AND NOW, comes Plaintiff, PNC Bank, National Association,
auccessor by merger to CCNB Bank, N.A., by its attorneys, Nauman,
8.ith, Shi..1er . Hall, to file the within Complaint, representing
in support thereof the following:
1. Plaintiff, PNC Bank, National Association (hereinafter
"PNC"), successor by merger to CCNB Bank, N .A., is a national
banking association organized and existing under the banking laws
of the United States of America with an office at 4242 Carlisle
Pike, Camp Hill, Cumberland County, Pennsylvania.
2. The Defendants, Fred A. Gettys and Yvonne W. Gettys
("Gettys") are adult individuals and husband and wife residing at
1950 Chestnut Court, Camp Hill, Cumberland County, Pennsylvania,
17011, (hereafter sometimes referred to as "Defendants") .
3. On or about December 1, 1989, Defendants entered into an
agreement in Cumberland County, Pennsylvania, whereby they borrowed
from PNC and agreed to repay to PNC on demand the sum of Four
Hundred Eighty-Five Dollars ($485,000.00), and as collateral for
the loan, executed and delivered to PNC their mortgage dated
December 1, 1989, creating a lien and charge upon various lots in
the plan of land located in susquehanna Estates, in the Borough of

Lemoyne, Cumberland County, Pennsylvania, which plan is recorded in
Cumberland County Plan Book 58, Page 147. At all times relevant
hereto, Gettys were and remain the sole owners of the mortgaged
property as tenants by the entireties. A description of the
mortgaged premises is attached hereto, made a part hereof,
incorporated herein, and is marked Exhibit "A".
4. On December 5, 1989, said mortgage was recorded in the
Office of the Recorder of Deeds in and for Cumberland County in
Record Book 960, Page 899, which mortgage in the public records is
incorporated herein by reference.
5. The said mortgage was never assigned by PNC and is still
held by it as a valid and subsisting obligation of Defendants.
6. PNC believes and, therefore avers, that, Defendants
herein, are the only parties in interest in the land described
herein as Exhibit "A".
7. The property securing the herein mentioned mortgage is
not a one or two family owner-occupied residence.
8. Under the terms and conditions of the financing agreement
including a mortgage note, Defendants agreed to repay the sums
borrowed on demand. On September 15, 1995, formal demand for
payment was made upon the Defendants by first class United States
mail, postage prepaid, a copy of which demand letter is marked
Exhibit "B", attached hereto, made a part hereof, and incorporated
by reference.

9. Defendants have breached the terms and conditions of the
aforementioned promissory note causing default under the terms of
the note in that they have failed to repay the sums borrowed as
demanded.
10. Defendants as of December 4, 1995 were indebted to PNC in
the amount of One Hundred Ninety-Three Thousand Eight Hundred
Eighty-three Dollars and Eighty-Five Cents ($193,883.85) itemized
as follows:

11. The obligation owed by Gettys to PNC continues to accrue
interest thereon at the rate of $54.33 per day beginning December
4, 1995, through the date of judgment.
12. Defendants also agreed under the terms of the mortgage that
in the event of default thereunder they would pay, in addition to
the charges listed in paragraph 9 above, attorneys' fees and costs
incurred by PNC as a result of the institution of these legal
proceedings.
13. The Act of January 30, 1974, P.L. 13, No.6, 41 P.S. 5 101
~~, and in particular 5403 thereof, does not apply in this
matter.
The mortgage at issue is not a residential mortgage as
defined under the Act as the principal balance is in excess of
$50,000.00 and therefore, Defendants are not residential mortgage
debtors as defined under Act No.6.

14. As set forth above, PNC has made repeated demands upon
Gettys, Defendants herein, to cure the default under the aforesaid
mortgage and promissory note, however, Gettys have refused and
failed and continued to refuse and failed to cure this default.
NRI..'O.., Plaintiff, PNC Bank, National Association, demands
judgment against Fred A. Gettys and Yvonne W. Gettys, Defendants,
in the amount of One Hundred Ninety-Three Thousand Eight Hundred
Eighty-three Dollars and Eighty-Five Cents ($193,883.85), plus
costs and attorneys' fees, plus interest in the amount of $54.33
per day beginning December 4, 1995, and for foreclosure and sale of
the mortgaged property.
