Chilcote, the sum of Three Thousand Seven Hundred Fifty-Eight Dollars and Fifty Cents ($3,758,50), which is justly due and owing by the said Defendant to the said Plaintiff upon a cause of action whereof the following is a statement: 1. The Plaintiff rendered professional dental services to the Defendant at the special instance and request of the said Defendant. 2. The contract between said parties ,was partially oral and partially written. incorporated herein.) (See Exhibit "A" attached hereto and 3. The usual and customary charges for said services were made by the plaintiff and charged to the said Defendant, 4. Plaintiff prepared a bill for such services and Defendant received the same. 5. To date, Defendant has failed to pay this bill. " 6. The Plaintiff has made demand upon Defendant for payment but said Defendant, Thomas J. Chilcote, has neglected and refused to pay same, 7. Niklaus (hereinafter referred to as "Dr. Niklaus"), was represented by Attorney craig A. Diehl (hereinafter referred to as "Attorney Diehl"). In fact, the docket in this case reveals that it was Attorney Diehl who, on December 22, 1995 signed and filed the Complaint in response to the Rule to file a Complaint (a copy of the Complaint is attached hereto, marked Exhibit "1" and incorporated herein by reference). Attorney Diehl, the llttorney of record, WllS served with Mr. Chilcote's Answer, New Matter llnd counterclllim on Jllnullry 15, 1996. 2. The originlll file in the instant case reveals thllt the Answer, New Matter llnd counterclaim were properly endorsed with II Notice to Defend IlS required by Pennsylvania Rules of Civil Procedure Nos. 1018.1 lllld l026, advising Dr. Niklaus and Attorney Diehl thllt they had 20 days to file a responsive pleading. 3. Dr. Niklaus clllims in his Brief that the same Answer, New Mlltter and counterclaim with the Notice to Defend WllS sent or otherwise delivered to Attorney Osborne. 4. Therefore, Dr. NiklllUS, Attorney Diehl and Attorney Osborne knew that a responsive pleading was required to be filed in twenty (20) days from January 15, 1996. 5. Neither Dr. Niklaus, Attorney Diehl nor Attorney Osborne clllim thllt the failure to file the responsive plellding within twenty (20) dllYS was the fault of Mr. Chilcote although they offer no explanation for their failure to file a timely responsive plellding. 6. Pennsylvania Rules of Civil Procedure Nos. 440 llnd 1012 mandate thllt Mr. Chilcote and/or his attorney be served with any Withdrawlll of Appellrllnce of Attorney Diehl and the Entry of Appearance of Attorney Osborne. 2 7. Neither Attorney osborne, Attorney Diehl nor Dr. Niklaus sought an extension of time or otherwise lldvised Mr. Chilcote or his attorney of an intent to plead a defense. 8. The pllrties were not involved in settlement negotiations llnd there had been no contact between the two sides. 9. On February 8, 1996, Mr. Chilcote's attorney served II Rule 237.1 Notice of Intention to Take Default Judgment on Attorney Diehl and on Dr. NiklllUS. 10. The Notice \111S in full compliance with Pennsylvania Rule of civil Procedure No. 237.]. . 11. Whatever Dr. Niklaus, Attorney Diehl and/or Attorney Osborne did, they did not file an Qnswer or other responsive pleading, the~ did not call or write Mr. Chilcote llnd/or his attorney in an effort to obtain an extension of time to file an Answer or other responsive pleading and they did not call or write Mr. Chilcote and/or his attorney in an effort to obtain an extension of time to file an Answer or other responsive pleading. II. COUNTER-STATEMENT OF QUESTIONS PRESENTED (a) ab2Uld this Court strike the Default Judoment? Suggested Answer: No (b) Do equitable principles call for the opening of the Default Judgment? 3 suggested Answer: Absolutely Not III. A&ilJJIIM THIS DEFAULT JUDGME~T SHOULD NOT BE STRICKEN BECAUSE MR. CHILCOTE DID SERVE COUNSEL FOR DR. NIKLAUS OR. IN THE ALTERNATIVE. ATTEMPTED TO DO SO BUT WAS PROHIBITED FROM DOING SO BY DR. NIKLAUS' COUNSEL. The original file will establish that on December 22, 1995 Attorney Diehl signed and filed a Complaint on behalf of Dr. Niklaus. Below his signature on page 2 of the Complaint Attorney Diehl is identified as "Attorlley for Plaintiff." (see a copy of the Complaint attached hereto, marked Exhibit "1" and incorporated herein by reference). Obviously, Attorney Diehl became Dr. Niklaus' attorn~y of record. Pennsylvania Rules of Civil Procedure No. 1023(a) provides, in part, that "[e]very pleading of a party represented by an attorney Shllll be signed by at least one attorney of record in his individual name." Pennsylvania Rule of civil Procedure No. 1025 provides, in part, that "[e]very pleading or other legal paper of a party represented by an attorney shall be endorsed with the name of the attorney...." Dr. Niklaus was obviously represented by Attorney Diehl when the Complaint was filed. Attorney Diehl signed the Complaint as 4 " 1" , ,._' ".' ~,._ " \, ,., J J" 1 '.' Ij f ~ \ " , ',,'.,1 j ........ the attorney of record and he even identified himself as "Attorney for Plaintiff." Neither Attorney Diehl, Attorney Osborne nor Dr. Niklaus did llnything to chllnge Attorney Diehl's status as Dr. Niklaus' llttorney of record. On February 8, 1996, when Mr. Chilcote served the Rule 237.1 Notice of Intention to Take Default Judgment on Attorney Diehl and on Dr. Niklaus, it was served on Dr. NiklllUS' attorney of record, to wit: Attorney Diehl, as required by Pennsylvllnia Rule of civil Procedure No. 237.1. Although Dr. Niklaus contends Attorney Osborne entered lln llppearance but inadvertently failed to give Mr. Chilcote llnd his llttorney notice of the same, Dr. Niklaus never contends that Attorney Diehl withdrew his appearance and th~ record is devoid of any withdrawal of appearance by Attorney Diehl. Attorney Diehl remains one of Dr. Niklaus' attorneys of record even to this day. Therefore, this court's inquiry should end. Rule 237.1 was . fully complied with because both Dr. Niklaus and his attorney of record, Attorney Diehl, were properly served. Dr. Niklau6 admits this filet. Furthermore, this was not a judgment taken w.tthout notice to Dr. NiklllUS llnd his counsel. Notice was not given to an attorney whQ came on the scene late and kept that knowledge to himself. 5 Even Dr. Niklaus admittert in his Petition and Brief that Mr. Chilcote gave the required Notice to Dr. Niklaus and the only llttorney known to Mr. Chilcote, to wit: Attorney Diehl. pennsylvania Rules of civil procedure No. 1012(a) mandates that "[w)ritten notice of entry of an appearance shall be given forthwith to llll parties." Dr. Niklaus admits thllt this Rule WllS violated by Attorney Osborne. Not only has Dr. Niklaus violated Rule 1012 but he also violated pennsylvania Rules of civil procedure No. 440 which provides, in part: "Copies of all legal papers other than original process filed in an action or served upon any party to lln action shall be served upon every other party to the action." Dr. Niklaus admits that neither Mr. Chilcote nor his attorney received a copy of Attorney osborne's Entry of Appearance. DR. NIKLAUS CAN ESTABLISH NO BASIS WHATSOEVER FOR EOUITABLE RELIEF Notwithstandinq Dr. Niklaus' cries for relief from the equity side of this Court, Dr. Niklaus has never done equity. First, Dr. Niklaus has not even addressed his own failure to file an Answer after the original complaint was filed or after he received the Rule 237.1 Notice of Intention to Take Default . Judgment. Why didn't he just file an Answer or other responsive pleading? That would have solved the problem. 6 Or. Niklaus admits that the counterclaim was duly served ryn him with a Notice to Defen~ as required by Pennsylvllnill Rules of civil Procedure No. 1018.1 and 1026; that he did not file an answer within the allotted time; that he changed llttorneys but his old llttorney never withdrew his appearance and the new llttorney never lldvised Mr. Chilcote or Attorney Reed llS required by Pennsylvania Rules of Civil procedure No. 1012; that Mr. Chilcote did comply with the requirements Pennsylvanill Rules of Civil Procedure No. 237.1 and did serve on Dr. Niklaus and Attorney Diehl a Notice in conformity with Rule 237.1; and that Dr. Niklaus ignored the Notice of Intention to Take Default Judgment and again did not file an Answer or cause either of his llttorneys to contact Mr. Chilcote or Attorney Reed. It is a well established equitable principlll that he who seeks equity must do equity. Obviously, Dr. Niklaus has not done equity. Mr. Chilcote is utterly dumbfounded at the continuing "lagal" llrrogance of Dr. NiklllUS and his counsel. They lllleged in their Brief that "[t)he failure to file the responsive pleading was occasioned by the fact that the Petitioner did not receive the Notice of Intention to Take Default Judgment." Dr. Niklaus has been represented by two attorneys in this matter. Dr. Niklaus is a veteran of collection proceedings. Cumberland county Prothonotary records reveal that Dr. NiklllUS obtained a 7 judqment and commenced execution proceedings through the Sheriff's office agllinst II former plltient only months before he sued Mr. Chilcote. They all knew full well that a responsive pleading is due with or without the Rule 237.1 Notice. They didn't file a responsive pleading because they chose not to. They cannot, with credibility, blame Mr. Chilcote for their failure to file a responsive pleading. Furthermore, Dr. NiklllUS did receive the Rule 237.1 Notice and so did his attorney of record, Attorney Diehl. Attorney Osborne did not receive a Rule 237.1 Notice because he never advised Attorney Reed or Mr. Chilcote that he was representing Dr. Niklaus. Dr. Niklaus is not now entitled, especially in dn equity proceedings, to profit or qain from his own failure to abide by well established Rules of Court. Second, if Dr. Niklaus is to obtain equitable relief he must show thllt he did something right, or that he mllde some effort to comply with the Pennsylvan~a Rules of Civil Procedure I In Garber ~ Emes, 511 A.2d 193, 354 Pa. Super 75 (1986), the Superior Court mllde it abundllntly clear that the Notice To File Defllult Judgment serves only to insure that the defendant has actual knowledge that the other party is filing a default judgment. It does not decrease or lessen the counterclaim-defendant's burden to Dlead to the counterclaim on a timely basis and in accordance 8 with the pennsylvania Rules of Civil Procedure. What is Dr. NiklllUS' excuse? He didn't file an answer in 20 dllYS. He didn't tell Mr. Chilcote or Mr. Reed that Attorney Diehl was no longer representing him. He didn't inform Mr. Chilcote or Attorney Reed that Attorney osborne was representing him. And he refused, even after receiving the Rule 237.1 Notice, to file a responsive pleading. Third, a review of many cases reveals that none of the trllditional or typiClll facts or circumstances whi~h would give rise to equitable relief exist in the instant case. For example, in Ouaker Transi~ Co. v. Jack Blumenfeld and co., 419 A.2d 1202, 277 Pa. Super. 393 (1980) the superior Court directed the lower court to open judgment where a default judgment was entered because: 1. There was no notice given to the party against whom judgment was entered; and 2. Judgment was entered while counsel for parties were engaged in continuing settlement negotiations. Neither situation exists in the instant case. Neither Mr. Chilcote nor his attorney were negotiating with Attorney Diehl llnd no.ither Mr. Chilcote nor his attorney were served with Attorney Osborne's Entry of Appearance. There had been absolutely no contact whatsoever between Attorney Osborne and Mr. Chilcote or his attorney. Furthermore, Dr. Niklaus and Attorney 9 Diehl were serviced with the original pleadings with a Notice to Defend and with Notices Of' Intention to take Default Judgment. Perhaps Dr. Niklaus would be entitled to equitable relief if he could allege that he was negotiating settlement, or thllt the Notice of Intention to Tllke Def.ault Judgment, though sent WllS not received by him or Attorney Diehl, or that he or his attorney had asked for an extension of time to file an answer, or that Mr. Chilcote and his attorney misled them, or that the answer was in the mail, or that his attorney was ill. But no such explanation has been offered. How can equity be on Dr. Niklaus' side? Mr. Chilcote did nothing wrong. Dr. Niklaus violated numerous civil Rules and now is asking for equitable retief. There is nothing reasonable llbout Dr. Niklaus' conduct. It evidences the same arrogance for lllW llod Rules of court which spawned the underlying disputes between he and Mr. Chilcote. Alba v. Uroloav Associates of Kinaston is not aDDlicable to the instant ca~. Dr. Niklaus relies solely on Alba v. urolo9v Associates of Kinaston, 598 A.2d 57, 409 Pa. super. 406 (1991). It is the only case cited in Dr. Niklaus' Brief. However, ~ is just not applicable to the instant case. AlbA is a medical malpractice case where the plaintiff did 10 not even send a Notice of Intention To Take a Default Judgment as required by Rule 237.1. As one would expect, the Superior Court remanded the case and directed the lower court to open the judgment. Appellllnts. ..contend that the trial court abused its diEcretion in denying their petition because prior notic6 of entry of the judgment was not given, nor was such notice excused under Pa. R. Civ. P. 237.1. We agree and accordingly vacate the order and remand for proceedings consistent with this opinion. 598 A.2d at 57-58 Furthermore, there was much evidence of ongoing negotilltions between the parties and even a sixty day extension to file an answer. In the instant neither Dr. Niklaus nor either of his attorneys of. record ever negotiated w.tth Mr. Chilcote or his counselor even sought an extension of time or otherwise made any effort to file an answer. Unlike in ~, Mr. Chilcote and his counsel did everything they possibly could to fully comply with all of the requirements of. the Pennsylvania Rules of civil Procedure. However, Dr. NiklauB and both of his attorneys of record ignored or failed to comply with many Rules of pennsylvania Civil Procedure and they have never given any explllnation for their numerous and gross short-comings except to blame them on Mr. Chilcote.
