AND NOW, September 11, 1997, upon conslderallon of the parties' Consent
Agreement, the Order of January 3, 1996, Is modified as follows:
1. The plaintiff and defendant shall share physical custody of the child,
Jennifer Elaine Mae Mentzer, born 10/31/95, on an alternallng weekly basis,
exchanging custody every Monday evening at 7:00 p.m., and shall share custody
on the child's birthday and holidays at limes to be agreed upon by the parties.
2. The custody count In the Temporary Protection Order Is consolidated with
the Custody Action No. 95.7232.
3. In all other respects the Custody Order of January 3, 1996, remains In
effect.
4. This order to be without prejudice to either party to refer the matter to a
Custody Conciliator.

hereinafter referred to as the mother, resides at 96 Prlnce~s
Boulevard, Mechanlcsburg, Cumberland county, Pennsylvania 17055.
2. The plaint Iff/respondent, Steven A. Mentzer, hereinafter
referred to as the father, resides at 21 Evandale Court,
Carlisle, Cumberland County, Pennsylvania 17013.
3. The parties are the parents of Jennifer Elaine Mae

4. On January 3, 1995, Judae J. We~ley Oler entered an
Order of Court granting shared legal and physical custody of the
child to both parents see copy of the Order which Is attached and

Incorporated by reference.
S. The parties have not followed the January 3, 1995,
Custody Order since they have either resided together with the
r.hlld or have been separated and have made varying arranlements
for the child. Most recently, the mother has had primary custody
of the child by agreement of the parties since In or about

February of 1997. For the past several months the father has had
no contact with the child.
6. On !leptember 4, 1997, II Petition for l'rotectlon From
Abuse was filed In Cumberland County Court of Common pleas at No.
97-4780 civil Term and 8 Temporllry Protection Order was entered
by Judge Hoffer ordering In part the mother hllve temporary
custody of the child. The mother's petition Inadvertently
omitted reference to the January 3, 1995 custody Order becsuso
the parties, by agreement. had never abided by the Order.
7. The Order of Janusry J, 1995 Mhould be modified reaMon
Including the following:
a. The partleM have not abided by the Order since Its
entry and the mother has provided primarily for the
child.
b. The father haM abused the mother In the present. of
the child and at tlmeM has caused Injury to the child
during these IncldentM of domestic violence.
c. The father. on several occaMions, haM specifically
threatened to kill the mother and the child causing the
mother to fear for the child's safety.
WHEREFORE, the defendant/petitioner requests that this court
enter a Temporary Order granting Immediate phy~lcal custody of
the child to the defendant/petitioner and granting supervised
visits to the plaintiff/respondent at times and places to be
