AND NOW, comes Appellant, Jay E. Gerner, by end through hla attorney, Robert J. Mulderlg,
Esquire, end mes the following Petition:
1, Appellant Is Jay E. Gerner, en adult individual currentq residing at " RUlty Drive,
Mechan\caburg, Cumberland County, Pennsylvenla 17005.
2. On or about November 13, 1995, the Appellant euf1'ered a poeaIble seizure dIaorder,
3. Following thIa Incldent, medlcel reports were submitted to Appellee.
6. By letter of December 12, 1995, a copy of which Is attached end a made pert hereto, the
Deportment of Transportation did recell the Appellant'e driving prIvUeges for en indefinite period.
7. The Appellant was not given en opportunity to show that she Is not incompetent to drive.
WHEREFORE, for all the above reasons, the Appellant, Jay E. Gerner, by end through his
attorney, Robert J, Mulderlg, Esquire, requeBta for Honorable Court to eet a time for hearing In the

Dear Motorist:
Medical record~ submitted to the Department indicate
that you have a medical condition Which is not compatible
with the safe operation of a motor vehicle.
Your driVing privileges are hereby recalled until sat-
isfactory evidence is presented as to proof of competency as
authorized by Section 1519c of the Vehicle Code.
In order to comply with this sanction you are required to
return any current driver's license, learner's permit and/or
temporary driver's license (camera card) in your possession
no later than the effective date listed. If you cannot com-
ply with the requirements stated above, yoU are required to
submit a DL16LC Form or a letter acknowledging the sanction
of your driving privilege, Failure to comply with this no-
tice shall result in this Bureau referring this matter to the
Pennsylvania State Police for prosecution under SECTION
1571(a)(4) of the Vehicle Code.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE DR ACKNOWLEDGEMENT,
WE WILL SEND YDU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT
WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY. OTHERWISE,
VDU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS SANCTION.

This decision has been made by comparing your medical
condition with the standards recommended by our Medical Ad-
visory Board and adapted by this Department. If your condi-
tion improves, your physician should submit a new physical
examination report for reevaluation, If you have a seizure
disorder yOU must remain seizure free for a six month period,
with or without medication, before you will be eligible far
reinstatment of your driving privilege.
You have the right to appeal to the Court of Common
Pleas of the county of your residence within thirty(30) days
of the mail date of this notice, If you appeal, your licensa
will be rein~tDted pending D final deci~10n ~~ the Court,
Effective Date of Suspension I 01/16/1996, 12101 a.m.
