NOW comes South Mountain Plumbing & Heating Co. by and through Its attorneys,
FLOWER, MORGENTHAL, FLOWER & LINDSAY, P.C., and states as follows:
1. Plaintiff is South Mountain Plumbing & Heating Co., a sole proprietorship, with a
principal place of business at 7 Oak Drive, Newville, Cumberland County, Pennsylvania 17241.
2. Cumberland Homes, Inc. is a Pennsylvania corporation with its principal place of
business at 2231 Ritner Highway, Carlisle, Cumberland County, Pennsylvania.
3. Steven P. Calaman is an adult individual who resides at 2231 Ritner Highway, Carlisle,
Cumberland County, Pennsylvania 17013.
4. Rodger L Hosfelt is an adult Individual who resides at 115 South Side Drive, Newville,
Cumberland County, Pennsylvania 17241.
5. Defendants Calaman and Hosfelt are agents of Cumberland Homes, Inc.

6. In August, 1994, Defendants Calaman and Hosfelt, on behalf of Cumberland Homes,
Inc., hired Plaintiff, an Independent contractor, to provide boiler Installation and certain plumbing
work as a sub.contractor to Defendant Cumberland Homes, Inc. for a home Defendants were
building at Farm Road, Newville, Cumberland County, Pennsylvania.
7. Defendants agreed to pay Plaintiff for his work on a time and materials basis, and
advanced Plaintiff $5,000,00 against the purchase and Installation of a boiler and heating system.
8. Defendants did not pay the balance due Plaintiff on the Initial work. Defendants,
however, requested Plaintiff to perform additional plumbing services for the Farm Road project,
agreeing to pay Plaintiff on a time and materials basis, with Interest at the rate of 1.5% per month.
9. Plaintiff provided materials and performed all work required of him in a workmanlike
manner.
10. Plaintiff made demand to Defendants for payment commencing October 6, 1994. A
copy of said Invoices are attached hereto as Exhibit "A".
11. Although Plaintiff has made repeated demands for payment, Defendants have failed
or refused to pay.
12. The amount outstanding, Including Interest through October 23, 1995, Is $4,852.18.
Said amount Includes credit for the single advance give to Plaintiff by Defendants.

WHEREFORE, Plaintiff prays this Honorable Court to enter Judgment for Plaintiff and against
Defendants In the amount of $4,852.18 with Interest as aforesaid, Interest after Judgment at the
legal rate, and costs. this claim does not exceed $25,000.00.

DEFENDANTS' PRELIMINARY OBJECfION TO
PLAINTIFF'S COMPLAINT
Defendants, CUMBERLAND nOMES, INC., STEVEN P. CALAMAN, and
ROGER L. HOSFEL T, by their undersigned attorney, preliminarily object to Plaintill's
Complaint pursuant to Pa R.C.P. 1028 (a)(5) as follows:
PRELIMINARY OBJECfION RAISING PLAINTIFF'S LACK OF CAPACITY
TO SUE FOR FAILURE TO REGISTER FICfITIOUS NAME
J. Plaintill's name, SOUTH MOUNTAIN PLUMBING & HEATING CO., is a
fictitious name within the meaning of Section 302 of the Pennsylvania Fictitious Names Act
(hereinafter" Act"), 54 Pa. C.S. Section 302.
2. Plaintill's fictitious name is not now registered with the Commonwealth, and was not
registered prior to the institution of the action as required under the Act.
3. Under the Act, no 'action can be maintained by a party using a non-registered fictitious
name until registration and any other necessary compliance with the Act has occurred.

4. Plaintilfis, accordingly, without capacity to sue to maintain this action and is barred
from maintaining this action against Defendants under the Act.
5. The contract upon.which Plaintilfhere sues was entered into by the Plaintilfusing a
non-registered fictitious name.
6. Under Act 54 Pa. C.S. Section 331 (b), a Plaintilfmust pay $500.00 civil penalty to the
Commonwealth before he is allowed to institute suit on a transaction where a non-registered
fictitious name was used.
7. Plaintilfhas not paid a $500.00 penalty to the Commonwealth in connection with the
transaction upon which this action is based.
8; Plaintilfis, accordingly, for this reason also barred from instituting and maintaining this
action in this Court.
WHEREFORE, Defendants respectfully request that Plaint ill's Complaint be dismissed.

NOW comes South Mountain Plumbing & Heating Co. by and through Its attomeys,
FLOWER, MORGENTHAl, FLOWER & UNDSAY, P.C., and states as follows:
1. Plaintiff Is South Mountaln Plumbing & Heating Co., a sole proprietorship, with a
principal place of business at 7 Oak Drive, Newville, Cumberland County, Pennsylvania 17241. On
or about January 15, 1996, South Mountain Plumbing & Heating Co. registered Its fictitious name
with the Department of State of the Commonwealth of Pennsylvania. A copy of the Application for
Registration is attached hereto as Exhibit "A",
2. Cumberland Homes, Inc. Is a Pennsylvania corporation with Its principal place of
business at 2231 Ritner Highway, Carlisle, Cumberland County, Pennsylvania,
3, Steven P. Calaman is an adult Individual who resides at 2231 Ritner Highway, Carlisle,
Cumberland County, Pennsylvania 17013.

4. Rodger L. Hosfelt Is an adult IndMdual who resides at 115 South Side Drive, Newville,
Cumberland County, Pennsylvania 17241.
5, Defendants Calaman and Hosfelt are agents of Cumberland Homes, Inc,
6. At all relevant times, Defendants conducted their business directly with M. Martin
Smyser, the sole proprietor of South Mountain Plumbing & Heating Co. with whom they had done
business In the past, and with whom they were familiar as Individuals, through their trades, and
as the sole proprietor of South Mountain Plumbing & Heating Co.
7. In August, 1994, Defendants Calaman and Hosfelt, on behalf of Cumberland Homes,
Inc., hired Plaintiff, an Independent contractor, to provide boiler Installation and certain plumbing
work as a sub-contractor to Defendant Cumberland Homes, Inc. for a home Defendants were
building at Farm Road, Newville, Cumberland County, Pennsylvania,
8. Defendants agreed to pay Plaintiff for his work on a time and materials basis, and
advanced Plaintiff $5,000.00 against the purchase and Installation of a boiler and heating system.
g, Defendants did not pay the balance due Plaintiff on the Initial work. Defendants,
however, requested Plaintiff to perform additional plumbing services for the Farm Road project,
agreeing to pay Plaintiff on a time and materials basis, with Interest at the rate of 1.5% per month.
10. Plaintiff provided materials and performed all work required of him In a workmanlike
manner,

11. Plaintiff made demand to Defendants for payment commencing October 8, 1994. A
copy of said Invoices are attached hereto as exhibit "A".
12. Although Plaintiff has made repeated demands for payment, Defendants have failed
or refused to pay.
13. The amount outstanding, Including Interest through October 23, 1995, Is $4,852.18.
Said amount Includes credit for the single advance give to Plaintiff by Defendants.
WHEREFORE, Plaintiff prays this Honorable Court to enter Judgment for Plaintiff and against
Defendants In the amount of $4,852,18 with Interest as aforesaid, Interest after Judgment at the
legal rate, and costs. this claim does not exceed $25,000,00,
