ZIMMERMAN, single man, of 139 Pine Knob Road, Newville, Pennsylvania, hereinafter referred to as Contractor, AND Ye'ESLEYp. ZIMMERMAN, single man, of 139 Pine Knob Road, Newville, Pennsylvania, hereinafter referred to as Owner, WHEREAS, the said Contractor undertook and agreed to make certain improvements to Owner's property located at 139 Pine Knob Road, Newville, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof· NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and !n consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for himself, and his subcontractors, and ail parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and improvements and the lot of ground appurtenant thereto for or on account of any work done or materiais furnished by them or any of them under said contract or otherwise, for, towards, ~n, or about the erection and construction of the said improvements on the · oo lot above described, and the said Contractor, for himself, his subcontractors and others under him hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered in the Presence of Wesley ~tractor BEGINNING at an existing iron pin located in the centerline of Route T-401, also known as Pine Knob Road, said pin located at Northeast comer of Lot 9; being known as Lot No. 7A; thence along said centerline South 85 degrees 39 minutes 49 seconds East Two Hundred Sixty-seven and eight hundredths (267.08) feet to an existing iron pin in the centerline; thence continuing along the centerline North 86 degrees 48 minutes 15 seconds East One Hundred Fifty-two and fifty-eight hundredths (152.58) feet to a point; thence North 31 degrees 04 minutes 46 seconds West Twenty-one and sixty-six hundredths (21.66) feet to a point; thence North 86 degrees 48 minutes 15 seconds East Sixty-one and eight hundredths (61.08) feet to a point; thence South 43 degrees 12 minutes 31 seconds East Sixty-five and forty-seven hundredths (65.47) feet to a point; thence along lands now or formerly of Martin E. Lichtenberger South 43 degrees 12 minutes 31 seconds East Eight Hundred Fifty-seven and eleven hundredths (857.11) feet to an existing iron pin; thence along lands now or formerly of Lee A. Clouse South 47 degrees 15 minutes 00 seconds West Eight Hundred Seventy and zero hundredths (870.00) feet to an existing iron pin; thence along lands now or formerly of Donald E. Linebaugh et ux., North 37 degrees 09 minutes 57 seconds West Three Hundred Eighty and three hundredths (380.03) feet to an existing iron pin located at the corner of an existing private right of way; thence North 68 degrees 38 minutes 42 seconds West Fifty and zero hundredths (50.00) feet to an existing iron pin located at the boundary of Lot 7; thence North 21 degrees 21 minutes 18 seconds East Two Hundred and zero hundredths (200.00) feet to an existing iron pin at the corner of Lot 7; thence along Lot 7 and Lot 9 North 19 degrees 05 minutes 13 seconds West Seven Hundred Eighty-eight and seventy-seven hundredths (788.77) feet to an existing iron pin located in the centerline of the said Pine Knob Road, the place of BEGINNING. CONTAINING 16.7466 acres, more or less. BEING THE SAME REAL ESTATE WHICH J. RAY HEISEY and MIRIAM H. HEISEY, husband and wife, DONALD E. L1NEBAUGH and KIMBERLY L. LINEBAUGH, by deed dated April 9, 1998 and recorded in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 175, Page 288, granted and conveyed to WESLEY p.
