is in pay status. The Master also inquired about the survivor benefit option and apparently husband has chosen to name wife as a beneificiary of the survivor benefits but Mr. Andes has requested verification of that status. Husband has an IRA with Cova Financial Life Ineurance Company. We need to have an updated statement on that value as counsel have provided estimated amounts and, of course, the statement would qive us the actual value as of the current date and as of the date of separation. It is not likely that Mr. Scheuren contributed to the IRA fo11owinq the separation so that a date of hearinq statement would be accurate. However, if contributions were made after separation they need to be . , considered in arriving at a value. Husband is a participant in a Power Partners and Lenders stock Club which Hr. Russo has suggested has a value of $150.00. Hr. Andes has asked for verification of the value of Hr. Scheuren's interest in that club. Two insurance policies were noted on the pre-trial statementa, a Nationwide Life Insurance policy and a PP'L policy. Hr. Russo has indicated that neither policy has any cash value. Counsel have indicated that with respect to the Nationwide Life Insurance policy, husband has named two of the children as the beneficiaries under the policy and will probably continue to agree to maintain them as the beneificiaries. Hr. Russo is going to provide information on the policies as we are not even certain whether they are term policies and how they may be related to Hr. Scheuren's employment with PP'L. Hr. Scheuren has provided a list of household tangible personal property with his opinion of values. Apparently a substantial amount of the property remained with wife although Mr. Scheuren did take some property with him when he separated. Hr. Andes is going to have the property appraised. Wife inherited in 1993 some real estate and some tangible property including household furnishings, a mink coat, mink stole, and jewelry from her aunt in Ashland, Pennsylvania. Mr. Russo has indicated he is not going to raise an increase in value issue but would want us to consider the fact that there is some property which wife has of a nonmarital nature, which is one of the factors to consider in the equitable distribution analysis. There are no marital debts other than the mortgage and the lease on the Caravan. Hr. Andes has a photocopy of a stock certificate dated December 1995 showing ownership by the parties of shares in Prime Hospital Corp. Counsel are going to try to determine from their clients the status of this stock and if it has any value. Hr. L PENSION INFORMATION, Defendant does not own an interest in any pension. Her employment benefits are a profit sharing plan and an ESOP which can easily be valued by review of periodic statements. . . , . . ~ , Plaintiff enjoys a substantial pension as a result of his ell1ploYll1ent during the marriage by Pennsylvania Power and Light Company and Defendant believes that the pension will be in pay status by the time of the hearing. Ifthat is the case, it will not be necessary to value the pension, because the Court can simply divide the pension by awarding to Defendant her share of the marital portion of the pension payments each month.. In addition, Defendant believes that Plaintiff has received any early retirement incentive package from his employer which results in his receiving payments from the employer, or its pension fund, to supplement his regular pension payments until he reaches the age at which he is eligible for full social security benefits. If Husband is entitled to those payment a portion of them represents marital property which the Court must divide as well. Those benefits should be distributed in the same fashion as the other pension benefits. I. COUNSEL FEES. Defendant has engaged the services of Samuel L. Andes at the hourly rate ofs I 50.00. Her attorneys fees are anticipated to be substantial by the time ofthe hearing and she will ask the Court to award counsel fees to her from the Plaintiff. At the hearing she will provide an itemized statement of the services by her allomey up to that time. 2. PERSONAL I'BOPEP-rv. Defendant anticipates the parties will be able to agree upon the distribution of the tangible personal property and household goods. In the event they cannot, she proposes that the items be appraised and that the parties stipulate the appraised value of the assets into the record and agree upon which party is to have which item. ~ MARITAL DEBTS, The only significant marital debts known to Plaintiff are those listed on Schedules A and B. 1J. Scheuren, by and through his counsel and avers the following in support of his request for a continuance: 1, On or about May 7, 1998, Plaintiff filed a Petition for Bifurcation of the above-captioned divorce action, 2, On or about May 9, 1998, the Honorable J, Wesley Oler, Jr,lssued an Order of Court scheduling a hearing on the issue of bifurcation for Thursday, August 13, 1998, at 1:30 p.m, A true and correct copy of said Order is attached hereto as Exhibit A. 3. The parties have engaged in significant and fruitful settlement negotiations and it appears the parties are close to finalizing a property settlement agreement and executing Affidavits of Consent. 4, Counsel for both parties agree that the parties attendance at a bifurcation hearing would likely result in the breakdown of progress made thus far in the settlement negotiations and may eliminate any future chance to resolve the outstanding issues. Order .. a Qualified Dome.tlc Relation. Order: This Order creates and recognizes the existence of an Alternate Payee's right to receive a portion of the Participant's benefits payable under an employer-sponsored defined contribution pension plan that Is qualified under Section 401 of the Internal Revenue Code (the "Code") and the Employee Retirement Income Security Act of 1974 ('ERISA'), It is Intended to constitute a Qualified Domestic Relations Order ('QDRO') under Section 414 (p) of the Code and Section 206(d)(3) of ERISA and the Retirement Equity Act of 1984, P.L. 98.397 6. Pur.uant to State Domeatlc Relations Law: This Order Is entered pursuant to the authority granted in the applicable domestic relations laws of Pennsylvania, 7. For Provisions of Marital Property Rights: This Order relates to the provision of marital property rights as a result of the Order of Divorce between the Participant and the Alternate Payee. 8. Amount of Alternate Payee's Benefit: This Order assigns to the Alternate Payee an amount equal to One Hundred Sixty-Four Thousand Two Hundred Eighty-Two Dollars and Forty Cents ($164,282,40) of the Participant's Total Account Balance accumulated under the Plan as of March 12, 1999; reduced by any amounts already distributed to the Alternate Payee from the Plan, Further, such Total Account Balance shall Include all amounts maintained under all of the various accounts and/or sub accounts established on behalf of the Participant. The Alternate Payee's portion of the benefits described above shall be allocated on a prorata basis from all of the accounts and/or Investment funds maintained under the Plan on behalf of the Participant, Such benefits shall also be segregated and separately maintained in a nonforfeitable Account(s) established on behalf of the Alternate Payee, This Account(s) will initially be established In the same fund mix percentages as the Participant maintains in his account. Additionally, the Alternate Payee's account shall be credited with any Interest and Investment income (or losses) attributable thereon from March 12, 1999, until the date of total distribution to the Alternate Payee, 9. Commencement Date and Form of Payment to Alternate Payee: If the Alternate Payee so elects, her benefits shall be paid to her as soon as administratively feasible folloWing the date this Order Is approved as a QDRO by the Plan Administrator, or at the earliest date permitted under the terms of the Plan or Section 414(p) of the Interal Revenue Code, If later, Benefits will be payable to the Altemate Payee In any form or permissible option otherwise available to participants under the terms of the Plan, Including, but not limited to, a single lump-sum cash payment. 10. Alternate Payee's Rights and Privileges: On and after the date that this Order Is deemed to be a Qualified Domestic Relations Order, but before the Altemate Payee receives her total distribution under the Plan, the Altemate Payee shall be entitled to all of the rights and election privileges that are afforded to Plan participants and beneficiaries, Including, but not limited to, the rules regarding In- service withdrawals and distributions, the right to designate a beneficiary for death benefit purposes, and the right to direct Plan Investments, all to the extent permitted under the provisions of the Plan, 11. Death of Alternate Payee: In the event of the Alternate Payee's death prior to her receiving the full amount of benefits called for under this Order and under the benefit option chosen by the Alternate Payee, such Altemate Payee's beneficlary(ies), as deSignated on the appropriate form provided by the Plan Administrator, shall receive the remainder of any unpaid benefits under the terms of this Order, and In accordance with the benefit option selected by the Alternate Payee, 12. Death of Participant: In the event that the Participant dies prior to the establishment of separate account(s) In the name of the Alternate Payee, such Alternate Payee shall be treated as the surviving spouse of the Participant for any death benefits payable under the Plan to the extant of the full amount of her benefits as called for under Paragraph 8 of this Order, Should the Participant predecease the Alternate Payee after the new account(s) have been established on her behalf, such Participant's death shall In no way affect the Alternate Payee's right to the portion of her benefits as stipulated herein, 13. Savlnga Claule: This Order Is not Intended, and shall not be construed In such a manner as to require the Plan: (a) to provide any type or form of benefit option not otherwise provided under the terms of the Plan; (b) to require the Plan to provide Increased benefits determined on the basis of actuarial value; or (c) to require the payment of any benefits to the Altemate Payee which are required to be paid to another alternate payee under another order that was previously deemed to be a aORO, (d) to make any payment or take any action which Is Inconsistent with any federal or state law, rule, regulation or applicable JUdicial decision. 14. Certification of Necelaary Information: All payments made pursuant to this Order shall be conditioned on the certification by the Alternate Payee and the Participant to the Plan Administrator of such Information as the Plan Administrator may reasonably require from such parties to make the necessary calculation of the benefit amounts contained herein, 15. Continued Qualified StatuI of Order: It Is the Intention of the parties that this aORO continue to qualify as a aORO under Section 414(p) of the Internal Revenue Code, as It may be amended from time to time, and that the Plan Administrator shall reserve the right to reconfirm the qualified status of the Order at the time benefits become payable hereunder, 16. Tax Treatment of Distributions Made Under This Order: For purposes of Sections 402(a)(1) and 72 of the Internal Revenue Code, any Alternate Payee who Is the spouse or former spouse of the Participant shall be treated as the distributee of any distribution or payments made to the Alternate Payee under the terms of this Order, and as such, will be required to pay the appropriate federal Income taxes on such distribution, 17. Conltructlve Receipt: In the event that the Plan Trustee Inadvertently pays to the Participant any benefits that are assigned to the Alternate Payee pursuant to the terms of this Order, the Participant shall Immediately reimburse the Alternate Payee to the extent that the Participant has received such benefit payments, and shall forthwith pay such amounts so received directly to the Alternate Payee within ten (10) days of receipt. 18, Effect of Plan Termination: In the event of a Plan termination, the Alternate Payee shall be entitled to receive her portion of the Participant's benefits as JAM" N.ICHEUII.EN IIIMM" v.
