A. ABUSE
1. The plaintiff, ,Jennifer E. Nace, is an adult indivld\lal
residing at 530 Mountain Road, Bolling Springs, Cumberland
County. Pennsylvania 17007,
2. The defendant, 'fan)' R. Ballance, (SSN: 165-54-
7529)(Date of Birth: 8/5/66), Is an adult individual residing at
530 Mountain Road, Boiling Springs, Cumberland County,
Pennsylvania, 17007,
3. The defendant has had an Intimate relationship with the
ptainti ff.
4. Since approximately August 1995, the defendant has
attempted to cause and haB Intentionally, knowingly. or
recklessly caused bodily Injury to the plaintiff, has placed the
plaintiff In reasonable fear of imminent serious bodily injury.
and has knowingly engaged In a course of conduct or repeatedly
committed acts toward the plaintiff which have placed the
plainUff in l'eaRonllble fear of bodily Injury. This has
Included, but is not limited to, the following specifiC instances

of abulle:
a. On or about November 19, 1995, the defendant
grabbed the plRlntlff, threw her up Bgainllt a
television cBuslng abrasions to her hand, stepped on
her foot so that she could not move, and grabbed a
telephone out of her hand hitting her In the face with
it. When the d"fendant let go of t.he plaintiff, she
left the residence, went to a friend's house, and
called the Pennsylvania State Pollee.
b. In or Bh0ut October 1995, t.he defendant forcefully
pushed t.he plaint.lff In the chest. area causing her to
stumble backwards and fall to t.he floDr. When the
plaintiff got up, the defendant grabbed both her wrists
Rnd screamed In her face causing her to fear for her
safety. When t.h", defendant let. go of the plaintiff,
she ran to another room, grabbed the telephone and
dialed 91, hut the defendant chased after her grabbing
the telephone from her before she could finish dialing
the number and hit her In t.he side of t.he face witb It.
When the defendRnt slammed down t.he telephone, the
plaintiff rBn to the bedroom, but the defendRnt challed
aft.er her Bgain, shoved her ont.o the hed, straddled her
body, plnned both her arms down and screamed In her
face. The defendnnt. U",n grabbed her throat and
threat.ened her saying, "r could kill you if 1 wanted

wasn't worth It, but when Hhe tried to get up off of
the bed, t.he defendant pushed her bRck down and left.

hfld bruises on hot.h arms, a bruise on ber chin, and
redness about her throat.
c. On or about. August 23, 1995, while driving In a
car, the defendant punched the plaintiff on the side of
her helld flnd fflce. After the pllllntiff repeatedly
asked the defendllnt to stop the car, he slammed on the
brakes cBuslng the plaintiff, who was wearing a seat
belt, to go flying Into the windshield and hlt her
forehead. When the pllllntlff got out of the vehicle
and sat on a guard rail crying, the defendant told her
to get ~wk Into the vehicle but she refused. The
defendant got out of the vehicle and repeRtedly pushed
the plRlntl ff t.oward the vf1hlclo, but she resisted
tel ling I,he defendant she did not wllnt to get bRck Into
the vehicle. Thl' defendant. forcefully shoved h.'II' Into
the vehicle. Thl' plnlnt.! fr lat.er went to Sledle
Hospital where she was t.reat.ed for a concussion and a
dlalocated shoulder'.
d. On severAl dlffer'nnt. occasions sinct! npproxlmatnly

WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 Pa.C.S. S 6101 1IJ. ug., aa
amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the
"Protection from Abuse Act:"
1. Ordering the defendant to refrain from
abusing the plaintiff or placing her in fear of
abuse.
2. Ordering the defendant to refrain from having
any direct or indirect contact with the plaintiff
including, but not limited to, telephone and
written communications.
3. Ordering the defendant to refrain from
harassing and stalking the plaintiff and from
harassing the plaintiff's relatives.
4. Prohibiting the defendant from entering the
plaintiff's place of employment.
5. Prohibiting the defendant from removing,
damaging, destroying or selling property Jointly
owned by the parties or owned solely by the

6. Ordering the defendant to be excluded from
and to slay away from the mobile home located at

7. Ordering the dafendant to stay away from any

year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date If the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that Indicates continued
risk of harm to the plaintiff.
10. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. 66113; ii) a private criminal complaint under 23
Pa.C.S. 66113.1; ili) a charge of Indirect criminal contempt
under 23 Pa.C.S. 66114. punishable by imprisonment up to six
months and" fine of $100.00-$1,000.00; and iv) civil contempt
under 23 Pa.C.S. 66114.1. Resumption of co-residence on th~ part
of the plaintiff and defendant shall not nullify the provisions
of the court order.
11. The Pennsylvania Slate Police, Camp Hill, and East
Pennsboro Police Departments shall be provided with certified
copies of this Order by the plaintiff's attorney and may enforce
this Order by arrest for Indirect criminal contempt without
warrant upon probable cause thai this Order has been violated,

Michael S. Schwoyer, Chief Deputy Diotrict Attorney of

a hearing on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A truti and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint.
3. The victim requests the filing of an Indirect Criminal
contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The commonwealth is requesting a trial on the charges
of Indirect Criminal contempt pursuant to 23 Pa.C.S.A. 56113.
6. The plaintiff and the defendant may seek modification

a hear long on charges of Indirect Criminal contempt:
1. A protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The commonwealth is requesting a trial on the charges
of Indirect Criminal contempt pursuant to 23 Pa.C.S.A. S6113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 Pa.C.S.A. S61l7.
WHEREFORE, the Commonwealth requests the defendant be

certifies that the attached complaint has been properly completed
and verified, and there is probable cause for the issuance of
process. In consideration of the attached commonwealth's
petition, the defendant, TONY R. BALLANCE, is directed to appear
for trial on the charge of Indirect Criminal contempt before the

C~rlisle, pennsylvania.
The defendant has a right to be represented by an attorney.

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Michael S. Schwoyer, Chief Deputy District Attorney of
Cumberland County, Pennsylvania brings the following Petition for
o hearing on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this privaLe criminal complaint.
S. The Commonwealth is requesting a trial on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 56113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 Pa.C.S.A. 56117.
WHEREFORE, the Commonwealth requests the defendant be
commanded to appear before the Court on the charge of Indirect
Criminal contempt.

9. This Order shall remain In effect for a period of one
year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date if the Court
finds that the defendant has commit.ted another act of abuse or
has engaged In a patt.ern or practice that indicates continued
risk of harm to the plaintiff,
10. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. ~6113; ii) a private criminal complaint under 23
Pa.C.S. 86113.1; Iii) a charge of indirect criminal contempt
under 23 Pa.C.S. 86114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00: and Iv) civil contempt
under 23 Pa,C.S. 86114,1. Resumption of co-residence on the part
of the plaintiff and defendant shall not nullify the provisions
of the court order.
11. The Pennsyivania State Police, Camp Hill. and East
Pennsboro Police Departments shall be provlded with certified
copies of this Order by the plaintiff's attorney and may enforce
this Order by arrest for indirect criminal contempt without
warrant upon probable caURP t.hat this Order has been violated,
whether or not the violal ion is committ.ed in the presence of a
pulice officer, In the event that an arrest is made under this
section, the defendant shall be taken without unnecessary delay
