NOW, March 18, 1994, upon consideration of respondent' s
preliminary objections, to which no answer has been filed, and it
appearing that petitioner is actually s<!eking relief pursuant to 42
U,S,C, S1983, this court sustains the preliminary objection
pertaining to jurisdiction, The courts of common pleas have
jurisdiction over such actions, Fawber v, Cohen, 516 Pa, 352, 532
A,2d 429 (1987), and accordingly, pursuant to 42 Pa, C,S, S5103, we
transfer this matter to the Court of Common Pleas of CUmberland
, County. We accordingly decline to rule on paragraph 4 of
respondent's preliminary objections,

Pursuant to the Pennsylvania Rules of civil Procedure, Rule
1972 (7), Respondent moves to quash Petitioner's Petition for Appeal
and in support of same avers as follows:
1, Respondent, State 'Correctional Institution at Smithfield
(SCI-Smithfield), by and through Assistant Counsel William E,
Fairall, Jr" Esquire, alleges that Respondent has never been
served with a copy of the Petition for Review in this matter,
2, Attached hereto under the above Court term and number is
a ten-day Default Notice served by regular United States Mail on
James Morgan, Superintendent, of the State Correctional Institution
at Smithfield (Exhibit 'A'),
3, Also attached to this Motion is the Department of
Corrections' Notice of Litigation form by which this case was
delegated from the Attorney General's Office under their lead file
No. 934028 as document 001, meaning the first document received
under this Court term and number,
4, Respondent is obviously left without the ability to
respond, not having received a copy ot the initial Petition tor
Review or other document tiled with this Court.
5. Respondent is not in possession ot any Certificate ot
Service which would indicate that Petitioner has served a copy ot
another document under this Court term and number on the Respondent
or on the Attorney General's Otfice,

The Respondent, the State Correctional Institution at
smithfield, by Assistant Counsel, William E, Fairall, Jr" in
accordance with Pa, Rule of Appellate Procedure 1516(a) make the
following preliminary objections to Petitioner's Petition for
Review:
LACK OP SUBJEOT MATTBR JURISDICTION
1, This Court's jurisdiction is statutorily defined at 42
Pa. C,S,A. Sections 761-764,
2, Mr, Robertson's Petition for Relief requests money
damages (punitive) and affirmative action on the part of the State
Correctional Institution at Smithfield to set aside a portion of
that institution as a non-smoking area,
3, Mr. Robertson's Petition is essentially a Section 1983
civil rights action which, sounding in trespass, falls within the
exception to this Court's original jurisdiction set forth at
761 (a) (1) (v) .

4. In addition, the state Correctional Institution at

MOTION FOR BNLARGEMENT OP TIMB NUNC PRO TUNC
Defendant, State Correctional Institution at smithfield, by
and through Assistant Counsel, William E, Fairall, Jr"
respectfully moves the Court for an enlargement of time nYD& ~
~ to accept defendant's preliminary objections raising the issue
of subject matter j11risdiction as timely filed this date, The
following is stated in support of this Motion:
1, Plaintiff, Brian Robertson, filed his Petition for Relief
in or about August, 1993, Mr, Robertson, at all times relevant to
this action, been incarcerated at the State Correctional
Institution at smithfield,
2, On October 27, 1993, Assistant Counsel received a copy of
plaintiff's ten (10) day notice, ostensibly filed in accordance
with Rule 237,1 of the Pennsylvania Rules of civil Procedure,
3, On October 29, 1993, Assistant counsel filed a Motion to
Quash on behalf of the Respondent herein as the Respondent had not
been served with a copy of Mr, Robertson's Petition for Relief,
" .
4. On January 18, 1994, this Court issued an Order directing
Respondent to file an Answer to the Petition for Review on or
before February 15, 1994,
5. On February 15, 1994, Assistant Counsel prepared a letter
to the Office of the Prothonotary requesting an extension of time
in which to file a responsive pleading, This letter was not in
accordance with appropriate Rules for the Commonwealth Court,
6. Assistant Counsel files this Motion or Petition for an
extension of time, DYD& R[2 ~ in which to file the Respondent's
preliminary objections primarily raising the issue of subject
matter jurisdiction,
7, Assistant Counsel avers that a substantial number of new
cases, the majority of which are inmate litigation, have been
delegated to this office for representation over the last few
months; that with adverse weather conditions and the loss of
Assistant Counsel's secretary for several weeks due to emergency
surgery, has left the office with a significant backlog of
pleadings, briefs and motions,
8, This Motion is not submitted for purposes of delay and it
is respectfully submitted that the Petitioner will not be harmed by
the granting of this Motion,
9, Defendant asserts that Commonwealth Court does not have
subject matter jurisdiction as Mr, Robertson's request for relief
falls within the exceptions to this Court's original jurisdiction
contained in 42 Pa, C,S,A, Section 761(a) (1) (v), As subject matter
jurisdiction can be raised at any time, it is in the interest of

judicial economy to accept Defendant's preliminary objections as
timely filed.
WBBRI~ORI, in light of the above, Defendant requests that the
Court grant the Motion for Enlargement of Time BYn& Et2 ~ and
accept Defendant's preliminary Objections as timely filed this
date.
