MARITAL PROPERTY AND SETILEMENT AGREEMENT
This Agreement, made and entered into this ~ iI, day of ~.-o....eL , 1998, between
8RlNDA K. HARVEY-CARROLL of 119 Salem Church Road, Mechanicsburg, Cumberland
County, Pennsylvania, hereinafter referred to liS "Wife," and LARRY R. CARROLL, SR., of 115,
Third Street, New Cumberland, Cumberland County, Pennsylvania, hereinafter referred to as
"Husband,"
WHEREAS, the parties hereto are now Wife and Husband, having been lawfully manied to
each other on FeblUlll)' 22, 1986, in Mechanicsburg, Cumberland County, Pennsylvania; and,
WHEREAS, Husband and Wife are the parents of Lan)' R. Carroll, Jr" D,O,8, October 29,
1988; and,
WHEREAS, certain dilferences Imve IIrisen by and between the parties as II result of which
they have now separated and the parties hereto are desirous of settling fully and finally their respective
financial and property rights and obligation as between each other including, without limitation by
specification: the settling of all matters between them relating to the ownership and equitable
distribution of real and personal property; the settling of all matters between them relating to the past,
present and future support and/or maintenance of the child; the settling of all matters between them
relating to the past, present and future support, alimony and/or maintenance of Wife by Husband or of
Husband of Wife; and in general, the settling of any and all claims and possible claims by one against
the other or against their respective estates; lind,
WHEREAS, both and each of the parties hereto have becn advised of their legal rights and the
implications of this Agreement and the legal consequences that may and will ensue from the execution
hereof, and each has had the opportunity to consult with his or her own competent legal counsel
independent of each other; and,
WHEREAS, each party warrants, as part of the consideration of this Agreement, that each has
fully and completely disclosed all infommtion of a financial nature requested by the other, and that no
infonnation of such nature has been subject to distonion or in any manner being misrepresented; and
WHEREAS, other than as set fonh herein, Wife desires finally and forever to relinquish all of
her right of dower, rights as heir or surviving spousc or otherwise, actual, currently existing, or
inchoate, in and to the real and personal propeny of the Husband, now owned by him or which in the
future may be owned by him, and all rights to counselli:es. or expenses and olher tlmn liS set lorlh
herein, Husband likewise wishes to relinquish all his rights of curtesy, rights as heir or surviving spouse
or otherwise, actual and currently existing or inchoate in and to the real and personal estate of the Wite,
currently owned by her or which she may own in the future;
NOW, THEREFORE, the parties hereto intending to be legally bound hereby do hereby
mutually agree as follows:
1. Advice of Counsel. Husband and Wife acknowledge that thl.'Y have been given the
opportunity to obtain the advice of counsel regard.ing the provisions of this Agreement and their legal
effect in advance of the date set 1011h above to permit such independent review. Elich pany
acknowledges that he or she has had the opponunity to receive independent legal advice Irom counsel
of his or her selection, and that each fully understands the facts and has been fully inlbmled as to his or
her legal rights and obligation, and each pany acknowledges and aecepts that this Agreement is, and
under the circumstances, fair and equitable, after having the opportunity to receive such advice and
with such knowledge, and that execution of this Agreement is not the result of any improper or illegal
agreement or agreements. In addition, each party hereto acknowledges that he or she has had the
opponunity to be fully advised by his or her respective nllomey or the impact or the I'ennsylvanill

Divorce Code, whereby the court has the right and duty to detennine 011 maritol rights of the parties
including divorce, oIimony, alimony pendente lite, equitable distribution of 011 maritol property or
property owned or possessed individuolly by the other, counsel fees and costs of litigation and, fully
knowing the same and having the opportunity to be fully advised of his or her rights thereunder, each
party hereto stiD desires to execute this Agreement, acknowledging that the ternlS and conditions set
forth herein are fair, just and equitable to ench of the parties, lInd wllives his or her respective right 10
have the Court ofCommo.l Pleas ofCumberlllnd County. or any other court of competent jurisdiction,
make any detennination or order effecting the respective parties' rights to a divorce, alimony, alimony
pendente lite, equitable distribution of allmaritol property, counsel fees and costs oflitigation.
2, Separation. Husband and Wile do hereby mutually agree and consent to live separate
and apart and do further agree that it shall be lawful for the Husband and Wife at 011 times hereafter to
live separate and apart from each other. and to reside, from time to time, at such place or places as they
respectfully sholl deem lit, free from any control or restraint or interference, direct or indirect, by each
other,
3. No Molestation, HllrasslIlent or Interference. Neither party shall molest, harass or
interfere with the other or compel or endeavor to compel the other to cohabit or dwell with him or her
by any means whatsoever.
4. Mutual Property and Estate Waiver, Except as otherwise expressly set forth herein.
in which event such express provision shall take precedence over this paragraph, the parties hereto
intend that from and after the date of this Agreement, neither sholl have any spouse's rights in the
property or estate of the other, and to that end both parties waive, relinquish, and forbear the rights of
dower or curtesy, rights to inherit, rights 10 c1uim or take the Husband or Wile's or tiunily exempliun ur

allowance, to be vested with letters of administration or letters testamentary, or to take against any will
of the other, and each agrees with the other if either should die intestate, his or her share shall descend
to vest il! his or her heirs at law, personal representatives, and next of kin, excluding the other as
though he or she had died a widow or widower. And each further agrees that should the other die
testatc. his or her property shall descend to and vest in those persons set forth in the other's Last Will
and Testament as though the spouse so designated as beneficiary had predeceased the testator, The
parties further agree that th')}' may and can hereafter, as though unmarried, without any joinder by him
or her, sell, convey, transfer or encumber any and all real estate and personal property which either of
them now or hereafter own or possess and further agree that the recording of this Agreement shall be
conclusive evidence to all of his or her right to do so, The said Husband and Wife do hereby
irrevocably grant, cach to the other, should the exercise of this power hereby given be nCCCSSlll)', the
right and the power to appoint one or more times any person or persons whom the Husband or Wife
shall designate to be the attorney-in-lilct for the other. in their name and in their stead, to execute and
ackuowledge any deed or deeds, releases, quit claims, or satisfactions, under sc.11 or otherwise. to
enable either party hereto to alienate his or her real or personal property, but without any power to
impose personal liability for breach of warranty or otherwise. Each of the parties hereto further waives
any right of election contained in Chapter 22 of the Pennsylvania Probate Estates and Fiduciaries Code,
and any right to seek or have an equitable distribution of married property ordered by the Court
pursuant to Section 3502 of the Divorce Code, Each of the parties hereto further agrees that neither
shall hereafter be under any legal obligations to support the other. pay any expenses for maintenances,
filOeral. burial. or otherwise for the other. and to that end cach of the parties hereto does hereby waive
any right to receive support, alimony, alimony pendente lite, counsel fees, e.xpenses, or any type of

The parties hereto mutually agree that they have effected a satisfactory division of the furniture,
household furnishings, appliances and other household personal property between them, and they
llIutually agree that each party shall from and after the date hereof be the sole and separate owner of all
such langible personal property presently in his or her possession, whether said property is heretofore
owned joinlly or individually by the parties hereto, and this Agreement shall have the effect of an
IISSil!nlllelll or bill of sale frolll encb party to the other for such property as may be in the individual
posscssions III' cnch ol'lhe parties hercto.
Further. the parties hereto have divided between themselves, to their mutual satisfaction, all
items of tangible and intangible marital property. Neither party shall make any c1airn to any such items
of marital property, or of the separate personal property of either party, which are now in the
possession and/or under the control of the other.
From and aller the date of the signing of this Agreement both parties shall have complete
trcedom of disposition as to thcir separate property which is in their possession or control pursuant to
Ihis ^I!rccmelll and may mortgage. sell. grant, conveyor othenvise encumber or dispose of such
property, whelher real or personal, whether such property was acquired before, during or after
maniage, and neither Husband nor Wife need join in, consent to, or acknowledge any deed, mortgage,
or other instrument of the other pertaining to such disposition of property,
6. Debls, Wife agrees to assume all marital debts. The parties agree to be responsible for
their individual debts which are presently in their names. Wife agrees to indemnifY Husband for any
outstallding marital debts in the event of default by Wife.

7, Future Debts, The parties further agree that neither will incur any more future debts
for which the other may be held liable, and if either party incurs a debt for which the other will be liable,
that party incurring such debt will indemnitY and hold the other hannless from any and all liability
thcreof
8. Real Property. Husband agrees to transfer his right, title and interest in and to the
parcel of jointly-owned real estate with improvements thereon situate at 119 Salem Church Road,
Mechanicsburg, Hampton Township, Cumberland County, Pennsylvania, to Wife and to sign all
documents necesS8l}' to effect said transfer of the title to the real estate to Wife's name individually
contemporaneously with the signing of this Agreement.
Wife further agrees to satistY and save Husband hann1ess from any obligation which he may be
liable as a result of the mortgage and other encumbrances on the jointly-owned real estate, said
mortgages and encumbrances being recorded in the Cumberland County Recorder of Deeds Office.
Wile agrees that upon delivery of the deed to the jointly-owned real estate, she will continue to make
the mortgage and/or home equity payments and will indemnitY Husband on account of any obligation
she may have on account of the mortgage or mortgages, as well as any other obligation conceming
ownership of the real estate including, but not limited to municipal liens, real estate taxes, sewer and
water assessments, fire and casualty insurance. and utilities, Furthennore, Wife agrees to satistY the
mortgages and/or home equity lines of credit through refinancing or any other method of payment
within sixty (30) days from the date of this Agreement or within a reasonable time thereafter not to
exceed ninety (90) days.
9. Support, Alimony nnd Alimony Pendente Lite, Wife shall pay Husband, as
alimony, the sum of seven hundred dollars ($700.00) per month, beginning on April I, 1998 for

twenty.four (24) consecutive months, payable on the first day of each month, The alimony amount of
$700,00 per month shall be non-modifiable, excepting only a substantial change in circumstances
directly related to a physical or mental disability, medical condition or the health of either party, which
limits or impairs the ability of either pW1y to work. Upon conclusion of the twenty-fourth (24lh) month,
the payment and amount of alimony shall forever cease.
Alimony payments made pursuant to this purugraph shall be paid directly to the Domestic
Relations Office in accordance with a separate Order of Court on or before the lirst (I") duy of each
month, Alimony awarded pursuant to this paragraph shall cease upon either Husband or Wife's death,
Husband's remarriage or Husband's cohabitation. The alimony awarded pursuant to this paragraph
shall be taxable to Husband's income at the amount of $700,00 per month commencing April I, 1998,
and deducted from Wife's income at the amount of$7oo.oo per month commencing April I, 1998. in
accordance with all tax laws and Intemal Revenue Service Rules and Regulations. The pW1ies agree to
reduce this Agreement to an Order of court upon the written request of eithcr party. Further, the
parties agree that the payment of alimony pursuant to this paragmph shall be ollset by Husband's child
support obligation as set forth below.
10, Child Support. The pW1ies hereto acknowledge that Husband shall pay a basic child
support award and day care expense in the amount of $300,00 per month, Husband shall be required
to pay $300,00 per month as child support and day care costs for a period of twenty-four months,
commencing April I, 1998, and the parties further agree that this amount shall be non-modifiable
during this period of time, This agrcement shall be enforced by the Domestic Relations Ollice and shall
be non-modifiable for a period oftwcnty-fuur months, commcncing April I, 19<Jllund ending I\-Iurch I.
2000, It is the specific intent of the parties that this payment of child support by Husband to Wili: shull

require a net result of a monthly payment of $400,00 from Wife to Husband through the Cumberland
County Domestic Relations Office as set forth in the Alimony provisions of this agreement, however, in
no event shall this paragraph modifY the provisions of paragraph 9 whieh deal with the incolfle tax
consequences in paragraph 9 concerning alimony. Further. Wire shall assume all medicnl expcnses
incurred by the child during this twenty-lour (24) month period. It- (eo. ..1+..,1,..,\ ...wlldv,",.
II. Pension. Each party agrees to waive any right they may have in the others' pension or
retirement plan.
12, Cash Distribution. Wife agrees to pay to Husband at the signing of this Agreement
and the transfer of the real estate, the sum 01'$2,000,00, made payable to Andrew C. Sheely, Attorney
for Lany R. Carroll, Sr, Wife rurther agrees to make three (3) $1,000,00 payments on the following
dates: October 1, 1998, April 1, 1999, and October 1, 1999, The payments are to be made payable 10
Larry R. Carroll, Sr. and addressed to 115 N. Third Stn.'Ct, New Cumberlllnd. PA 17U7U. Wili: ngl'L'CS
to execute a Note in the amount 01'$3,000.00 to be held by Andrew C. Sheely, ESlluire which will bc
filed in the Cumberland County Courthouse in the event or derault or the payment of$3,000.00,
13, Health Insuronce. Wife agrees to provide Husband with health insurance at her
expense for a period from April 1, t998 to March 31, 2000.
14, Counsel Fees and Court Costs. The parties agree to be responsible for their
respective legal fees and court costs incurred in the process of any divorce action or separation
agreement.
15. Life Insunlllcc. Husbnnd agr~'Cs to nlllilllninll $1O.0UU.UO term 1iIi: insurance policy
naming Lany R. Carroll, Jr. as beneliciary. Proof or said coverage shall be lurnished at the time of the
execution of this agreement.

16, Divorce, The parties acknowledge their intention and agreement to proc~'Cd in an
action in divorce to obtain a final decree in divorce by mutual consent on the grounds that their
marriage is irretrievably broken, and to settle amicably and fully hereby all claims raised by either party
in any divorce action, The parties agree to execute any and all documents necessa:y for the entry of 1I
final divorce decree.
17, Breach. In the event that either party breaches any provision of this Marital Propel1y
and Settlement Agreement, he or she shall be responsible tor any and ull costs incurr~-d to enlbrce Ihe
tenus hereof, including. but not limited to, coull costs and reasonable counsel Ices of the olhcr pal1y.
In the event of breach, the other party shall have the right, at his or her election, to sue for damages lor
such breach or to seek such other and additional remedies as may be available to him or her.
18, Enforcement. The parties agree that this marital settlement agreement or any part or
parts hereof may be enforced in any court of competent jurisdiction.
19, Applicable Law and Execution, The parties hereto agree that this marital settlement
agreement shall be construed under the laws of the Commonwealth of Pennsylvanillllnd shall bind Ihe
parties hereto lInd their respeclive heirs. executors lInd assigns. This ducumcnt shall be ex~'Culed as
original and multiple copies.
20, The Entire Agreement. The parties acknowledge and agree that this marital
settlement agreement contains the entire understanding of the parties and supersedes any prior
agreement between them. There are no other representations, warranties, promises, covenants or
understandings between the parties other than those expressly set forth herein.
21. Incorporation nnd Judgment for Divorce, In the event that either Husband or Wife
at any time hereafter obtain a divorcc in the action lor divorce presenlly pending belw~'Cn thcm, ur

othe:wise, this agreement and all of its provisions shall be incorporated into any such judgment for
divorce, either directly or by reference. The Court, on enll)' of judgmenl for divorce, shall relain lhe
right to enforce lhe provisions and tenus of lhis marital settlement agreement.

ADDENDUM TO PARAGRAPH 10
OF MARITAL PROPERTY AND SETTLEMENT AGREEMENT
Plaintiff, Brinda K. Harvey-Carroll, and Defendant, Larry R.
Carroll, Sr., further understand and acknowledge that
circumstances after March 31, 2000 may necessitate an adjustment
in the amount of support, either upwards or downwards, depending
upon the child's circumstances and the respective incomes or
earning capacities of the parties hereto in accordance with
general support standards. In the event Husband and Wife cannot
agree upon the amount of child support at any time after March 31,
2000, Husband and wife agree that nothing set forth in this
paragraph or this Marital property and Settlement Agreement shall
prejudice the right of either party to file a petition for
modification or entry of an amount of child support, at any time,
in any Court of appropriate jurisdiction, if necessary. It is the
specific intent of the parties that proceedings after March 31,
2000, and any future award of child support will be governed by
the applicable support guidelines and case law and that the
present agreed upon amount of $300.00 per month shall have no
effect on any future proceedings for child support initiated by
either party after March 31, 2000.

1. Plaintiff is Brinda K. Harvey-Carroll, an adult
individual, currently residing at 119 Salem Church Road,
Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant is Larry R. Carroll, Sr., an adult individual,
currently residing at 115 Third Street, New Cumberland, Cumberland
County, Pennsylvania.
3. Plaintiff and Defendant are bona fide residents of the
Commonwealth of Pennsylvania and have been so for at least six
months immediately previous to the filing of this complaint.
4. Plaintiff and Defendant were married on February 22,
1986, in Mechanicsburg, Pennsylvania.
5. There have been no prior actions for divorce or
annulment between the parties.
6. The Plaintiff has been advised of the availibility of
marriage counseling and the Plaintiff may have the right to request
that the Court require the parties to participate in counseling.
Having been so advised Plaintiff does not desire the Court to order
counseling.
7. The marriage is irretrievably broken.

COUNT II
8. The allegations in paragraphs one through seven,
inclusive, are made a part hereof and incorporated herein by
reference.
9. The Plaintiff alleges that in violation of her marriage
vows, the Defendant has over a period, in Mechanicsburg and other
places offered such indignities to the person of the Plaintiff as
to render her condition intolerable and life burdensome.
10. This action in divorce is not collusive.
11. Neither party to this action is a member of the armed
forces of the United states of America.
WHEREFORE, Plaintiff prays Your Honorable Court to enter a
decree in divorce.
COUNT II I
EQUITABLE DISTRIBUTION
12. The allegations in Paragraphs one through eleven,
inclusive, are made a part hereof and incorporated herein by
reference.
13. Plaintiff and Defendant have acquired property, both real
and personal, during their marriage.
WHEREFORE, Plaintiff requests this Honorable Court to
determine marital property and to order an equitable distribution
thereof.

Dear Ms. Verney and Mr. Sheely:
By order of Court of President Judge Harold E. Sheely
dated September 9, 1997, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on December 18, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. The complaint also raised the
economic claim of equitable distribution.
On March 21, 1996, an answer and counterclaim were filed.
The counterclaim raised the additional economic issues of
alimony and counsel fees and costs.
I am unable to determine if the parties are willing to
sign affidavits of consent but I am going to proceed on that
basis. If I am incorrect, please advise and we will schedule a
hearing on the grounds of indignities.
Based on my assumption that grounds for divorce are not
an issue, I am directing each counsel to file a pre-trial
statement in accordance with P.R.C.P. 1920.33(b) on or before
Friday, October 3, 1997. Upon receipt of the pre-trial

20. Defendant has incurred certain costs in defending this action
and will likely incur additional costs and expenses in valuing marital
assets, attending hearings and court proceedings.
21. plaintiff is in a far more economic superior position than
Defendant and is in sole access and control of most marital assets.
WHEREFORE, Defendant, Larry R. carroll, Sr., respectfully requests
that his Honorable Court:
(A) Order equitable distribution of marital property in accordance
with the factors set forth in 23 Pa. c.S.A. S 3501, et sea.l and
(8) Order alimony pendente lite, interim counsel fees as deter-
mined appropriate by the Courtl and
(C) Order an award of alimony as determined appropriate by the
Court 1 and
(D) Order an award of counsel fees, costs and expenses as the
Court deems appropriate.

AND NOW comes plaintiff, Brinda K. Harvey-Carroll, by and
through her attorney, Jacqueline M. Verney, Esquire, and
petitions the Court as follows:
1. petitioner is Brinda K. Harvey-carroll, the above named
Plaintiff in the above-captioned divorce action, who is an adult
individual currently residing at 119 Salem Church Road,
Kechanicsburg, Cumberland county, Pennsylvania, 17055.
2. Respondent is Larry R. Carroll, Sr., the above named
Defendant in the above-captioned divorce action, who is an adult
individual whose last known address was 115 Third Street, New
Cumberland, Cumberland county, Pennsylvania, 17070.
3. Petitioner filed a Petition for Protection From Abuse on
October 12, 1995 and a Consent Agreement was entered into by the
parties on October 16, 1995. On December 13, 1995, Respondent
was found in contempt of the PFA by the Honorable George E.
Hoffer. On March 21, 1996, the Honorable J. Wesley Oler entered
another Protection From Abuse Order. All of the above orders
excluded the Respondent from the marital residence at 119 Salem
Church Road, Mechanicsburg, with the Order of March 21, 1996
granting Petitioner exclusive possession of the marital
residence, All Orders are attached hereto as Exhibits.
4, The PFA Order of Karch 21, 1996 was to remain in effect
for one year,
5. Respondent contacted Petitioner's residence on Karch 21,
1997 and advised that he intended to enter the marital residence.
6. The parties are the parents of a eight year old son,
Larry R. Carroll, Jr., who resides with Petitioner at 119 Salem
Church Road, Kechanicsburg,
7. Respondent has been excluded from the marital residence
since October 16, 1995. Since October 16, 1995, Petitioner has
exclusively paid the mortgage and second mortgage, the taxes, the
homeowners insurance and maintenance and repair costs on the
marital residence.
8. Respondent has demonstrated that he is able to secure
and maintain an alternate residence.
9. Petitioner believes that relocating the minor child will
have a deleterious effect on his emotional well-being.
10. Petitioner fears that permitting Respondent access to
the marital home will result in violence or the threat of
violation by Respondent due to his prior behavior of violence and
threats of violence.
WHEREFORE, Petitioner requests your Honorable Court to enter
an Order providing for her to have exclusive possession of the
parties' former marital residence located at 119 Salem Church
Road, Kechanicsburg, Cumberland county, Pennsylvania, 17055.

ORDER OF COURT
AND NOW, this 21st day of March, 1996, upon
consideration of the Petition To Modify Protective Order filed
on behalf of Brinda K. Harvey-carroll (Plaintiff/Petitioner),
and pursuant to an agreement reached in open court between the
parties and their respective counsel, it is ordered and directed
as follows:
1. Respondent is hereby enjoined from abusing or
threatening to abuse or placing Petitioner in fear of abuse.
2. Respondent is hereby enjoined from having any
contact, direct or personal, with the Petitioner, including
driving by the residence or being driven by the residence.
3. Respondent is hereby enjoined from harassing
or stalking Petitioner or her relatives.
4. Respondent is hereby enjoined from the
destruction and removing of jointly owned property and any
property owned individually by Petitioner.
5. Respondent is hereby enjoined from entering
the building or the property of the Petitioner's place of
employment.
6. Respondent is hereby enjoined from owning or
possessing a firearm.
7. Petitioner is granted exclusive possession of
the dwelling located at 119 Salem Church Road, Hechanicsburg.

Respondent is to stay away from the property and any residence
which Petitioner may in the future establish for herself.
8. Respondent agrees to return in working order
a swimming pool pump and filter and antique table to the
Petitioner; the swimming pool pump to be returned today, the
antique table to be returned in accordance with a subsequent
paragraph.
9. Petitioner and Respondent agree to have the
personal property appraised wherein Respondent will arrange for
an appraiser and pay for so appraiser to appraise all personal
property located at 119 Salem Church Road and at a location
where Respondent has stored certain personal property owned by
both parties. That appraisal is to occur within ten days from
the date of this Order. within seven days of the date of the
appraisal, on a Saturday or a Sunday, between the hours of 9:00
a.m. and 4:00 p.m., Respondent will arrange to have any
remaining tools removed from 119 Salem Church Road.
10. This Order shall remain in effect for one
year from the date of the Order.
11. The Hampden Township Police and the
Susquehanna Township Police will be provided with a copy of this
Order by the attorney for the Petitioner. This Order shall be
enforced by any law enforcement agency when a violation occurs
by arrest for indirect criminal contempt. The arrest may be
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of the police officer. In the event that an arrest is
made under this section, the Respondent shall be taken without
unnecessary delay before the Court that issued the Order. When
that Court is unavailable, the Respondent shall be arraigned
before the appropriate district justice. (23 Pa. C.S.A. 6113).
This Order is being entered into without
testimony from either party, and is intended to be a consent
agreement.

The parties agree that the following may be
entered as an Order of Court.
1. The defendant, Larry R. Carroll, Sr, agrees to refrain
from abusing or threatening to abuse plaintiff, Brinda R. Harvey-
Carroll, and/or placing her in fear of abuse.
2. The defendant agrees not to have any direct contact with
the plaintiff except when they encounter each other to accomplish
the visitation provisions of this agreement concerning their son,
Larry R. Carroll, Jr.
3. The defendant agrees not to harass and stalk the
plaintiff and harass the plaintiff's relatives.
4. The defendant agrees not to enter the plaintiff's place
of employment, the school of Larry R. Carroll, Jr. or his day care
facilities.

5. The plaintiff and defendant agree not to remove, damage,
destroy, or sell any property owned by the parties jointly.
6. The defendant agrees to stay away from the plaintiff's
dwelling located at 119 Salem Church Road, Mechanicsburg,
Cumberland County, pennsylvania, which the parties previously
shared, but is permitted access to outer buildings adjacent to the
property.
7. The defendant agrees to stay away from any residence the
plaintiff may in the future establish for herself.
8. The defendant, although entering into this Agreement,
does not admit the allegations made in the Petition.
9. The defendant understands that the Protection Order
entered in this matter will be in effect for a period of one (1)
year and can be extended beyond that time if the Court finds that
the defendant has committed an act of abuse or has engaged in a
pattern or practice that indicates risk of harm to the plaintiff on
a continued basis. The defendant understands that this Order will

10. Violation of the Protection Order may subject the
defendant to: (a) arrest under 23 Pa.C.S. ~6113; (b) a private
criminal complaint under 23 Pa.C.S. 96113.1; (c) a charge of
indirect criminal contempt under 23 Pa.C.S. 96114, punishable by
imprisonment up to six months and a fine of $100.00 to $1,000.00;
and (d) civil contempt under 23 Pa.C.S. ~6114.1.

11, The defendant and the plaintiff agree to the entry of the
following Custody Order regarding their son, Larry R. Carroll, Jr.:
(a) The mother will have primary physical and legal
custody of the child.
(bl The father will have partial custody and liberal
visitation of the child as the parties may agree.
(c) The parties may communicate by telephone to arrange
partial custody and visitation.
(d) The parties will transfer custody of the child at a
public place to be agreed upon.
(el The father will not use alcohol prior to or during
periods of partial custody of the child.
(f) The mother and father agree that each will notify
the other of all medical care the child receives while in
that parent's care. Each parent will notify the other
immediately of medical emergencies which arise while the
child is in that parent's care.
(g) The parties realize that their child's wellbeing is
paramount to any differences they might have between
themselves. Therefore, they agree that neither party
will do anything which may estrange the child from the
other parent, or injure the opinion of the child as to
the other parent or which may hamper the free and natural
development of the child's love or respect for the other
parent.

DEPENDANT'S PRETRIAL STATEMENT
Larry R. Carroll, Sr. Defendant, by and through counsel of
Andrew c. Sheely, Esquire, hereby files this Pretrial Statement
pursuant to Pa. R.C.P. 1920.33 and respectfully states as follows:
(1) As a result of a PPA action commenced in 1995
and subsequent incidents, Defendant has not been able
to return to the marital residence and obtain items
relating to the value of marital assets. Defendant
hereby submits a partial list of marital assets as
set forth below. Defendant reserves the right to
supplement the list and amend the values thereof at
the Hearing due to the changing values of the marital
assets and liabilities. In addition, the parties have
not yet agreed upon values for the majority of
assets, including the marital residence, pensions and
other items of personal property. However it is
anticipated that the parties will either stipulate to
the value of such or submit such assets for formal
valuation prior to the time of the hearing. In
addition, Defendant has served written
interrogatories upon Plaintiff to identify and value
additional marital assets.
At the time of separation, Wife was permitted to
gain exclusive possession to all marital assets,
including the marital residence. Defendant has not
had direct access to any assets or marital property
for nearly two years and is therefore dependent upon
Plaintiff for values of various marital assets and
liabilities. Defendant hereby incorporates the
written interrogatories which have been filed of
record as well as the public records such as deeds
and mortgages to verify the existence and identity of
all marital assets and liabilities.

(5) The parties gross income, payroll deductions, net
income, federal income tax returns and W-2 forms;
(i) Defendant's inoome tax returns are presently
unavailable but will be provided as soon as sucb are
made available and if suob exist. Defendant's montbly
income is limited and be is presently employed as a
laborer where he is paid approximately ten dollars
($10.00) per hour. A normally work week consists of
approximately 20 hours of work. Defendant has no
steady inoome and is dependent upon his employer,
refrigeration Speoialists, who determines wben and
where he will work. Prior to marriage, during
marria~e and after separation, Defendant has had a
similar earning oapaoity working as a carpenter,
general laborer and "jaok-of-all trades". Pre-
separation inoome tax returns are in tbe possession
of Plaintiff.
(6) Information Relative to Support, Income and Expense
Statement
(i) Copies of the support, income and expense
information are attached hereto. Presently,
Defendant receives a small amount of spousal support
from Plaintiff on a monthly basi.. As set forth
above, Defendant earns approximately $10.00 per hour,
pre tax, end minimi.es his expenses by residing at
his mother's residence in Hew Cumberland where he
does assist with some of her expenses.

(i) Absent sufficient information pertaining to
Defendant's pension and Retirement benefite (existing
and cashed-in), it is impossible to value these
items, In addition, decisions to cash-in the marital
pensions and other benefits constitute dissipation of
marital assets and Defendant is entitled to the

(9) Disputed Economic Issues and Items of Marital property
(i) Division of marital assets. At this point in
the proceeding, absent more specific information from
plaintiff, all marital assets and liabilities are
disputed with the exception of personal property.
Further, an issue will arise as to the dissipation of
marital assets, including personal property, as well
as insurance claims of Plaintiff for items of marital
property and non-marital property. A PFA order
entered in October of 1995 greatly limited
Defendant's access to the marital residence and many
items of personal property which existed at the time
of the separation were not included in the appraisal.
The values of marital assets, including the increase
in value after separation, will remain at issue due
to Plaintiff's decision to conceal or avoid providing
such information to Defendant
(ii) ~imony claim Defendant has a substantial
alimony claim against Plaintiff for the following
reasons. First, Defendant has an eighth grade
education and is thereby limited to manual labor type
jobs with limited retirement benefits. This is a ten
year marriage where Plaintiff was the primary wage
earner and who continues to earn substantial income
with significant retirement benefits. The age
difference between Plaintiff and Defendant further
restricts Defendant's ability to acquire jobs and
employment to provide for a standard of living
similar to that achieved during marriage.
Defendant has little, if any, opportunity for further
acquisition of martial assets, including retirement
benefits, and due to his station in life and chronic
alcoholism. Defendant's health is questionable and
has little opportunity to continue health benefits
following a divorce. Substantial alimony is necessary
absent a significant division of marital property in
favor of Defendant.

(11) Proposed Resolution of all economic issues;
(i) Due to his limited income ability, health,
age, inability to obtain insurance and station in
life, Defendant proposes a division of assets which
will allow both parties to continue their present
lifestyles. Such a distribution will result in
Defendant receiving a greater share of the existing
assets as he has little means to acquire such assets
in the future and much less time than Plaintiff.
Further, Plaintiff should not be rewarded for
dissipating marital assets and claiming insurance
proceeds to her benefit notwithstanding that
Defendant has an interest in the property. Plaintiff
has used her superior economic earning capacity and
control over marital assets to prejudice Defendant
who relied on her to maintain and manage the marital
assets during the marriage. Defendant proposes a 75
- 25 , division of marital assets, or an equal
division of assets with a substantial alimony payment
of significant duration.
Any proposal should leave the parties on equal
economic footing while providing both parties with an
opportunity for further benefits of their own labors.
Plaintiff has chosen to live with a male friend after
the separation and it will be demonstrated that the
male friend has contributed substantial income to her
livelihood, including her ability to preserve marital
assets. While an award should not punish Wife for
being the financially supportive spouse, such
financial resolution must consider the age, earning
capacity and stations in life for both parties.
Defendant, a chronic alcoholic, is not in good health
and his ability to earn significant future assets is
questionable. Plaintiff has maintained a carefree
lifestyle since separation, being able to rent cars
and maintain cellular phones, and with the ability to
receive a substantial monthly rent contribution from
her male friend since separation.

AND NOW, this 3'" day of October, 1997, comes the Plaintiff; Brinda K. Harvey-
Carron, by and through her attorney, Jacqueline M, Verney, Esquire, and files her Pro-
Trial Statement, and in support thereof, states as follows:
I. BACKGROUND
The parties were married on February 22, 1986 in Mechanicsburg, Pennsylvania,
The parties separated on September 30, 1995 and have been living separate and apart
since that time, A divorce complaint was filed on December 18, 1995 by wife raising
grounds ofirretricvable breakdown of the marriage and indignities and seeking equitable
distribution of property, Husband filed an Answer and Counterclaim on March 21,1996
raising the issues ofalimony and counsel fees and costs. Wife's claim ofindignities bars
Husband's right to a6mony, It is unknown whether Husband intends to litigate the
indignities issue.
On or about December 27, 1995 an order was entered wherein Wife pays $73,67
per month in spousal support to Husband which takes into account an offset for the
Husbands child support for one child living with Wife.
II. PRESENT INFORMATION
1. ASSETS AND LIABILITIES:
See attached Inventory and Appraisement. See Exhibit A,
2, EXPERTS:
Wife intends to call Mark E. Hilbert, the real estate appraiser and Vickie L, Hardy
who performed the appraisal of the parties personal property, Wire reserves the right
to supplement the list of expert witnesses as appropriate.
3, WITNESSES:
Wife expects to call Wife and Husband as witnesses. Various police officers may be
witnesses ifthe indignities claim is litigated. Wife reserves the right to supplement
her list of witnesses if necessary,
4, EXHIBITS:
Wife anticipates offering the Real Estate Appraisal, Exhibit B, the personal property
appraisa~ Exhibit C, bank statements, Wife's IncomelExpense Statement, Exhibit 0,
and the PFA Order protecting Wife from Husband, if necessary, as exhibits, Wife
reserves the right to supplement this list if necessary,
5, INCOME INFORMATION:
Wife is employed by the Pennsylvania Health Care Association. Wife believes
Husband is self-employed, See IncomelExpense Statement attached hereto,

7, COUNSEL FEES:
It is Wife's position that each side would have sufficient funds to pay for their own
attomey fees and thus neither party should be entitled to an award of counsel fees.

All marital property and the division thereof.
9, MARITAL DEBT:
Please see attached Inventory and Appraisement.
10, PROPOSED RESOLUTION:
Wife proposes that the parties retain the personal propeny presently in their
possession. Wife funher proposes that she be awarded the real property subject to her
obUgation to continue paying the two mortgages, Husband should not receive any
portion of Wife's pension or any other monetary award in light of his receipt of
$13,000.00 which Wife agrees to assume repayment thereof. Husband should not
receive an award of alimony, Furthermore, Wife has been extremely reasonable in
her efforts to resolve this matter thus demonstrating her good faith effort towards an
amicable resolution. Her reasonableness should weigh heavily against any award of
counsel fees or expenses in favor of Husband.
