COMPLAINT
1. Plaintiff is Northwest Consumer Discount Company, a
Pennsylvania Corporation with an address of 227 Penrose Place,
Carlisle, Cumberland County, PA 17013.
2. Kenwood W. Losh, Sr., mortgagor and Defendant, is an
adult individual with an addre~s at 404 Crossroad School Road,
Carlisle, Cumberland County, PA 17103.
3. Susan K. Losh, mortgagor and Defendant, is an adult
individual with an address at 404 Crossroad School Road,
Carlisle, Cumberland County, PA 17103.
4. On or about November 22, 1993, Defendants signed a Note
to Northwest Consumer Discount Company. The defendants promised
monthly payments on their obligation in the original amount of
$101,240.37, said Note is marked Exhibit nAn, attached hereto and
made a part hereof.
5. Contemporaneously with and at the time of the execution
of the aforesaid Note, in order to secure payment of the same,
Defendants made, executed and delivered to Northwest Consumer
Discount Company, a certain real estate Mortgage which is
recorded in the office of the Recorder of Deeds of Cumberland
County, Pennsylvania in Book 1180, Page 4446, conveying the
subject premises. Said mortgage is incorporated herein by
reference.
6. The land subject to the Mortgage is situate in West
Pennsboro, Cumberland County, Pennsylvania and is more
particularly described in Exhibit "Bn attached hereto and
incorporated herein by reference.
7. Defendants are the real owner of the land subject to
the Mortgage.
8. The mortgage is in defaul t due to the fact that the
Mortgagors have failed to pay the full monthly installments of
$1,215.05 for May, 1995 and each monthly payment thereafter.
The following amounts are due on the Mortgage:
(a) Unpaid principal balance
and interest to November 22, 1995
(b) Homeowners lnaurance
(c) 151 Attorney Commission

$106,773.70
$ 286.00

$123,075.75
together with interest at $32.55 per diem, after November 22,
1995, and all other charges and costs to date of Sheriff's Sale.
The attorney's fees set forth above are in conformity with
the Mortgage documents and Pennsylvania law, and will be
collected in the event of a third party purchaser at Sheriff's
Sale. I f the Mortgage I s reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
9. No judgment has been entered upon said Mortgage in any
jurisdiction.
10. Defendants arc not members of the Armed Forces of the
United States of America, nor engaged in any way which would
bring them within the Soldiers and Sai lors Rei ief Act of 1940, as
amended.
II. Notice of Intention to foreclose and to accelerate the
loan balance has been given to the Mortgagors in accordance with
Section 403 of the Pennsylvania Act NO.6 of 1974, but the
Mortgagors have failed to reinstate the mortgage in accordance
with the provisions thereof. A copy of the Notice Is 9ttached
hereto, marked as Exhibit "C", and made part of hereof.
12. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either fal led to
meet the time Ilmi tat ions as set forth therein or have determined
by the Housing Finance Agency not to qualify for assistance.
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $123,075.75, together wi th interest of $32.55 per
diem after November 22, 1995, other charges and costs incidental
thereto to the date of Sheriff's Sale and for foreclosure and
sale of the property within described.
