Court Administrator 4th Floor Cumberland County Courthouse Carlisle, PA 17013 (717) 240-6200 CIVIL ACTION 1. Plaintiff, Agnes Gammon, is an individual residing at the above address. 2. Defendant, Hope United Methodist Church lhereinafter "Hope United"), is a non-profit corporation doing business in the Commonwealth of Pennsylvania with a registered office and/or principal place of business at the above address. 3. At all times relevant herein Defendant, Hope United, owned, occupied, leased, controlled, and maintained the premises known as the Hope United Methodist Church, located at 6260 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania. 4. On or about December 21, 1993, Plaintiff, Agnes Gammon, was walking near the walkway of the aforementioned premises when was caused to slip, stumble, trip and/or fall as a result of a protruding pipe then and there existing causing Plaintiff, Agnes Gammon to sustain injuries and damages, the details of which are set forth hereinafter, 5. Prior to the date of the said accident Defendant, Hope United had direct knowledge of the above described condition and/or it existed for sllch a length of time that Defendant, Hope United, knew and/or shoul.l have know of its existence, 6. The negligence and carelessness of Defendant, Hope United Methodist Church consisted of: condition, thereon; la) failing to maintain the premises in a non-defective which would protect and safeguard persons lawfully lb) permitting the premises to remain in a defective condition so as to constitute a danger, menace, nuisance and trap for persons lawfully on said premises; lc) failing to have inspected said premises at reasonable intervals in order to detennine the condition of said premises; ld) failing to warn persons using said premises of the defective condition; Ie) failing circumstances; and to exercise due care under the If) otherwise, being negligent and careless, in not cleaning or maintaining the premises. 7, As a result of the negligence and carelessness aforesaid, Plaintiff, Agnes Gammon, sustained injury to her back including bones, muscles, ligaments and discs thereof, injury to her ribs, left eye, face and leg, as well as various other injuries and conditions as may be established, and injury to the nerves and nervous system causing Plaintiff, Agnes Gammon to endure pain and suffering and to lose time from her usual duties, activities and occupation, causing a loss of earnings and earning capacity and to incur debts and obligations for medicine and medical treatment; all of which may be permanent. Defcmdant, Hope United, Methodist Church (hereinafter "Hope United"), is'a non-profit corporation doing business in the Commonwealth of Pennsylvania with a registered office and/or principal place of business at the above address, 3, At all times relevant herein Defendant, Hope United: owned, occupied, leased, con~rolled, and maintained the premises known as the Hope United Methodist Church, located at 6260 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania. . 4. On or about December 21, 1993, Plaintiff, Agnes Gammon, was walking near the walkway of the aforementioned premises when was caused "to slip, stumble, trip and/or fall as a 'result of a protruding pipe then and there existing causing Plaintiff, Agnes Gammon t9 sustain injuries and damages, the details of which are set forth hereinafter, S. Prior to the date of the said accident Defendant, Hope United had direct knowledge of the above described condition and/or it existed for sllch a length of time that Defendant, Hope United, knew and/or shoul.1 have know of its existence, 6.
