Def.ndant entered into a Retail Installment credit Agr....nt with Plaintiff. Said account is known and numbered as 1058958901. 4. Th. application for the retail installment account wae tak.n by telephone solicitation. The terms of the credit agr.em.nt were mailed to the Defendants and became accepted and agr..d to by th.ir us. of the account. AB evidence whereof, a copy of the Plaintiff's affidavit is attached hereto, made a part hereof and marked Exhibit "A", 5. From time to time, Plaintiff at Defendant's specific request extended credit to Defendants. 6. Defendant purchased and received goods and merchandise from Plaintiff thereby utilizing the credit account established in their behalf. As evidence whereof, copies of billing statements sent to Defendants by Plaintiff are attached hereto, made a part hereof and marked Exhibit "B". 7. The prices charged for said merchandise were fair and reasonable and were agreed to by the Defendants. 8. Any and all monies received have been credited to the Defendant's account. 9. Demand has been made upon Defendant for the amount due, but all demands remain unheeded. 10. As a result of the Defendant's failure to make satisfactory payments on their credit account and, under and pursuant to the Credit Agreement, are now indebted to Plaintiff in the amount of $1,056.03 along with interest at the rate of 18% per annum. As evidence whereof, a copy of the terms of tho credit agreement is attached hereto, made a part hereof and marked as Exhibit "C". 11. Pursuant to paragraph #6 of the Credit Agreement, Defendants are also responsible for reasonable attorney's fees not to exceed 20% and the costs of this proceeding.
