1. That John H. Myers & son, Inc. is the claimant in the
above-captioned action, filed on December 28, 1995.
2. That through a misunderstanding by counsel for the
claimant, a Mechanic's Lien claim was filed wherein Paragraphs 4
and 7 allege that the property subject to the Mechanic's Lien was
a residential dwell ing known and nllmbered as 11 shirley Lane,
Boiling springs, Middlesex Township, Cumberland County,
Pennsylvania, when in fact the property subject to the lien is Lot
No. 20 on the final subdivision plan for carolyn R. Glace, Plan
Book 69, Page 136, along Township Road 573 (Hoover Road), Middlesex
Township, Cumberland County, Pennsylvania.

3. That the said error was due to a misunderstanding and 18
an incorreot statement at the facts.
4. That the time for filing the Mechanic's Lien Claim has
not expired.
5. The owners will not be prejudiced by the amendment.
WHEREFORE, Petitioner prays 1eava to amend its aforesaid
Mechanic's Lien Claim by sUbstituting in Paragraphs 4 and 7 of Page
2 of the claim "Lot No. 20 on the final subdivision plan for

2. pursuant to seotion 1503(8) ot the Heohanio's Lien Law,
Claimant i. required to set torth in its Mechanio's Lien Claim an
aoourate desoription ot property said to be subjeot to the
Meohanio's Lien Claim.
3. At par.agraphs tour (4) and seven (7) ot his Lien Claim,
the Claimant describes the property claimed to be subject to the
lien liS a "residential dwelling located at 11 Shirley Lan ill , Boiling
Springs, Middlesex Township, cumberland county, Pennsylvania."
4. The aforesaid description is not an acourate desoription
of the property of the Owners. In fact, improvements were actually
made on a different property. Therefore, Claimant I s Mechanics'
Lien Claim is defective on its face and fails to comply with
sections 1503(8) and, as such, Claimant's Claim must be stricken.

5. pur.suant to section 1503(4), the Claimant is required to
state in his claim the date on which formal notice of intention to
file a claim was given.
6. Claimant's lien claim fails to state when, it ever,
tornal notice of intent to file a claim was given. Therefore,
Claimant's 1 ien claim is defl'ctive for failure to comply with
section 1503(4) of the Lien Law and, as such, must be stricken.

7. Pursuant to section 1502(a)(2), the claimant is required
to serve written notice at the clail1l1mt' s tiling at the claim upon
the owners within one (1) month atter riling. In that the
Claimant's Hen claim was tiled on or about December 19, 1995, the
written notice at such tiling was to be served upon the Owners on
or betore January 19, 1996.
B. The ownars were not served with the required notice at
the filing of the Claimant's Lien Claim on or before January 19,
1996, and it is further believed, and therefore averred, that no
written notice was served by the Claimant, Therefore, Claimant's
lien claim is defective for failure to comply with section
1502(a) (2) of the Lien Law and, as such, must be stricken.
9. Pureuant to section 1502(a)(2), the Claimant was required
to file an affidavit of service of notice of his filing of the lien
claim within twenty (20) days after service of notice.
10. It is believed, and therefore averred, that the Claimant
has failed to file the required atfidavit of service. Therefore,
Claimant's Mechanics' Lien claim is defective for failure to comply
with the Lien Law and, as such, it must be stricken.

The owners of the property subject to the lien are Alfred R.
Logan and Irene J. Logan, husband and wife, of 11 Shirley Lane,
Boiling springs, Middlesex Township, cumberland county, Pennsylvania
17007.

The date on which claimant completed the work for which the
claim is made was October 20, 1995,

Denied.
After reasonable investigation, the Owners,
Alfred R. Logan and Irene J. Logan, are without. information
sufficient to form a belief as to the truth of the averment that
t.he Claimant's counsel misidentified the property subject to the
mechanic's lien because of a misunderstanding. Said averment is,
t.herefore, denied.
By way of further response, the proper
description of the Owners' property potentially subject to a
mechanic's lien is a matter of public record to which there can be
no misunderstanding.
It is further alleged that inasmuch as the Claimant
admits that the property has been misidentified in it.s mechanic's
li.n olaim, it is irrelevant ae to why the property wae eo
miei4entifie4. By way of further response, the Meohanio's Lien
LaW, (49 P.B. 81~04) prohibits the amen4ment of a mechanio's lien,
olaim whioh undertakes to substitute a different property than that
desoribed in the olaim, after the time for filing a claim has
expired, .
3. A4mitted in partl denied in part. It is admitted that
the error referred to in paragraph 2 of Claimant's pstition to
Amen4 is an incorrect statement of the facts. Inasmuch as the
Owners are without sufficient information to form a belief as to
the truth of the remaining averments of paragraph 3, said averments
are 4enied. By way of further response, the Owners incorporate by
reference herein their response to paragraph 2,
4. Denied. It is specifically denied that the time for
filing a mechanic'S lien claim has not expired, On the contrary,
the date on which the Claimant completed its work for which the
olaim is made was on or before September 27, 1996. As the date of
the instant petition to Amend is February 3, 1996, the four month
time limit for the filing of a mechanic'S lien has expired.
5. Denied. The Owners will be prejudiced by the amendment
of the Claimant's mechanic's lien claim as such an amendment would
be contrary to applicable law.

2. That through a misunderstanding by counsel for the
claimant, a Mechanic's Lien Claim was filed wherein paragraphs 4
and 7 allege that the property subject to the MeChanic's Lien was
a residential dwelling known and numbered as 11 Shirley Lane,
Boiling Springs, Middlesex Township, cumberland county,
pennsy~vania, when in fact the property subject to the lien is Lot
No. 20 on the final subdivision plan for Carolyn R. Glace, Plan
Book 69, Page 136, along ~ownship Road 573 (lIoover Road), Middlesex
Township, cumberland county, Pennsylvania.
