WHEREAS, Village of Moreland, Inc. of cumberland
County, pennsylvania is about to execute contemporaneously
herewith, a contract, with Merit Homes of York county,
pennsylvania, for the erection of a building upon S.. Exhibit
attached hereto.
NOW, December 7, 1995, at the time of and immediately
before the execution of the principal contract, and before any
authority has been given by the said village of Moreland, Inc.
to the said Merit Homes to commence work on the said building, or
purchase materials for the same in consideration of the making of
the said contract with Merit Homes and the further consideration
of One ($1.00) Dollar, to Merit Homes paid by village of
Moreland, Inc. it is agreed that no lien shall be filed against
the building by the contractor, or any sub-contractor, nor by any
of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for
the erection of said building, the right to file such liens being
expressly waived.
WITNESS, our hand and seals the day and year aforesaid.

ALL THAT C..TAII tract or parcel of land situate in the Township
of Lower Allen, Cumberland County, Pennsylvania, bounded and
described as follows, to wit:
..01..1.0 at the northwesterly corner of the intersection of
Glouchester Street a fifty (50') foot public right-of-way, and
Oxford Drive a fifty (50') foot public right-of-way; thence along
the northerly line of Oxford Drive South forty-three degrees
thirty-two minutes forty seconds West (S 43 32' 40" W) a distance
of two hundred forty-five and seventy-three hundredths (245.73')
feet to a point; thence along the easterly line of Lot No. 29 on
a course of North thirty-three degrees zero minutes West (N 33
00' W) a distance of one hundred sixty-six and ninety (166.90')
feet to a point; thence continuing along the same on a course of
North thirty-three degrees forty-four minutes forty seconds West
(N 33 44' 40" W) a distance of one hundred fifty-three and
ninety-seven hundredths (153.97') feet to a point; thence
continuing along same on a course of North twenty-three degrees
twenty-one minutes forty seconds West (N 23 21' 40" W) a distance
of twenty-four and forty-nine hundredths (24.49') feet to a point
in the southerly line of Moreland Court; thence along said
southerly line of Moreland Court (fifty (50') feet wide) on a
course of North sixty-six degrees thirty-eight minutes twenty
seconds East (N 66 38' 20" E) a distance of two hundred sixty-six
and eighty-one hundredths (266.81') feet to a point; thence by a
curve to the right having a radius of ten and zero hundredths
(10.00') feet, an arc distance of sixteen and eighteen hundredths
(16.18') feet, the chord of which is South sixty-seven degrees
one minutes twenty-seven seconds East (S 67 01' 27" E) a distance
of fourteen and forty-seven hundredths (14.47') feet to a point;
thence along the westerly line of Glouchester Street (fifty (50')
feet wide), South twenty degrees forty-one minutes fifteen
seconds East (S 20 41' 15" E) a distance of one hundred forty-
seven and forty-six hundredths (147.46') feet to a point; thence
continuing along the same by a curve to the left having a radius

the chord of which is South thirty-one degrees eight minutes
