WHEREAS, Robert J. Prechtl and Nancy J. Prechtl, of 940 Willcliff Drive,
Mechanicsburg, Cumberland County, Pennsylvania (herein "Owner") is about to execute
contemporaneously herewith, a contract, with W. Lee Roland, of 101 Windrush Lane,
Mechan~csburg, Cumberland County, Pennsylvania (herein "Contractor"), for the erection of a
building(s) upon
ALL THAT CERTAIN Lot or tract of land as set forth on Exhibit "A"
attached hereto and incorporated herein by reference.
NOW, ~tO ~.grr~J4'~ ~; ,2002, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Owner to
the said Contractor to commence work on the said building(s), or purchase materials for the same
in consideration of the making of the said contract with Owner and the further consideration of
One ($1.00) Dollar in hand paid to Contractor by Owner, receipt of which is hereby
acknowledged, it is agreed that no lien shall be filed against the building(s) by the Contractor, or
any sub-contractor, nor by any of the material-men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said building(s),
the right to file such liens being expressly waived.

Nancy Lane South prepared by Gerrit J. Betz Associates, Inc., Engineers 8 Surveyors, dated January 13, 1989,
revised February 16, 1989 and February 27, 1989 and recorded in Cumberland County Plan Book 58, Page 73-A,
as follows:
BEGINNING at an iron pin set at the northwestern corner of Lot No. 10 as shown on the above mentioned
Plan of Lots; thence along said Lot No. 10, South 08 degrees 15 minutes 14 seconds East 395.87 feet to an iron
pin set; thence along lands now or formerly of Ray E. and Nancy L. Rudy, South 89 degrees 18 minutes 42
seconds West 346.64 feet to an iron pin set; thence along lands now or formerly of Paul and Eugenia Monks,
