COLLIBR, Defendant COMPLAINT COKBS HOW, plaintiff, Model Motors Nissan, Inc., by and through its attorneys, connelly, Reid and Spade, by John F. Lyons, Esquire, and respectfully represents and avers as follows: 1. Plaintiff is Model Motors Nissan, Inc., a Pennsylvania business corporation with its registered offices located at 3537 Hartzdale Drive, Camp Hill, Cumberland County, Pennsylvania 17011. 2. Defendant is Clarence W. collier, an adult individual whose last known address is 30 vinlyn Drive, York Haven, Pennsylvania 17370. 3. At all times relevant hereto, Defendant was the owner of a grey, 1989 Nissan 240SX. 4. At all times relevant hereto, Plaintiff as part of its business, provides repair services for motor vehicles including ,\ Nissan Motors' vehicles. r 5. On or about July 18, 1995, Defendant took his motor vehicle to plaintiff for the purpose of having certain repairs performed. 6. Defendant authorized the repairs as evidenced by his signature on the repair invoice. (A copy ot the invoice is attached hereto and incorporated herein by reference and marked as Exhibit "A"). 7. Plaintift, at Defendant's request, provided parts and performed repairs to Defendant's vehicle. 8. Defendant accepted the repairs. 9. Plaintiff charged Defendant $279.13 for labor and parts. 10. Defendant paid for the repairs by personal check. 11. SUbsequent to obtaining possession of the vehicle, Defendant stopped payment on the personal check ho presented to Plaintiff to pay for the repairs to his vehicle. 12. Despite accepting the repairs, Defendant has refused to pay the sums owed for such parts provided and work performed by Plaintiff on Defendant's vehicle. 13. In addition to the sums due for parts and labor, Defendant was aware that Plaintiff charged a $20.00 fee for returned checks. 14. Plaintiff has incurred costs of litigation in filing a i Complaint with the local District Justice in the amount of $38.80. 15.
