IN CUSTODY COMPLAINT FOR CUSTODY Kathryn Mattel is the mother of the Defendant, Troy Matthew Ross and is thus the maternal grandmother of the children in question and currently resides in Ft. Lauderdale, Florida. Doreen Rosenberry has physical custody of three of the children and lives at 6541 Roxbury Road, Shippensburg, Pennsylvania 17257 which is a Franklin County address. Defendant Troy Matthew Ross is believed to reside at 237 Lincoln Street, Carlisle, PA 17013 which is a Cumberland County address and he is the father of the minor children in question. Cami Rider is the mother of the children in question and she resides in the York County Prison. She is not eligible for parole for approximately six (6) months. The relationship of plaintiffs to the children are that of maternal grandmother and guardian. The plaintiffs currently reside with the following persons. A Custody Complaint has been filed in this matter and is attached and incorporated by reference as Exhibit "A". 2. Defendant, Troy Matthew Ross, the father of the children has threatened to take them from the physical custody of Doreen Rosenberry and Monann Bailor. 3. Father has indicated he intends to put the children with different relatives of his. 4. Father has a history of providing inadequate care and neglecting the welfare of the children, as well as drinking to excess. 5. The mother is currently incarcerated in York County Prison and is unable to assist with care. 6. Previously mother and father placed these children in the current arrangement. 7. Plaintiffs seek an Order restraining father from interfering with the status quo. 8. Father has not seen the children since mid-July, and does not have a drivers license. 9. Plaintiffs fear father will move the children to places unknown based upon information that he has communicated to Plaintiff Doreen Rosenberry and her mother, Monann Bailor. 10. Pending conciliation in this matter, Plaintiffs request this Honorable Court enter a Temporary Custody Order granting joint legal custody to Kathryn Mm'tel, Doreen Rosenberry, Troy Ross and Cami Rider, and granting Kathryn Mattel and Doreen Rosenberry primary physical custody with visitation in father, Troy Matthew Ross on alternating weekends beginning this weekend. Father shall be responsible for all transportation. 8. Agreement to this Order shall in no way prejudice the parties to any legal issues they may raise in the future. Sparler, Esquire; custodian, Monann Bailor, pro se; Mother, Cami Rider, being in the York County Prison did not appear and was not available by telephone although she was notified of the hearing. 3. The parents transferred custody of Makayla Ross to Monann Bailor approximately two years ago. She lives in York County. Monann Bailor is not a party to this action but has received all pleadings. It is recommended that the Court consider ordering the plaintiffs to interplead Monann Bailor. 4. In April, 2002, the parents transferred custody of the remaining three children to Doreen Rosenberry, one of the plaintiffs herein, when Mother was advised she would retum to prison for a probation violation on a DUI charge. Doreen Rosenberry lives in Franklin County. 5. Counsel for Father requested a continuance of the conciliation conference in order to file Preliminary Objections to the jurisdiction of Cumberland County since none of the children live in Cumberland County. 6. The Honorable J. Wesley Oler, Jr, entered an Emergency Order dated October 2, 2002 maintaining the status quo. 7. The caregivers have been advised that Cumberland County Children & Youth Services is conducting a child abuse investigation regarding the three older children. The caregivers were advised by Children & Youth. and the Pennsylvania State Police who is investigating the allegations also not to permit any visitation between the children and their parents. Notice of the investigation pursuant to the Child Protective Services Act has not been given to the parents yet. 8. The parties agreed to the entry of an Order in the form as attached, permitting Father supervised visitation with the children. Date ~Jacq~geline M. Other than for the Defendant, Troy Matthew Ross, none of the parties nor the children reside in Cumberland County and none of the children have resided in Cumberland County for the last twelve (12) months. 8. The children have been in the custody of the Plaintiff, Doreen Rosenberry, and residing in Franklin County and with Monann Bailor, who resides in York County for a period in excess of twelve (12) months. 9. Pursuant to Pa.R.C.P. 1915.2, "An action may be brought in any county, (1) which is the home county of the children at the time of commencement, . . . which had been the child's home county within six (6) months before commencement of the proceedings . The within action was improperly brought in Cumberland County and with regard to Tyler Lee Strouse, Amethyst Shyann Ross and Hunter David Ross should be in Franklin County. The issues as to custody of Makayla Ann Ross should be in York County.
