I, On Dcccmbur ~ 1995 UOI UTILITIES, INC" a Pennsylvania corporation
having ilS principal office at 100 Kachel Boulevard, Suite 400, Green Hills Corporate Center,
Reading, Pennsylvania 19607 (hereinafter "Owner"), and METRETEK INCORPORATED,
having a business address of 4450 Enterprise Court, Melbourne, Florida 32934 (hereinafter
"Contractor") entered into a written contract by which the contractor agrees to install
approximately 300 Melrctek Commercial Pulse Accumulator (CPA) units at various met/lring
facilities on the premises of various customers of UOI,
2, It is agreed by owner and the contractor as part of the contract averred in
paragraph I and for the consideration therein set forth that neither the contractor nor any
subcontractor or person furnishing labor or materials to the contractor for the perfonnance of
the contract with the owner shall file a mechanic's lien against the building or the land for the
work and materials done or furnished or any part thereof,
3. This agreement is executed by the owner and the contractor with the
intention that it be filed with the Prothonotary of the Court of Common Pleas of Cur.lberland
County within ten days from the date hereof, in accordance with the authority granted by the
Act of August 24, 1963, P,L, 1175, 405,49 P.S 1402,
