AND NOW, comes the Plaintiff, John F. Walter Excavating, Ino., by Its attorneys, Aower,
Morgenthal, Flower & Undsay, P.C., and states the following cause of action:
1. The Plaintiff Is John F, Walter Excavating, Inc" a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania, having Its principal office and place of
business at Box 175, Newville, Cumberland County, Pennsylvania 17241.
2, Defendant Is SBS Custom Homes, Ino" a close corporation organized existing under
the laws of the state of Maryland, having Its principal place of business at 227 L Gateway Drive,
Bel Alre, MD 21014; and having a mailing address of P,O. Box 915, Bel Alre, MD 21014.

3. Plaintiff Is In the business, in1m: mm., of providing excavating, hauling, and other
construction services Involving heavy trucks and equipment.
4. Defendant Is In the business of home construction and general contracting.
5. Defendant, at all times relevant hereto, was performing contracting and construction
work In a project known as Redwood Hills Development, located In Middlesex Township,
Cumberland County, Pennsylvania; where It was constructing residential houses for Individual
customers,

6, At the oral request of Defendant, through Its agents and officers wOI'klng at the sald
Cumberland County construction site, Plaintiff performed certain services for It as a sub-contractor,
as more particularly itemized on statements attached hereto, made part hereof, and marked Exhibit
"A..
7. Defendantaccepled all work performed by Plaintiff, and promised to pay Plaintiff the
amounts billed to It, which were Invoiced at Plaintiff's regular rates as charged for said services.
8. Plaintiff's rates as charged are fair, reasonable, and on a customary charges made
to Plaintiffs customers In Cumberland County, Pennsylvania.
9. The total amount due for the services performed by Plaintiff for Defendant Is $5845.
In addition, a service charge, which was agreed to by Defendant, In the amount of $242.27 Is due
and payable.
10. Despite demands by Plaintiff has failed and/or refused, and continues to fall and/or
refuse to pay the amount due.
WHEREFORE, Plaintiff demands Judgment in the amount of $6,087.27 against Defendant,
together with Interest and cost of suit.
