made in his bailiwick, and after having exhausted all known facets to
locate defendant, as stipulated under Rule of Civil Procedure, Rule
430, "good faith effort", he VIas unable to find TOM SITES, the within
named DEFENDANT, and he therefore returns "NOT FOUND" as to the said
TOM SITES, the within named Defendant.
*NOTE: Deputy Heilman spoke to Warrant Officer Garlin at Ft. Il,diantown
Gap, who informed him that the Defendant is no longer employed there,
and stated that the Defendant is expected to move to Hawaii within the
next sixty days.

the Defendant entered to No. 95-7029 Civil Term on December 22, 1995 and
after seven unsuccessful attempts to serve the Defendant through the
Cumberland County Sheriff, he aucceeded in serving him on March i5, 1996 at the
Indiantown Gap Military Reservation in Lebanon County, Peansylvania. A copy
of said return of deputized service by the Lebanon County Sheriff is attached
hereto and marked Plaintiff's Exhibit C.
6. The Defendant filed an unsigned Answer to Plaintiff's Complaint,
which answer was never served on Plaintiff.
7. The Defendant is employed as an E-5 Sergeant in the Army National
Guard at the "Gap" and has a regular take home pay of approximately $250.00 per
month plus an annual training pay. Additionally, he had a real estate salesman's
license which mayor may not be active.
;',8... Defendant, was the owner of a house and lot known and numbered as 1904
Holly Street, Harrisburg, Pennsylvania which he sold on or about April 7, 1996.
9. The Defendant is, or recently has been, the owner of three
parcels of real estate with dwellings built on each, known and numbered as
1404 Derry Street, 2604 Lexington Street and 2240 North 4th Street, all in
Harrisburg, Pennsylvania.
10. The Defendant, on or about the first two weeks of March of 1996
took a vacation to Hawaii.
11. The Defendant has not paid rentals to the Plaintiff or to the
Estate of the Plaintiff's father, Sylvester E. Augustin, during his occupancy
of the premises of 1298 Letchworth Road, which occupancy has been at least aince

12. The Defendont'a occuponcy of the property in queation haa
creoted 0 heolth hozord, deteriorntion to the building ond contents and
resulted in the utilitiea being shut off, cnuaing it to be condemned.
13. The Defendant hna neither posted bond nor money with the
Prothonotary, to be opplied to the poyment of ony judgment rendered on
Appeal which ia in violotion of PA RCPJP 1008(b) and CCRP 357.
14. The Defendant. in hia affidovit to proceed in Forma Pouperis,
stoted thot he hod no prescnt employment, no income ond no reol eatate
apparently overlooking his income from militory aervicea ond reol eatote
holdings.
Wherefore, Petitioner requeats thot your Ilonoroble Court grant a
rule upon the Defendont to ahow couae why on order should not be made upon

Robert G. AUluetin, who was Iranted Letters of Ad.inistrator, C.T.A. for the
Iltate of Sylvelter E. AUlustin on Septe.ber 13, 1995.
6. Sublquent to the death of Dorothy I. Augustin, the Defendant
requested perailsion fro. Robert G. Augustin, the son and heir of the Decedlnt,
Sylvelter E. Augustin, to remove his personal belongings from the house in
queltion and wss given fifteen days to do so.
7. The Defendant gsined entry to the pre.ises at 1298 Letchworth
ROld to re.ove his belonginBl,has since occupied said premises without a lease
or authority to do so and refuses to vacate same to the present date after being
notified to do so by Robert G. Augustin on February 28, 1995 and by 30 day
written notice posted on the property on September 15, 1995 and September 22,
1995 by the Plaintiff.
8. During his occupancy of the Letchworth Road property, the
Defendlnt hll paid no rent for eame, has perforaed little or no upkeep or
maintenance to it to the point that it is a health hazard, has caused damaged
to it Ind hss failed to pay utility bills which were shut off by the utilities.
9. The Defendant heats the premises by utilizing a fireplsce fueled
with wood obtained from the premises and possible other sources creating the
poasibility that pipes might freeze.
10. The fair rental value of the property in question is $575.00
per month and the unpaid utility bills consisting of UGr for $222.66 and PP&L
and telephone estimated bills of $100.00, were incurred during the period of
time that the Defendant occupied the property.
li. Due to the failure of the Defendant to vacate the premises on
demand, his utilization of the premises without paying for reasonable rent and

the Defendant entered to No. 95-7029 Civil Term on December 22, 1995 and
after seven unsuccessful attempts to serve the Defendant through the
Cumberland County Sheriff, he succeeded in serving him on March 15, 1996 at the
Indiantown Gap Military Reservation in Lebanon County, Pennsylvania. A copy
of said return of deputized service by the Lebanon County Sheriff is attached
hereto and marked Plaintiff's Exhibit C.
6. The Defendant filed an unsigned Answer to Plaintiff's Complaint,
which answer was never served on Plaintiff.
7. The Defendant ia employed aa an E-5 Sergeant in the Army National
Guard at the "Gap" and has a regular take home pay of approximately $250.00 per
month plus an annual training pay. Additionally, he had a real estate aalesman's
license which mayor may not be active.
.8.. Defendant, was the owner of a house and lot known and numbered as 1904
Holly Street, Harrisburg, Pennsylvania which he sold on or about April 7, 1996.
9. The Defendant is, or recently has been, the owner of three
parcels of real eatate with dwellings built on each, known and numbered aa
1404 Derry Street, 2604 Lexington Street and 2240 North 4th Street, all in
Harrisburg, Pennaylvania.
10. The Defendant, on or about the first two weeks of March of 1996
took a vacation to Hawaii.
11. The Defendant has not paid rentals to the Plaintiff or to the
Estate of the Plaintiff's father, Sylvester E. Augustin, during his occupancy
of the premises of i298 Letchworth Road, which occupancy has been at least since

12. The Defendant'o occupancy of the property in question has
crested s health hszard, deterioration to the building and contents and
resulted in the utilities being shut off, causing it to be condemned.
13. The Defendant has neither posted bond nor money with the
Prothonotary, to be applied to the payment of any judgment rendered on
Appeal which is in violation of PA RCPJP 1008(b) and CCRP 357.
14. The Defendant, in his affidavit to proceed in Forma Pauperis,
stated that he had no present employment, no income and no real estate
apparently overlooking his income from military services and real estate
holdings.
Wherefore, Petitioner requests that your Honorable Court grant a

mode upon him striking Defendont'D Appenl, terminating the Supersedeas under
PA RCPJP I008(b) and CCRP 357 and withdrawing Defendant's authority to proceed
as ~ forma pauperis.

LM in Courtroom No. 1 at which time a hearing on the request shall be
held.
Plaintiff shall be authorized to serve Defendant by posting a copy of
this Rule to Show Cause on the premises at 1298 Letchworth Road, Lower Allen
Township.

the Defendant entered to No. 95-7029 Civil Term on December 72, 1995 and
after seven unsuccessful attempts to serve the Defendnnt through the
Cumberland County Sheriff, he succeeded in serving him on March i5, 1996 at the
Indiantown Gap Military Reservation in Lebanon County, Pennsylvania. A copy
of said return of deputized service by the Lebanon County Sheriff is attached
hsreto and marked Plaintiff I s Exhibit C.
6. The Defendant filed an unsigned Answer to Plaintiff's Complaint,
which answer was never served on Plaintiff.
7. The Defendant is employed as an E-5 Sergeant in the Army National
Guard at the "Gap" and has a regular take home pay of npproximately $250.00 per
month plus an annual training pay. Additionally, he had a real estats salesman's
license which mayor may not be active.
::,8~.. Defendant, was the owner of a house and lot known and numbered as 1904
Holly Street, Harrisburg, Pennsylvania which he sold on or about April 7, 1996.
9. The Defendant is, or recently has been, the owner of three
percels of real estate with dwellings built on each, known and numbered es
1404 Derry Street, 2604 Lexington Street and 2240 North 4th Street, all in
Harrisburg, Pennsylvania.
10. The Defendant, on or about the first two weeks of March of 1996
took a vacation to lIawaiL
11. The Defendant has not paid rentals to the Plaintiff or to the
Estate of the Plaintiff's father, Sylvoster E. Augustin, during his occupancy
of the premises of 1298 Letchworth Iload, which occupancy has been at least since

February i5, 1995.
12. The Defendant's occupancy of the property in question has
created a health hazard, deterioration to the building and contents and
resulted in the utilities being shut off, causing it to be condemned.
13. The Defendant has neither posted bond nor money with the
Prothonotary, to be applied to the payment of any judgment rendered on
Appeal which is in violation of PA RCPJP 100B(b) and CCRP 357.
14. The Defendant, in his affidavit to proceed in Forma Pauperis,
stated that he hod no present employment, no income and no real estate
apparently overlooking his income from military services and real estate
holdings.
Wherefore, Petitioner requests that your Honorable Court grant a
rule upon the Defendant to show cause why an order should not be made upon
him striking his Appeal, terminating his supersedeas and withdrawing his
authority to proceed in ~ Pauperis
