The Plaintiff is DAUPHIN DEPOSIT BANK AND TRUST cnlPANY, a Pennsylvania Banking Corporation with its principal place of business at 213 Market Street, Harrisburg, Pennsylvania 17105. 2. The Defendant, MASON BIOOS, tla BIGGS' BUILDING SPECIALTIES, is an adult individual, whose last known address is 3 Bridle Lane, CalltJ Hill, PA 17011; and doing business as BIGGS BUILDING SPEX:IALTIES at 5002 Lenker Street, Mechanicsburg, PA 17055. 3. On or about Decer:ber 13, 1993, the Defendant, as Lessee entered into a Closed-End Motor Vehicle Lease Agreement with the Plaintiff and West Shore Lincoln Mercury, Inc., of Hechanicsburg, Pennsylvania 17055, the Deal er , as Lessors, for the lease of a 1994 Mercury Autanobile. 4. By the terms of the Agreement the Defendant agreed to pay to PI aintiff, as Lessor, the monthly lease payment of Five Hundred Twenty-nine Dollars and Thirteen Cents ($529.13) beginning Decer:ber 13, 1993 and on the 15th day of each month thereafter for a tenn of Thirty-six (36) months. 5. Pursuant to the terms of the Agreement, fail ure to make any payment on or before the date it is due constitutes a default. A copy of said Agreement is attached hereto as Exhibit "A" and made part hereof. 6. The Defendant defaulted \.alder the Lease Agreement by failing to make the monthly lease payment due for May 25. 1995 and all monthly payments thereafter. 7. By virtue of Defendant's defaul t, Plaintiff took possession of the Vehicle which was then held in storage in Dauphin, Dauphin County, Pennsylvania 17018. 8. on or about August 4, 1995, Plaintiff sent a Notice of Repossession of the Vehicle, to the Defendant. A copy of said Notice of Repossession to the Defendant, ~ BIGGS, is attached hereto as Exhibit "B" and to BIGGS BUILDING SPECIALTIES as Exhibit "c" and rrade a part hereof. 9. Defendant failed to take any timely action in accordance with said Notice of Repossession. 10. The Vehicle was sold at public sale on August 26, 1995 in Dauphin County, pennsylvania 17018. 11. After sale of the Vehicle and application by Plaintiff of the proceeds of the sale of the Vehicle a deficiency balance in the amount of Four Thousand Five Hlmdred Forty-seven Dollars and Fourteen Cents ($4,547.14), plus interest as stated in the Agreement, renained due and owing on the Agreement. 12. On or about August 30, 1995, Plaintiff notified the Defendant of the deficiency balance on the Agreement and requested payment of same. A copy of said Notice to the Defendant, ~ BIGGS, is attached hereto as Exhibit "0" and and to BIGGS BUILDING SPECIALTIES as Exhibit "E" and rrade part hereof. 13. The Defendant has failed to rrake any payment to Plaintiff on account of the deficiency balance of the loan. 14. In the event of default by the terms of the Lease, the Defendant agreed to pay to the Plaintiff on demand the total of all renaining IOOnthly Lease payments; plus the total Purchase Option price; plus all repossession costs, court costs, legal fees and all other charges which the Lessee is responsible for under the Lease; less any security deposit, insurance proceeds and the highest wholesale offer received by the Plaintiff. -2- 15. The balance due and owing fran the Defendant to the Plaintiff is the Sllll of Four Thousand Five Hundred Forty-seven Dollars and Fourteen Cents ($4,547.14), plus attorney's fees and court costs. 16.
