THIS AGREEMENT made the,~ay of August, 2002, by and between,
SECHRIST CONSTRUCTION, INC., Builder, of 810 Darla Road, Mechanicsburg, Pennsylvania,
hereinafter referred to as Contractor,
AND
KEITH L. HIGHLANDS and CATHY M. HIGHLANDS, of P.O.Box 129, Newburg, Pennsylvania~
hereinafter referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland, Pennsylvania, known as Lot 8, Darla Road, situate in
Mechanicsburg, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached
hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the
lot above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain lot of unimproved land situated in the Second Ward in the Borough of Mechanicsburg~
County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described
as follows:
BEGINNING at a point on the western side of Darla Road on the lot side. of a proposed si~lewalk at the
dividing line between Lot Nos. 8 and 7 as shown on the hereinafter mentioned plan of lots; thence along
said dividing line between Lot Nos. 8 and 7, South 73 degrees 13 minutes West, a distance of 135.92
feet to a point at lands now or formerly of Spero G. and Elizabeth J. Diamond; thence along said latter
lands and lands now or formerly of Jack M. and Diane L. Pandas, North 16 degrees 47 minutes West. a
distance of 100 feet to a point at the northwest comer of Lot no. 8 as shown on the hereinafter
mentioned plan of lots; thence along lands now or formerly of Denise L. Wachtel, North 73 degrees 13
minutes East, a distance of 110.30 feet to a point on the lot side of a proposed sidewalk on the western
side of Darla Road; thence along said side of proposed sidewalk the following two (2) courses and
distances: (a) South 17 degrees 16 minutes 40 seconds East, a distance of 17.66 feet to a point: and
on a course to the left (having a chord bearing of South 33 degrees 58 minutes 28 seconds East. and
distance of 88.19 feet) an arc distance of 87.42 feet to a point on the same at the dividing line between
Lot Nos. 8 and 7 as shown on the hereinafter mentioned plan of lots, the place of BEGINNING.
BEING Lot No. 8 as shown on plan of lots entitled "Preliminary/Final Subdivision Plan tbr Heritage
Acres" dated April 14, 1999 (last revised July 20, 1999) and recorded in the Office of the Recorder of
Deeds in and fbr Cumberland County, Pennsylvania, in Plan Book 79, at Page I43.
SUBJECT TO restrictions of record as more fully set forth in Deed Book 252, at Page 3997.
BEING the same real estate that Sechrist Development Corp. by its deed dated July 23, 2002. and
recorded July 24, 2002, in Cumberland County Deed Book 252, at Page 3996, conveyed to Keith L.
Highlaods and Cathy M. Highlands, husband and wife, the Owners herein.
