COMPLAINT
1. Plaintiff, E-D Centers d/b/a Mechanicmburg Plaza,
is a MisDouri General Partnership doing business cIa R.J. Waters
, Associates, Brandywine II Building, suite 304, Routes 202 and
1, Chadds Ford, Pennsylvania.
2. Defendants are Paul Dransfield and Rosalyn
Dronsfield, husband and wife, doing business as Mechanicsburg
Flowers and Gifts at 5303-F Simpson Ferry Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
3. On or about June, 1990, E-D Centers d/b/a
Mechanicsburg Plaza became landlord of the leasehold property
from Mechanicsburg Development Company and took over all existing
leases at the Mechanicsburg Plaza.
4. on or about l\pr 11, 1994, plaintiff evicted Neema
Thakrar, individually and d/b/a Wesley Berry Florist from the
leasehold premises at 5303-F simpson Ferry Road, hachanicsburg,
Cumberland County, Pennsylvania where he was doing business.
5. Defendants purchased the business from Neema
Thakrar d/b/a Wesley Berry Florist and moved into the leasehold
premises without ever obtaining a lease or an assignment of Neema
Thakrar's lease from the plaintiff.
6. The defendants almost immediately fell into arrears
and since then negotiations have continued concerning the
plaintiff and defendants entering into their own lease but
plaintiff would not do so until defendants b~ought their account
current which they never did.
7. plaintiff and defendants have been operating
pursuant to the terms of the Lease between Mechanicsburg
Development Co., plainti~f's predecessor in interest, and Neema
Thakrar, individually and d/b/a Wesley Berry Florist, but
defendants are in arrears in the amount of $20,704.24 as of
December 5, 1995. A true and correct breakdown on the amount due
and owing and the Lease Agreement are attached hereto, made part
hereof and marked Exhibits "A" and "B" respectively.
8. Pursuant to the agreement, between plaintiff and
defend8nt~, defendants agreed to pay monthly rent, CAM, taxes and
insurance as provided in the lease.
9. Defendants have been sent repeated notices of
default which have all gone uncured.

$20,704.20 plUS $2,009.46 per month, as well as reasonable
attorneys' fees incurrnd in enforcing the terms of the lease
pursuant to paragraph 9.4 of the lease.
11. plaintiff'S reasonable attorneys' feeS in
connection with this lawsuit ~re $1,500.00.
WHEREFORE, plaintiff requests this Honorable court to
enter judgment in favor of plaintiff and ag~inst defendants,

ORDER

ORDERED AND DECREED that the relief prayed for in the Motion be, and hereby is

Cumberland County be and hereby is avoided; it is further
ORDERED AND DECREED that a certified copy of this Order may be filed with the
