CIVIL ACTION
1. Plaintiff, Agnes Gammon, is an individual residing at the
above address.
2. Defendant, Hope United Methodist Church lhereinafter
"Hope United"), is a non-profit corporation doing business in the
Commonwealth of Pennsylvania with a registered office and/or
principal place of business at the above address.
3. At all times relevant herein Defendant, Hope United,
owned, occupied, leased, controlled, and maintained the premises
known as the Hope United Methodist Church, located at 6260 Carlisle
Pike, Mechanicsburg, Cumberland County, Pennsylvania.
4. On or about December 21, 1993, Plaintiff, Agnes Gammon,
was walking near the walkway of the aforementioned premises when
was caused to slip, stumble, trip and/or fall as a result of a
protruding pipe then and there existing causing Plaintiff, Agnes
Gammon to sustain injuries and damages, the details of which are
set forth hereinafter,
5. Prior to the date of the said accident Defendant, Hope
United had direct knowledge of the above described condition and/or
it existed for sllch a length of time that Defendant, Hope United,
knew and/or shoul.l have know of its existence,
6. The negligence and carelessness of Defendant, Hope United
Methodist Church consisted of:
condition,
thereon;
la) failing to maintain the premises in a non-defective
which would protect and safeguard persons lawfully
lb) permitting the premises to remain in a defective
condition so as to constitute a danger, menace, nuisance and trap
for persons lawfully on said premises;
lc) failing to have inspected said premises at
reasonable intervals in order to detennine the condition of said
premises;
ld) failing to warn persons using said premises of the
defective condition;
Ie) failing
circumstances; and
to
exercise
due
care
under
the
If) otherwise, being negligent and careless, in not
cleaning or maintaining the premises.
7, As a result of the negligence and carelessness aforesaid,
Plaintiff, Agnes Gammon, sustained injury to her back including
bones, muscles, ligaments and discs thereof, injury to her ribs,
left eye, face and leg, as well as various other injuries and
conditions as may be established, and injury to the nerves and
nervous system causing Plaintiff, Agnes Gammon to endure pain and
suffering and to lose time from her usual duties, activities and
occupation, causing a loss of earnings and earning capacity and to
incur debts and obligations for medicine and medical treatment; all
of which may be permanent.
WHEREFORE, Plaintiff, Agnes Gammon, claims damages in excess
of Twenty Five Thousand ($25,000.00) Dollars from Defendant, Hope
United,

CIVIL ACTION'
1, Plaintiff, Agnes Gammon, is an individual residing at the
above address.
2. Defcmdant, Hope United, Methodist Church (hereinafter
"Hope United"), is'a non-profit corporation doing business in the
Commonwealth of Pennsylvania with a registered office and/or
principal place of business at the above address,
3, At all times relevant herein Defendant, Hope United:
owned, occupied, leased, con~rolled, and maintained the premises
known as the Hope United Methodist Church, located at 6260 Carlisle
Pike, Mechanicsburg, Cumberland County, Pennsylvania. .
4. On or about December 21, 1993, Plaintiff, Agnes Gammon,
was walking near the walkway of the aforementioned premises when
was caused "to slip, stumble, trip and/or fall as a 'result of a
protruding pipe then and there existing causing Plaintiff, Agnes
Gammon t9 sustain injuries and damages, the details of which are
set forth hereinafter,
S. Prior to the date of the said accident Defendant, Hope
United had direct knowledge of the above described condition and/or
it existed for sllch a length of time that Defendant, Hope United,
knew and/or shoul.1 have know of its existence,
6. The negligence and carelessness of Defendant, Hope United
Methodist Church consisted of:

nervous syst-em causing Plaintiff, ,Agnes Gammon to endure pain a,nd
suffering and to lose time 'from her usual duties, Activities and
occupation, causing a loss of earnings and earning capaci~y and to
incur debts and obligations for medicine and medical treatment r all
of which may ~e permanent,

Preliminary Objections to Plaintiff's Complaint and in support

Defendant, Hope United Methodist Church, a copy of which is

DEFENDANT'S ANSWER TO PLAINTIFF'S COMPLAINT AND NEW MATTER
AND NOW, comes Defendant, Hope United Methodist Church, by and through
Its attorneys, Thomas, Thomas & Hafer, and files this Answer to Plaintiff's Complaint
as follows:
1. Denied. Answering Defendant Is without information or belief as to the
truth of the averments of paragraph 1, hence they are denied and proof Is demanded
at time of trial.
2. Admitted.
3. Admitted In part. It Is admitted only that Defendant Hope United
Methodist Church Is located at 6260 Carlisle Pike, Mechanicsburg, PA 17055. Any
and all other allegations contained in paragraph 3 are specifically denied and strict
proof thereof Is demanded at time of trial.
4. Denied. Answering Defendant is without information or belief as to the
truth of the averments of paragraph 4, hence they are denied and proof Is demanded
at time of trial.
5. Denied as stated. Answering Defendant specifically denies that a
protruding pipe exists In an area where It could be a danger to anyone using the

established walkways. It Is admitted only that a fuel 011 tank fill pipe Is located
approximately five (5) feet west of the walkway. Any and all other allegations
contained In paragraph 5 are specifically denied.
6. Is It specifically denied that Defendant was negligent and/or careless In
the following respects:
(a) In failing to maintain the premises In a non-defective condition which
would protect and safeguard persons lawfully thereon;
(b) In permitting the premises to remain In a defective condition so as to
constitute a danger, menace, nuisance and trap for persons lawfully on said premises;
(c) In failing to have Inspected said premises at reasonable Intervals In order
to determine the condition of said premises; and
(d) In failing to warn persons using said premises of the defective condition.
7. It Is specifically denied that Defendant was negligent and/or careless with
respect to the condition of its premises. It Is also specifically denied that any
negligence and/or carelessness on the part of Defendant caused any Injuries to
Plaintiff. Answering Defendant Is without Information or belief as to the allegations
In paragraph 7 concerning Plaintiff's Injuries, hence they are denied and strict proof
thereof Is demanded at time of trial.
WHEREFORE, Defendant requests this Honorable Court to dismiss Plaintiff's

AND NOW, comes the Defendant, Hope United Methodist Church, by and through its
attorneys, Thomas, Thomas & Hafer, hereby respectfully request this Honorable Court to
compel Plaintiff Agnes Oammon to produce full and complete Answers to Defendant's
Interrogatories and Responses to Request for Production of Documents. In support of its
Motion, Defendant avers as follows:
1. This action was commenced by Plaintiff, Agnes Gammon, on or about February
23, 1996, as a result of an alleged slip and fall at Defendant's church premises.
2. On May 7, 1996, Defendant served upon Plaintiff its first set of Interrogatories
and Request for Production of Documents. See Exhibit" A."
3. Counsel for Defendant has left several messages for Plaintifrs attorney with
respect to the outstanding discovery request, but has not received a response concerning the
same.
4. Counsel for Defendant has written to Plaintifrs counsel on June 12, 1996
requesting Plaintifrs counsel to supply answers to Defendant's Interrogatories and Request for
Production of Documents. See Exhibit "B."

5. Plaintiff has failed to comply with this additional ten day extension.
6. As the date of the filing of this Motion, no answers to Defendant's Interrogatories
or responses to Request for Production of Documents have been received from Plaintiff, nor
have they sought a protective order.
7. Without the benefit of Plaintifrs discovery responses, Defendant Is unable to
schedule depositions and push this matter to a resolution.
WHEREFORE, Defendant respectfully requests this Honorable Court to Issue an order
directing Plaintiff, Agnes Gammon, to answer Defendant's Interrogatories and Request for
Production of Documents within 20 days of the date of the attached order.
