MOTION FOR SERVICE OF PROCESS PURSUANT
TO SPECIAL ORDER OF COURT
Plaintiff, by its counsel, Kerry S. Schuman, Esquire, moves
this Honorable Court for an Order directing service of process upon
the above-captioned Defendant by regular mail and certified mail
and by posting of the premises 315 Hogestown Road, Mechanicsburg,
PA 17055, and in support thereof avers the following:
1. The Sheriff has been unable to serve the Complaint. A
copy of the docket entries is attached hereto as Exhibit "A".
2. Pursuant to Pennsylvania Rule of Civil Procedure 430,
Plaintiff has made a good faith effort to locate the Defendant. An
Affidavit of Reasonable Investigation setting forth the specific
inquiries made and the results therefrom is attached hereto as
Exhibit "B".
WHEREFORE, Plaintiff respectfully requests this Honorable
Court enter an Order pursuant to Pennsylvania Rule of Civil
Procedure 430 directing service of process by regular and certified
mail and by posting of the premises 315 Hogestown Road,
Mechanicsburg, PA 17055.

MEMORANDUM OF LAW
Pennsylvania Rule of Civil Procedure 430 (a) specifically
provides:
(a) If service cannot be made under the applicable
rule, the Plaintiff may move the Court for a special
order directing the method of service. The Motion shall
be accompanied by an Affidavit stating the nature and
extent of the investigation which has been made to
determine the whereabouts of the Defendant and the
reasons why service cannot be made.
Note: A Sheriff's return of "Not Found" or the fact
that a Defendant has moved without leaving a new
forwarding address is insufficient evidence of
concealment. Gonzales vs. Polis, 238 Pa. Super. 362, 357
A. 2d 580 (1976). Notice of intended adoption mailed to
last known address required a "good faith effort" to
discover the correct address. Adootion of Walker, 468
Pa. 165, 360 A. 2d 603 (1976).
An illustration of a good faith effort to locate the
Defendant includes (1) inquiries of postal authorities
including inquiries pursuant to the Freedom of
Information Act, 39 C.F.R. Part 265; (2) inquiries of
relatives, neighbors, friends, and employers of the
Defendant; and (3) examinations of local telephone
directories, voter registration records, local tax
records, and motor vehicle records.
As set forth in the docket entries attached hereto, the
Sheriff has been unable to serve the Complaint.
A good faith
effort to discover the whereabouts of the Defendant has been made,
as evidenced by the attached Affidavit of Reasonable Investigation,
marked Exhibit "A".
WHEREFORE, Plaintiff respectfully requests service of process
of the pleadings by regular and certified mail and by posting of
the premises 315 Hogestown Road, Mechanicsburg, PA 17055.

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is contiMortgage Corporation, which is a
Pennsylvania corporation duly organized and existing pursuant to
the laws of the Commonwealth of Pennsylvania, having its principal
place of business at 500 Enterprise Road, Horsham, PA,
2, Defendant is Kenneth J, Ulmer, who is an adult individual
presently residing at 315 Hogestown Road, Mechanicsburg, PA,
3, On or about May 20, 1994, said Defendants made, executed
and delivered a Mortgage upon the premises, 315 Hogestown Rd"
Mechanicsburg, PA more particularly described in Exhibit "A," which
is attached hereto and incorporated by reference herein as though
fully set forth at length, to Eastern Savings Bank, F,S,B.
hereinafter called "Mortgagee," which Mortgage is recorded in the
Office of the Recorder of Deeds of the County of Cumberland in
Mortgage Book No. 1214, Page No, 139, and the terms of which are
incorporated by reference herein as though fully set forth at
length,

4, Thereafter, said Mortgagee assigned said Mortgage to
ContiMortgage Corporation by written assignment, which is to be
recorded in the Office of the Recorder of Deeds for the County of
Cumberland, and the terms of which said Agreement are incorporated
by reference as though fully set forth at length,
5, A description of the land and premises subject to the said
Mortgage is set forth in Exhibit "A" attached hereto and
incorporated by reference herein as though fully set forth at
length,
6, The said Mortgage is in default because the monthly
payment on account of amortization of the principal of the Note
secured by said Mortgage, interest on the Note secured by said
Mortgage and other items set forth in said Mortgage, due on
November 25th, 1994, and on the 25th of each month thereafter, are
due and have not been paid, as a result of which the entire
principal of said Note and all interest due thereon, together with
late charges, attorney's commission for collection, and other items
as set torth in said Mortgage and Note, are now due and payable,
A true and correct copy of said Note is attached hereto as Exhibit
"B," the terms of which are incorporated by reference herein as
though fully set forth at length.
7, On May 16, 1995, a letter was sent to Defendant, Kenneth
J, Ulmer, advising of Plaintiff's intent to foreclose within thirty
(30) days pursuant to 41 P,S, Section 403. A true and correct copy
of said letter is attached hereto as Exhibit "C,"
8. On or about May 16, 1995, notice under the Homeowners
Emergency Mortgage Assistance Act, Act 91 of 1983, was given to
