STIPULATION AGAINS'f LIENS
HIS AGUIUUIIIT made the /.J.f:I, day of December, 1995, by and
between W. LEE ROLAND, BUILDER, of 337 West Meadow Drive,
Mechanicsburq, Pennsylvania, hereinafter referred to as
Contractor, AID RICHARD L. ROHRER and CAROL E. ROHRER, husband
and wife, of 236 Green Lane Drive, Camp Hill, Pennsylvania,
hereinafter referred to as Owner, whereby the former undertook
and aqreed to erect and construct a sinqle-family residential
dwellinq on that certain lot of qround situate in Upper Allen
Township, Cumberland County, Pennsylvania, beinq Lot No. 23,
section II - Phase II, Meadowview Estates, said Plan beinq
recorded in the CUmberland County Recorder of Deeds Office in
Plan Book 68, paqe 98. Beinq part of the same premises which
Merle L. stambauqh, Executor of the Estate and under the Last
Will and Testament of Mary G. stambauqh, et al., by deed dated
December 28, 1991 and recorded on March 28, 1991 in the CUmber-
land County Recorder of Deeds Office in Deed Book "A", Volume 35,
paqe 403, qranted and conveyed unto John M. Knaub and Janet D.
Knaub, his wife. The said Janet D. Knaub died March 26, 1995,
whereupon full and complete title to the within described real
estate became vested solely in John M. Knaub, survivinq spouse.
Also beinq the same premises which John M. Knaub by Deed dated
December l~ , 1995 and about to be recorded herewith, qranted
and conveyed unto Richard L. Rohrer and Carol E. Rohrer.
HOW TBBUI'ORB, HIS AGRBBHBHT WITNBSSBTHI That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waving the right of lien, shall be an independent
covenant.
