MOTION rOR REINSTATEMENT OF APPEAL FROM JUDGMENT OF
DISTRICT JUSTICE
COMBS NOW, the movant, Scott Keys, by hia counsel, Jerry A.
philpott, Esquire, and respectfully moves thia honorable cour~ to
reinstate the appeal filed ft'om the judgment of District Justice
Charles A. Clement, Jr., alleging the following, to wit:
1. The movant is Scott Keys, defendant in the, above-
captioned case, an adult, competent individual residing at 18 YMCA
Drive, Duncannon, PA 17020.
2. The responding party is Robert G. Huston, plaintiff in
the above-captioned case, an adult competent individual residing at
2139 Circle Road, Carlisle, PA 17013.
3. On November 6, 1995, District Justice Charles A. Cl~ment,
Jr., granted judgment to Mr. Huston at ICV-0000368-95.

filed a notice of appeal which counael for Mr. Huaton has conceded
was timely.
S. On December 27, 1995, counsel for plaintiff filed a
praecipe to strike the appeal for violation of Rule 1005(B) of the
Rull. of Appellate proceedings with regard to judgements and other
deci.ion. of District Justices in civil matters.

l5. Mr. Keys did lerve his notice of appeal upon Hr. Huston'
and the Diltrict' Justice as shown by the attached p;roofB of

service.

It is apparent from the attached proofs of ..rvice that
both the Diltrict Justioe and Mr. Huston did receive copiel of the
notice of appeal.
8. Mr. Iteys thought he had complied with submitting proof of
.ervice to the prothonotary, but the record apparently contains no
Clopy of the proof of service.
9., ,Attached hereto is another proof of service for filing
with the court.

10. Mr. Keys can not account for why his earlier mailed proof
of .ervice did not end up in the court file.
11. Injustice would result to Mr. Keys if he were deprived of
an, opportunity to present his case for disposition before a judge
of thh court.
12. No subatantial harm wou),d befall Mr. Huston if Mr. KeYI
11 permitted to reinatate his appeal.
13. Under the decision of Ouarato v. Facelifters Limited, 305
Pa.Super. 536, 451 A.2d 777 (1982), a faHure to comply with Rule
1005(8) should be disregarded where the defendant has merely failed
to fHe proofs of service but there is evidencll that the plaintiff
~ad received actual notice of the appeal within the requested time
period. Such proof is demonltrated by the attaohed return receipt
Ihowing that Mr. Huston signed for the notice of appeal on December
8, 19115.

NOW COMES, plaintiff, ROBERT G. HUS'rON, by and through his
Attorney, John L. Perry, Esquire, and states the following:
1. Plaintiff, Robert G. Huston, is an adult individual
currently residing at 2139 Circle Road, Carlisle, Pennsylvania,
17013.
2. Defendant, Scott Keys, is an adult individual currently
residing at 18 YMCA Drive, Duncannon, Pennsylvania, 17020.
3. At all times relevant hereto plaintiff was employed as a
salesman for Yamaha of camp Hill.
4. On or about April 25, 1992, plaintiff sold Defendant a
Yamaha FZR600 motorcycle, VIN Number JYA3HHE05NA042075.
5. plaintiff agreed to finance the purchase of this vehicle
through a loan to Defendant in the amount of $5,400.00 secured by
the motorcycle.
6. The Agreement pertaining to this loan, a copy of which is
attached as Plaintiff'S Exhibit "A", reflects financing by "Yamaha
of Camp Hill".
7. The Agreement further reflects an annual interest rate of
12\.

8. Dafendant was awan that this loan originated with
plaintiff and that all monies were due and payable to the
plaintiff.
9. A lien in favor of "Yamaha of Camp Hill" was recorded on
the faoe of the Title, a copy of which is attached as Plaintiff's
Bxhibit "B".
10. pursuant to the terms of the above referenced Agreement,

1. The named plaintiff ie an individual suing in hill own
capacity.
2. The plaintiff's complaint allegedly sets forth a claim
based upon a written contract betwGen Yamaha of Camp HiU, in which
the named plaintiff is identified aa a "salesman" on the face of
the contract.
3. The plaintiff'a complaint fails to allege any authority
in the plaintiff to sue on behalf of Yamaha of Camp Hill.
WHEREFORE, the defendant requests thia Court to enter judgment
in the favor of the defendant and against the plaintiff for the
reason that plaintiff laCKS capacity to sue.

NOW COME, plaintiff, ROBERT G. HUSTON, by and throuqh his
Attorney, John L. Perry, Esquire, and state the following:
1.
Plaintiff, Robert G. Huston, is an adult individual
currently residinq at 2139 Circle Road, carlisle, Pennaylvania,
17013.
2.
Defendant, Scott Keys, is an adult individual currently
residing at 18 YMCA Drive, ouncannon, Pennsylvania, 17020.
3.
Yamaha of Camp Hill is a motorcycle sales and service
facility located at 1101 Slate Hill Road, camp Hill, Pennsylvania
1'1011.
4. Yahama of Camp Hi 11
Service, Inc.
is owned by Band B Sales and
5.
Band B Service, Inc. is a domestic corporation orqanized
under the laws of the Commonwealth of Pennsylvania.

At all times relevant hereto Plaintiff was employed as a
manaqer for Yamaha of Camp Hill.

On or about April 25,1992, Plaintiff, Robert Huston,
sold Defendant a Yamaha
motorcycle,

8. Plaintiff agreed to finance the purchase of this vehicle
through a loan to Defendant in the amount of $5,400.00 secured by
the motorcycle.
9. A copy of the Agreement pertaining to this loan is
attached as Plaintiff's Exhibit "A".
10. The Agreement further reflects an annual interest rate of
twelve percent (12%).
11. A lien in favor of Yamaha of Camp Hill was recorded on
the face of the Title, a copy of which ls attached as Plaintiff's
Exhibit "B".
12. By Assignment of Interest dated January 1, 1995, Band B
Sales and Service, Inc. by it's president craig Bear and secretary
Pat Bear, transferred and assigned all of it's right title and
interest in the aforementioned loan. A copy of this Assignment of
Interest is attached as Plaintiffs Exhibit "C".
13. Pursuant to the terms of the Loan Agreement, Defendant
was to pay to Plaintiff forty-eight monthly payments in the amount
of $142.19.
14. Defendant has made eight payments to Plaintiff.
15. Plaintiff has made repeated requests for payment from
Defendant.
16. Defendant has refused to make any additional payments to
Plaintiff.
WHEREFORE, Plaintiffs prays this Honorable Court enter

was demanding any money after plaintiff ref.used to honor the
warranty that he had given was when he was sued by plaintiff

dismissed.

17. Exhibit A to plaintiff's complaint is not the agreement
of the parties signed by Mr. Keys, defendant herein.
Attached
hereto as Exhibit A to this answer is the document that is in the
possession of Mr. Keys that he signed which bear$ a different
invoice number and different date than the one attached to
plaintiff's complaint. Exhibit A to this answer is the agreement
between Yamaha of Camp Hill and defendant,
18, The agreement of the parties (either Exhibit A to the
Amended Complaint or Exhibit A to this Answer; both are the Same in
this regard) incorporated by reference a "Manufacturer's" warranty,
hereinafter "the warranty",
19, The warranty on Yamaha that defendant purchased from
Yamaha of Camp Hill was for one year/12,000 miles,
20. In about February 1993, or within approximately ten
months and 8,000 miles, defendant experienced electrical problems
on his Yamaha and requested Yamaha of Camp Hill, through its
salesman, plaintiff herein, to honor the warranty.
21. While plaintiff was driving the Yamaha to Yamaha of Camp
Hill to get the warranty work done, the wiring harness began to
smoke and was essentially consumed by fire,
22, At the time of the fire, plaintiff Huston came to where
the Yamaha had burned, in front of Holy Spirit Hospital in Camp
Hill, and picked up the Yamaha and took it back to Yamaha of Camp
Hill.
23. Plaintiff, as representative of Yamaha of Camp Hill,
refused to honor the warranty, claiming that the burning was caused
by defendant's letting the battery go deadl
24, plaintiff told defendant that Yamaha of Camp Hill would
charge defendant $1,100 to fix the Yamaha bike notwithstanding the
warranty.
25, As a result of the fire, the Yamaha was reduced in value
to essentially salvage value,
Defendant was able to repair it
sufficiently himself so that he used it for a short time
thereafter, but it eventually had to be "trashed."

AGAIN8T PLAINTIFF HUSTON
26, Plaintiff Huston alleges in his Amended Complaint that in
all ~aterial respects he, not Yamaha of Camp Hill, was the seller
of the Yamaha bike to defendant,
27. The contract between defendant and plaintiff Huston
includes the warranty,
28. Defendant relied upon the warranty in entering into the
purchase of the Yamaha.
29. The Yamah3 faile~ to conform to the warranty in that
plaintiff refused to make repairs of defects that occurred within
the warranty period,
30, Defendant notified plaintiff Huston of the breach of the
war'ranty by seeking to enforce the warranty as set out above.
31, Plaintiff Huston's failure to honor the warranty by
repairing the wiring problems reduced the value of the Yamaha to
salvage value,
WHEREFORE defendant prays for damages from plaintiff Huston in
the amount of the purchase price of the Yamaha, $4,999, for
plaintiff Huston's failure to honor the warranty,

NOW COMES, Plaintiff, Robert G. Huston, by and through his
attorney John L. Perry, EBquire and states the fOllowing answer to
Defendants New Matter and Counterclaim filed in the above captioned
action:
17. Admitted in part, denied in part.
It is specifically
denied that the document attached to Plaintiff's Amended Complaint
a8 Exhibit "A" is not an aqreement of the parties signed by
Defendant, Scott Keys. It is admitted that the document attached
to Defendants Answer with New Matter as Exhibit "A" appears to be
a similar document signed by Defendant.
It is denied that
Defendants Exhibit "A" is the agreement between Yamaha of Camp Hill
and Defendant. To the contrary, it is one of two documents signed
by Defendant reflecting the sale of the Yamaha motorcycle and
financing by Plaintiff.

20. Denied.
After reasonable investigation Plaintiff has
found no documentation of any such claim by Defendant and therefore
strict proof is demanded at trial.
21. Denied in part.
Assuming that the allegations of this
paragraph refer to events occurring while Defendant was operating

the Yamaha motorcycle, Plaintiff ia without sufficient knowledge to
form an opinion as to the truth those averments and strict proof is
demanded at trial. It is specifically denied that the wiring
harne.. wa. "consumed by fire".
22. Denied in part, admitted in part. It is specifically
denied that there was any substantial fire involvinq the Yamaha
motorcycle. It is admitted that plaintiff did retrieve the Yamaha
motorcycle from the vicinity of Holy Spirit Hospital and return it
to Yamaha of camp Hill.
23. Denied. It is specifically denied that Plaintiff
individually or in his capacity 8S manaqer of Yamaha of Camp Hill,
refused to honor the manufacturers warranty. By way of further
answer, Plaintiff did submit a claim to the manufacturers and
determination as to the validity of the claim WIlS made by the
manufacturers representative.
24. Denied. Any quotation reqardinq costs of repair would have
originated with the service department at Yamaha of camp Hill not
with plaintiff. After reasonable investiqation Plaintiff has found
no documentation of any such quotatlon and therefore strict proof
of this averment is demanded at trial.
2!l. Denied. It is specifically denied that any electrical
problems relating to the Yamaha motorcycle resulted in a reduction
of its value to salvage value. By way of further answer, Plaintiff
believes and therefore avers that after experiencing the electrical
problems previously referred to Defendant did repair the motorcycle
and use it and subsequently was involved an accident in which the
motorcycle sustained si,gnificant damage which in turn significantly
reduced the value of the motoroycle.

26. Denied. Paragraphs number 6 and 7 of Plaintiff's Amended
Complaint clearly alleges that Plaintiff, sold Defendant a Yamaha
motorcycle.
27. Admitted.
28. Denied. Plaintiff is without sufficient knowledge to
form an opinion as to the Defendant's state of mind at the time of
the purchase of the Yamaha in question and therefore is unable to
form an opinion as to the truth of this averment. Therefore strict
proof is demanded at trial.
29. Denied. plaintiff speci ticall y denies that he refused to
honor the manufacturers warranty. Plaintiff's answer to paragraph
23 of Defendant's New Matter is incorporated herein by reference.
By way of further answer, Plaintiff believes and therefore avers
that any malfunction of the Yamaha motorcycle was the result of
Defendant's negligent operation an maintenance rather than
manufacturer's defects.
30. Denied. Plaintiff specifically denies that he was
notified of any "breach of the warranty". By way of further
answer, Plaintiff believes and therefore avers that any breach of
the warranty occurred by virtue of Defendant's negligence operation
and maintenance of the Yamaha motorcycle.
31. Denied. Plaintiff specifically denied that he failed to
honor the warranty, either indi viduall y or in his capacity as
manager of Yamaha of Camp Hill. Plaintiff's answer to pa.raqraph 23
of Defendant's New Matter is incorporated herein by reforenoe. By
way of further answer, assuming arguendo the averments of paraqrltph
24 of Defendant's New Matter, the value of the Yamaha was reduoed
no more than $1,100.
WHEREFORE, Plaintiff prays that Defendant's counterclaim 1-
Breach of warranty, against Plaintiff Huston, be dismissed.

23. The averments of this paragraph require no responsive
pleading. To the extent that a responslve pleading is required,
Plaintiff incorporates by reference all of his answers to the
Defendant's New Matter and counterclaim I.

35. Denied. It is specifically denied that B&B Sales and
Service, Inc. is liable on the warranty. Paragraph 18 of
Defendants New Matter is incorporated herein by reference. By way
of further answer, B&B Sales and Service, Inc. is not now, nor ever
has been engaged in the manUfacturing of motorcycles.
36. Admitted in part, denied in part. It is admitted that
Defendant attempted to secure repair of his motorcycle by Yamaha of
Camp Hill under the terms of the manufacturers warranty. It is
specH ically denied that additional Defendant, B&B Sales and
Service and Yamaha of Camp Hill in any way breach the terms of the
manufacturers warranty. By way of further answer, additional
Defendant BiB Sales and Service, Inc. believes and therefore avers
that Defendant breached the terms of the manufacturers warranty by
negligent operation and maintenance of the Yamaha motorcycle.
37. Denied.
Additional Defendant B'B Sales and Service,
Inc., specifically denies that it failed to honor the warranty in
question. Any decision regarding performing of repairs under the
warranty was made by representatives of the manufacturer. By way
of further anSWtir additional Defendant B'B Sales and service, inc.
incorporates by reference paragraph 24 of Defendant's New Matter.
Assuming arguendo the truth of the averments contained in paragraph
24 of Plaintiff's New Matter, the maximum reduGtion in the value of
the motorcycle resulting from the manufacturer's failure to repair
the wiring problems under the warranty would be $1,100.
WHEREFORE, additlona1 Defendant B'B Sales and service, Inc.,
prays this Honorable Court dismiss Defendant's Third Party Claim -
Breach of Wal-ranty, against additional Defendant B'B Sales and
service, Inc.
