Asch 6. Copies of gymnastic schedules. 7. Judy Asch provided hand written notes regarding her concerns of Dale Davidson having primary custody of the children. The recommendations at the conclusion of this report have been fonnulated utilizing all these sources of infonnation. BACKGROUND: Dale Davidaon has elected to petition for primary custody of both of his daughters. In February of 1996 he and Judy agreed to alter the custody schedule from the children being primarily with her, to a shared custodial schedule. They did this by allowing Dale to have the children for overnight visits where he previously had evening visits. Although Judy was not particuJar1y happy with this schedule due to the amount of alternating that must occur, she has acc:epted it because the girls have adjusted fairly weU to it. Dale wants to change the custody again because "the girls want him to." He indicates that biJ major reason for requesting this is because the girls have reported to him that they are . unhappy It their mother's house and would prefer to be at his house. He relates that the primary reason for the children's unhappiness is because their mother is unsupportive of their gymnastic interests. He also indicates that Judy is no longer helping him pay for gymnastics. This has put a _ tremendous financial burden on him. Consistent with his statements about gymnastics, Dale indicates that he would do "anything for my children." He states that they have I very close relationship which he fears their mother will inhibit. Judy Asch is opposed to Dale getting primary custody. The main reason for this is because she sees Dale u manipulating the children and alienating them from her. She questions whether or not Dale exhibits behavion consistent with parent alienation syndrome. She points out that Dale consistently uses the children, especially Lauren, to communicate with her. According to Judy, Dale has had the children 6U out Christmu schedules and request that they spend more time with their father. It is also Judy's contention that Dale directed the children to write the letten requesting primary custody to him. Judy sees Lauren u becoming parentified and serving as Dale's primary support. Judy also feell that she and Dale differ significantly in parenting philosophies. This becomes molt evident in their approach to the entire gymnastics issue. According to Judy, Dale will never say no to any gymnastic activity, whereas she feels that some family activities, and financial pressures, need to take preference over the children's activities. She is also concerned that the children have begun to build their life around gymnastics and that there is virtuaJly no time for other activities, or just relaxation. Finally, she feels that Dale lives vicariously through Pile 3 RE: Davidson v. Asch the children's gymnastic activities. She also believes that the children are afraid of disappointing their father regarding this. . ' Obviously, Mr. Davidson disagrees with his ex-wire's depiction. He states that he is supportive of her relationship with the children, but that that relationship has changed since her remarriqe to fun Asch. He believes that Judy puts her needs before the children. Interestingiy, he stated that she appears to love fun more than she loves the children. This same phrase was used by the children to describe their feelings about their mother at this time. He totally denies that he tella the children what to say. Rather, he indicates that they come to him with the statements they make. Furthennore, he accuses Judy of being rigid in her dolling out of time to him. She has been unwillins to negotiate with him about holiday time and continues to resist him pinins any extra time with the children. He reports that he would just like to see the children's reJationship with their mother improve. He believes that this is more important than an actual change in custody. In her interviews, Lauren indicated that she would like to spend more time with her father. Her primary reason is because her mother is not as supportive of her gymnastics as is her father. She ffeII that her mother favon Jac1yn over ber and is disappointed that her mother has "changed" since she nwried fun. She particularly resents that her mother is not 100% in qreernent with bringing her to all of her gymnastic meets. Interesting1y, Lauren states that she "agrees with dad on everything." She states that her father ta1ks with her about the lawyers and tells her "to light for what Wi: want." Her father has encouraged her to keep a record of things that bother her at her mother's. He also encouraged her to write the letter askinS for primary custody. She, on the other hand, indicates that the decision to do it was "totally" hers. ' Jac1yn is less adamant about her feelings than is Lauren, She, too, feels that her mother has changed over the last couple of years. She feels that Judy, at times, is too busy to play with her. She, therefore, feels that her father is more willing to play with her and be involved with her activities. Jsclyn is less concerned about the particular custody arrangements. She also was told that she would write a letter to the lawyers requesting primary custody go to her father, however when she was asked what primary custody meant, Jaclyn was unable to give a definition. On the Hricldin tests, both children showed a preference for their father over their mother. Lauren's test showed a relatively strong preference for her father. It appean that for Lauren support for gymnastics has become a measure of love. This becomes obvious in her interviews and her testing. Jac1yn's Bricldin test was much more even in responses than was Lauren's. Hasica1ly, she ranked her parents as being virtually equal in their abilitiCll to care for her. " Pile 4 RE: DavidlOn v. Asch DALE DAVIDSON: Dale is 34 years old and lives in the family home in Carlisle, Pennsylvania. Dale is currently employed by Shippensburs Unlvenity as a computer programmer. He has held that job for approximately three and half years. Dale had previously worked for Kinney's Shoes for a very brief time and, before that, for mM until his job was transferred to Houlder, Colorado in 1992. Of particular significance for Dale is the fact that he had a malignant brain tumor removed in 1989 from hia left frontal lobes. Subsequent to that surgery he experienced some mUd to modente personality chanaes. Dale presented for all of his interviews in a timely fashion. He was always neatly dressed and well groomed and carried a brief case with him containing documents that he wanted to present. He was very weU prepared for his sessions as he produced multiple forms of documentation. He was coopentive and compliant with the interview process. Dale appears to be a relatively serious, intense individual. He displayed very little sense of Iwmor. There was also a social distance that he maintained throughout the interview process. Dale's affect was somewhat flat, although generally within nonnal limits. He does not display a feeIins ofwannth or spontaneity in his interaction style. These latter personality traits may be a function of the surgery for the brain tumor. Dale's cognltiV\l abilities appear to be intact. Hesides the fact that he maintains a responsible job which demands attention to detail, he presented his position in the interviews in a goal directed and logical manner. There were no signs of anxiety or depression present. There were also no symptoms consistent with a profound psychiatric disorder or thought disorder. Dale denied any job related problems and he denied any drug or alcohol abuse. Dale's psychological testing is valid. Individuals with this profile show an anxious conformity to the expectations of othen, particularly those in authority and have notable defensiveness about psychological problems. These individuals also have a fear of expressing emotion and losing control. Therefore, they typically appear grim, cheerless, and serious minded. Heneath that facade there is likely to be feelings of penonal inadequacy and insecurity. They tend to down grade themselves and to anticipate rejection. They tend to deny a disappointing attitudes and to try to neutralize their distressful feelings. Hecause he may fear making mistakes and taking risks, his activities are likely to be restricted to a repetition of the familiar. There is also the possibility that his self-doubts may lead to social withdrawal. They have consistent and rigid behavioral patterns that must be maintained. Although his facade of propriety and attachment usually hides any repressed anger towards those who frighten and demean him, surges of resentment occasionally break through. Individuals with this profile general1y receive a diagnosis consistent with Obsessive- Compulsive Personality Traits, .. Pile 5 RE: Davidson v. Asch The personality testing seems to validate certain cUnlca1 hypothesis that occurred through the collection of history and interview. Dale seems to be generally serious and avoidant of signilicant social contact. He rigidly adheres to routines and has a difficult time, in general, with change. He a1ro aeems to lack insight into the impact of his own behsvior. His lack of insight Is brought about by a significant amount of denial. This tendency is to project blame for most situations on those around him. JUDY ASCB: Judy Is a 34 year old woman who currently lives with her husband, f1lll, in Carlisle, Pennsylvania. Judy has been employed for the last 12 ye&n at the Mechanicsburg Navy Depot as , a mathematician/computer progranuner. She and fun have been married for approximately one year, although they lived together for a brief time before that. Judy presented as a well groomed, neatly dressed woman. She appeared anxious about the interview process and was generally distressed about the overall custody conflict. Judy attempted to be self-disclosing and open within the interview. Judy's affect was marked by mild degrees of anxiety and depression. She il quite saddened by the distance that is being created in her relationship with her daughters. She also fean the future with respect to those relationships. This type of affect is common within custody evaluations, and is, therefore, not seen as cUnlcally significant. Judy also Iwtlon resentment towards Dale for continuing to initiate these custodial changes. The irritation she feels was obvious at some points during the interviews. Judy's thought processes are intact. There were no signs of any cognitive distortion or impairment. , Her thinking is clear, concise, and goal directed. Judy admits to drinking socially, but denies any significant alcohol or drug use. Judy also presented as more self-critical and self-aware than did Dale. She struggled with questions regarding the "right thing to do with respect to her daughters." Judy seems to be somewhat passive dependent in her interactions with others. It would not be surprising that she would defer to the will of her husband before she would assert her own desires within a relationship. This may be a source of some of the problems in the current situation because she may have changed some of her past behaviors and reactions to be consistent with Tun's, as opposed to being similar to those she had when she was with Dale. Judy's psychological testing is also valid. Individuals with this profile are likely to experience periods of anxiety. In general, their emotions are over-controlled. The thought of expressing negative emotions, such as anger, probably produces considerable discomfort. Nonetheless, hostility may be evoked by questioning their beliefs. These individuals are likely to display hysteroid traits such as egocentricity, suBBestibility, and naivete. They are also seen as alert, cheerful, constricted, dependent, narcissistic and over-conventional. Personal.values may be Pile 6 RE: Davidson v. Asch ucrifIced for attention or approval. Similar women usually have a strong identification with female roles and many traditional feminine issues. They have a strong tendency to be fault finding, passive, submissive, yielding, and demur. They are likely to express strong demands for attention and affection. Relationships can, therefore, be somewhat immature and superficial. They may experience problems with authority figures, marital discord, perceived projection and sociaJ immaturity. Excessive use of repression may create alack of insight and resistance to insight. Their needs arc often expressed unconsciously. There is a strong tendency in these individuals to develop physical symptoms IS a response to stress. ' Individuals with this profile generally receive diagnoses associated with the anxiety that they experience. This anxiety may be free floating or may be consistent with some type of marital maladjustment. The diagnosis may also be related to physical problems which they are experiencing. SUMMARY AND RECOMMENDATIONS: Dale Davidson and 1udy Asch both love their daughten very much. However, they currently disagree regarding what is in the best interest of their children. Dale believes that 1udy needs to be more supportive of the children's activities, especially gymnastics. Hecause he perceives her IS being unsupportive, he believes that the children would be better off in his primary custody. Judy feels that the children are being manipulated by their rather to prefer to live with him. She sees them (especially Lauren) IS having to care for Dale's emotional needs. She feels that Dale is systematically alienating the children from her. This evaluation seems to validate some of 1udy's fears that Dale encourages and reinforces his daughter's displeasure with their mother. He has consistently utilized the girls as conduits for his needs and desires to their mother. He, therefore, incorporates them into his way of thinking. He encouraged them to write letten asking for "primary custody." These are not terms that the girls would be familiar with unless they were exposed to those terms by Dale. This is especially true for Jaclyn who did not even know the definition of custody. Furthermore, to encourage Lauren to keep a diary of things she did not like about her mother focuses her on the negative aspects of that relationship. He did not require Lauren to also keep a log of things that she does with her mother that are filo, or how her mother supports her. Dale's rigid adherence to gymnastic schedules and events are consistent with his compulsive personality style. However, he does not help the girls accept the different parenting style of their mother. The result of his behavior is to indirectly force the children into "choosing sides" in this parental dispute. He becomes perceived as an "all giving" parent who "loves them more than mom." On the other hand, Judy has a difficult time understanding that the changes in her behavior since involving herself in the relationship with fun have been negatively perceived by her daughters. Lauren and 1aclyn's anger and confusion at their mother's changes are not solely the . Pile 7 RE: Davidson v. Asch result of brain washing. Hoth of these children are bright and very sensitive. They easily perceive difl'erencea in their mother's behavior. They have been asking for more individual attention and individual support for the last couple of years. By being able to blame those demands on Dale, Judy has ignored the fact that the children, themselves have those needs. A tendency to not fulfill these Deeds has lead to a further poJarization of the situation. Hoth Lauren and Jaclyn feel emotionaJly hurt as . function of these .changes. in their mother. Judy needs to be more attentive to them on an individual basis. It is, therefore, recommended that a shared custodial arrangement remain in effect. Almost all such arrangements create some degree of problems. The current mangement has the girls twitching residence on a nightly basis. While it is recognized that the gymnastic schedule creates some of this problem, it is also recognized that there are too many transitions to which these girls have to adjust. It is su88ested that a new schedule be tried. It would be recommended that Lauren and Jac1yn be with the father every Monday from after school until Wednesday after school. They should be with their mother every Wednesday after school until every Friday after school. The parents should alternate weekends from Friday after school until Monday after school. Hy utilizing this schedule the girls will have fewer transitions they had before. They will also get to spend larger blocks of times with each of their parents. It is believed that both of these parents recognize how important gymnastics is to these two girls, especially Lauren. It is also felt, that for the most part, Judy has beeR supportive of Lauren's needs with respect to gymnastics. It would be expected that both of them would continue to provide transportation for her to be able to attend practices. It is also expected that if Lauren or Jaclyn have gymnastic meets, the family would take whatever steps nec;essary to help her attend these meets. On the other hand, there are times that family activities take precedence over other activities and everyone must be aware and supportive of that fact. In general, it is up to the custodial parent to .make decisions regarding the needs of their child at any given time. It is also jmperative that Dale and Judy begin communicating in a more eftective and healthier manner. It is unacceptable to use the children as messengers for the parental relationship. Therefore, Dale should stop using Lauren and Iaclyn to communicate with Judy. Similarly Judy should be receptive to speaking with Dale about important infonnaUon regarding the children. If these parents cannot accomplish this on their own, they should employ the use of a mediator to help them resolve conflicts that they continue to have regarding the children's needs. The more their conflict continues the more emotional distress the girls will experience. Finally, these parents need to work out a more acceptable holiday schedule. ASCH, Defendant : IN CUSTODY .R~nuALMEMORANDUMOF l~nNDANT L BJSTORY QF CUSTODY The parties are the natural parenta of Lauren Marie Davidson, born December 22, 1983, and Jaclyn Renee Davidson, born March 10, 1987. From the time of the parties' separation in 1994, the children have been In the primary phylical cultody of the Mother. At that time, the parties reached an qreement that provided for a fairly standard contact between the chi1dren and their Father. They were with him on every other weekend and for two evenlnp . week until bedtime. In addition, there wu substantial contact in the IlII1lIIIeI' and durins holidaYI. Upon petition of the Father for additional time, . conciliation wu held and an Order wu entered on February 14, 1996, which provided additional time for the children to be with their Father. That Order specifically provided that the parties would t1we the IlII1lIIIeI' on a week-onlweek-off basis. During the school year, Mother had primary physical cultody and Father had every other weekend from Friday evening until Monday morning and hi. two evenings per week extended until the following morning when the children were returned to Mother. Again, time wu provided for the children to be with their Father on holidays. . For approximately the put two years, the Flther baa increasingly attempted to alienate the children from their Mother. TlIil is evidenced in the plyclJological evaluation that wu perfonned by Dr. Arnold T. Shienvold and which il an exhibit in this cue. This independent evaluation made note of various actions by Father that were taken with the specific purpoll in mind to alienate the children from their mother. Theil actions, along with an actual implementation of the Order of February 14, 1996, made it increasingiy apparent that the present arrangement of alternating the children a1molt every night wu not in their beat intereat, nor wu it I workable reaolution. Father'a actions in attempting to alienate the children has made it clear that I shared physical cuatody arrangement will not be possible under the present circumstances. Due to these factors, Mother filed a Petition to modilY custody and is u1dng for I primary physical custody arrangement for her, and for temporary physical cullody in Father on alternating weekendl and either during two evenings per week or for one over-night per week. The alternating week schedule for the IUIIlIDel' vacation montha would remain in effect. n. ISSUES ItlfOU TD': ~QVRT The iatuel before the Court relate to Mother'l request to eliminate the additional over-night periods of physical custody that Father secured by the Court's Order of February 14, 1996. As indicated above, this arrangement has created additional COnilictl u Father has become increasingiy anlllJoniltic in his treatment of Mother and in his ongoing increued attemptl to alienate the children from their Mother. The present arrangement needs to be modified to provide stability for the children. Greater control il neceasary for the Mother in this situation in order to avoid or alleviate the difficulties that are occurring due to Father's inappropriate actions. Davidson, on behalf of his children, Jacklyn Davidson, born March 10, 1987, age ten (10) and Lauren Davidson, born December 22, 1983, age thirteen (13) years, Dale L. Davidson has always been an active father with his daughters. Since separation with Judith Davidson Asch, the mother of the girls, Dale Davidson has greatly increased his time and involvement in the life of the girls. Hoth girls expressed a strong desire to live with their father. Both girls indicated thaI following their mother's marriage to Jim Asch, her relationship with each of them has changed for the worse. Hoth girls expressed a fear of Mr. Asch due to his temper. The girls also strongly indicated that W.r. Asch together with the mother regularly speak negatively about their tither. Dr. Schienvold felt that these actions have driven them toward desiring more time with their father. No evidence was presented which indicates that the interest shown by Mr. Davidson in his daughters was inappropriate. Mr. Davidson is very close to both girls and supports their school activities and their gymnastics with his time and energy. While Ms. Asch complains that Mr. Davidson has attempted to inappropriately influence the girls, both of them described long sessions in which Dr. Schienvold's report was read and discussed with them by both Judith and Jim Asch. Dr. Schienvold felt that this was very inappropriate. Ms. Asch has consistently refused to acknowledge Mr. Davidson's interest in the lives of her daughters. She asserts that she has prinwy custody and insists that Mr. Davidson cannot have any additional time with his daughters when they are off school for vacation. She recently has reatrlcted his telephone access to the girls. Ms. Asch considers telephone calls by Mr. Davidson to be an unwanted intrusion in her life, u. IIIIw. Whether the Court should grant the request of Dale Davidson to enjoy more custodial time with his daughterl. Mother hu been tIle primary custodian for the children since their birth. In 1994, when the parties IIeparated, the agreed to and provided for extensive contact between the children and the natural father. Thil included alternating weekend periods of temporary physical custody and two evenings per week. From shortly after separation forward, Mother received support from Father and wu IllUming tole responsibility for any and all expentel of any nature whatsoever for the children, including the cost of their gymnastics. In late 1995, Father flied a Petition to secure additional periods of physical custody with the children. Ultimately, at a conciliation on February 9, 1996, Mother acquiesced to Father'. requeltl and aareed Father could keep the children overnight on the night. during the weekdays when he would otherwise have had to return them before bedtime. The Order in effect at that time, dated February 14, 1996, remains in effect. Thil requires Father to return the children to Mother the next morning after the evening visit. It should be noted that thil exact languaae wu specifically asreed upon providing for the children to be returned in the momina. Mother did not concur, nor wu it agreed upon, nor wu it referenced in the conciliation conference, nor wu it set forth in the Order,' that the parties had "thared" custody. After this Order was entered, Father filed a Petition to terminate hil support, which wu sranted by the Cumberland County Domestic Relations Office. Several months later, Father filed a Petition for support, claiming that the parties had a "shared" CUltody arrangement and, therefore, since Mother had a sreater income than him, there wu a proportional unount of support due from Mother to Father. An Order wu entered against Mother for payment of support. Subaequent to this, Father filed an additional Petition requesting that the Court require Mother to not only pay support, but also to usilt in the COlt of the children'l ~tiCI through payments to the Domestic Relations Office. Mother then secured lesaJ counsel and petitioned the Court to terminate the support that she believed wu inappropriately entered against her. Thil Court entered an Order dated March 24, 1997 vacating the support award and denyina Father'l request to require Mother to participate in the cost usociated with llYJDIIIIliCl. At part of Mother's legal argument in that support hearin& the pointed out that the actually had physical cuatody of her children approximately 60',4 of the time and that support would actually be due to her under the current state of the law. Thil wu the only time Mother argued or made an issue of the fact that she technically had prinwy physical custody. On September 27, 1996, Father had filed a Petition requeatina primary phyticaI and prinwy legal custody of the children. Mother responded with her petition to modify requesting the Order of February 14, 1996 be vacated 10 the parties could return to the prior agreement. The parties agreed to enlist the support of Dr. Arnold T. Shienvold for an evaluation. Dr. Shienvold's report is of record and makes note ofvarioul matten that mult be taken into consideration relative to the pending proceedings. Dr. ShienvoJd notes Father'l actions in attempting to align himielf with the children "against" Mother and attemptl to alienate the children from Mother. Thil has included Father havina Lauren prepare and maintain an ongoing lilt of matten that she did not like about her Mother'l home or about the way Mother treated her. Thil included Father directing the children, either overtly or covertly, to prepare a letter written to Dr. Shienvold requesting that they be placed in their Father'a prinwy physical custody. Dr. Shienvold'l position in thil regard il extremely important in that, without question, he believes Father wu involved in the preparation of these letters. It il further interesting to note the children' I denial, even under oatb to the Court, that their Father wu involved in the preparation ofthete lettefJ. Despite Dr. Shienvold's report, Father continues to take actions to alienate the children from their Mother. He continues to attempt to align hirnIeIf with the children by usilting the children in preparing a summer custody schedule that ''we'' [Father and children] wanted for the summer. This, of course, backed Mother into a corner where the had to deny the children's request or submit to whatever request Father made becluae he had made the request through the children. In addition, Laura continued to maintain a journal or diary of matters she did not like in Mother's home. Upon receipt of Dr. Shienvold'l recommendatiOlll, Mother and Step-Father took the time to 80 over the report, or at least upeetl of the report, in a fuhIon with the children that WIt intended to help Mother clarifY the problema or cJiftk:ultIa that the children had with her conduct. AI noted in Dr. Shienvold'. report, Mother appareatJy WIt not aware or did not "pick up on" the differences in her relationship with the c:hlIcInn that the children felt dcve10ped subsequent to her remarriaae. Mother showed extreme concern and attempted to addreu I~timate illUCI that the c:hlIcInn raiMcI with Dr. Shienvold, but which they had not raised with her. When Mother rem,rried in the spring of 1996, Father used thI. u a buia to further drive a wedge between the children and Mother. In that Mother had IIiptly leu time for the children, or at least the children perceived this, rather than work with the c:hlIcInn in a positive manner for them to understand the adult relatioothipa that IIlUIt ao on in 011I'1 life, Father used the children'. perceived decrease in Mother'. involvement in their 1ivw u a buia to promote hi. alienation. Thia included Father beina at all of the chiIdnII'. IYDUIIIIiCl practicea, even thoup that WIt aaainIt the recommended policy of the OymnutiCI A1lOCiation. It involved Father IIIUIing the children that they will receive CIIeIltially whatever they want relative to equipment and dothin& for 8Y1MUlict and that they attend III meetl of any nature, no matter the expense nor where thoae meeu are held. AI wu made evident by the testimony of the impartial witnellel who were alto involved in gymnutlcs, Father'. involvement in the children'. gymnutlca, while fine in many respects, also went far beyond that of molt parenti. The children Indicated that they have become KCUltomed or acclimated to the present situation which baa existed for over I Y.. yean. The two overniahta with Father per week and the alternating weekendl with Father provide them with substantial time with Father beyond that of molt routine temporary physical custody arrangement.. Although Dr. Shienvold baa suMclted that longer periods of time with each parent miaJrt be more appropriate, he also has Indicated that he i. of the philosophy that if it isn't broke, you don't fix it. The children are ICCUltOmed to the arranaement, have exceIIen& aradeI. are healthy, active children and are generally well-adjulted. The only neptive upectI of the present situation appeara to relate to Father'l alienation tactiCI. Father submitl that an exact shared arrangement thou1d be implemented in this cue. Mother IUlllcltl the parties thou1d return to the prior arranaementl of Father havina the children for jult the evening houn two days per week or, at most, the preIerIt Order thou1d be maintained. n. UGAL PRINCIPALS The instant cue il Indicative of those unfortunate CIICI where parent a1ienation syndrome has come into play. Clearly Father has done what he can to drive a wedp between the children and their Mother, despite how thi. may have a negative impact upon the children. Dr. Shienvnld, who is the accepted impartial psychologist, made quite clear in hil anaIysil that Father does, in fact, alienate the children. Hi. reference to the fact that not all of the children'l alienation il ClUIed by Father, or that the c:hiIdren'l "ana<< and confusion It their Mother'l changes are not solely the reault of brainwashing" makes thil quite clear. (See Pile 6 of report) While Mother certainly has luues to addreu in her relationship with the children, Father clearly hat tried to inhibit and interfere with their relationship. AI in West v. Without question, u all of the evidence, including Dr. Shienvold'l report, makea clear, the oldeat child equatea a parent's love with their involvement in gynuwtICI. Father'l involvement in IYD'I'IIliCI, which Boes far beyond a parent'l routine involvement in the program. il aeen by Lauren as an indication that he lovel her much more than does her Mother. Father then UlCI thil involvement in an attempt to show Lauren how Mother iUl't u involved and, thUI, il not u concerned and does not lover her u much. On the other hand, Mother hat developed a more balanced approach to the family lifestyle. She il remarried and insists on other aspectl of the children'l lives being u important, if not more important, than gymnastiCI. While she dOli not attend every practice, she has attended practicea, has served u the treasurer for the IYJMUliCl IIIOCiatiOn, and has aeen that the children attend their meetl. In fact, on one occuion, Mother Ittended one meet with Lauren in one state while Step-Father attended another meet with Jaclyn in Pennsylvania. Thul, there il no question that Mother it involved in gymnutiCI, but Mother il not involved u much u Father and, therefore, at Ieut with Lauren, Mother does not seem to love the child u much u Father. Hued upon these circumstances and bued upon the fact that Father does not have another re1ationship in which he il involved at thil time, he appears to devote hil entire life to the children. The Court must take thesc fact. into consideration when it looks at the children'. expresaed desires. Thil il particularly true when Father prompt. the chi1dren to write letten to the psychologist uJdna that they be placed in their Father'l "primary physical cultody". It il reapectlbUy su88eated that the Court must dilCOUllt the cIetirea and preferences of the children. As our Supreme Court has noted, it i. the responsibility of the trial judp to give appropriate weight to the preference of a child, according to the child'. aae. intelliaence and maturity.
