The defendant, william R. Thomas, II, is enjoined from physically abusing the plaintiff, Victoria L. Thomas, and from placing her in fear of abuse. 2. The defendant is enjoined from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications, except for the limited purpose of faoilitating custody arrangements. 3. The defendant is ordered to refrain from harassing and stalking the plaintiff and from harassing the plaintiff'S relatives. 4. The defendant is prohibited from entering the plaintiff'S place of employment. 5. The defendant is prohibited from removing, damaging, destroying or selling any property owned by the plaintiff or jointly owned by the parties. 6. The defendant is excluded from the plaintiff'S residence located at 317 S. Yor.k street, Mechanicsburg, Cumberland county, Pennsylvania, and any other residence the plaintiff may est.ablish, except for the limited purpose of transferring custody during which times the defendant shall remain in his vehicle. 7. This Order shall remain in effect for a psriod of one year or until modified or terminated by the Court. The Order oan be extended beyond its original expiration date if the Court finds that the defendant has committed another act of abuse or has engaged in a pattern or p~actice that indicates continued risk of harm to the plaintiff. 8. This Order may subject the defendant to: i) arrest under 23 Pa.C.S. 56113; ii) a private criminal complaint under 23 Pa.C.S. 56113.1; iii) a charge of indirect criminal contempt under 23 Pa.C.S. 56114, punishable by imprisonment up to six months and a fine of $100.00-$1,000.00; and iv) civil contempt under 23 Pa.C.S. 56114.1. Resumption of co-residence on the part of the plaintiff and defendant shall not nullify the provisions of the court order. 9. The Middlesex Township police Department shall be provided with a certified copy of this Order by the plaintiff'S attorney and may enforce this Order by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of a police officer. In tho event that an arrest is made under this section, the defendant shall be taken without unnecessary delay before the court that issued the order. Thorn.., II, Defendant AND NOW, this la ~ day of February, 1997, upon consideration of the parties' Consent Agreement, the following Order is entered with regard to custody of the parties' children, William Roy Thomas DOB 12/27/88 and Katreena Marie Thomas DOB 2/19/91. 1. The plaintiff, hereinafter referred to as the mother, shall have primary physical and legal custody of the children. 2. The defendant, hereinafter referred to as the father, shall have partial cuetody of the children on dates and at other times agreed upon by the mother and father. 3. The mother and father agree that each shall notify the other immediately of medical emergencies which arise while the children are in that parent's care. 4. Neither party shall do anything which may estrange the children from the other parent, or injure the opinion of the children as to the other parent or which may hamper the free and natural development of the children's love or respect for the other provisions of the court order. This Order shall remain in eff~ct until modified or terminated by the Court and can be extended beyond its ori.inal expiration date if the Court finds that the defendant has committed another act of abuse or has engaged in 8 pattern or practice that indicates continued risk of harm to the plaintiff. Thomas, II, (SSN: 061-54- 7057)(Date of Birth. 5/14/67), is an adult individual residing at 68 Regency Woods North, Carlisle, Cumberland County, Pennsylvania, 17013. 3. The defendant is t.he plaint.iff's husband. 4. Since approximately February 1994, t.he defendant has attempted t.o CftUSS and has intent.ionally, knowingly, or recklessly caused bodily injury to the plaintiff, has placed the plaintiff in reasonable fear of imminent. serious bodily injury, and has knowingly engaged in a course of oonduct or repeatedly committ.ed acts toward the plaintiff under circumstances which have placed the plaint.iff in reasonable fear of bodily injury. This has included, but is not limited t.o, t.he following specific instances of abus~: 1 a. On or $bout December 16, 1996, the defend$nt forcefullf shoved the plaintiff against a door by pUBhing her ahout her shoulders with both of hlR hands. He then shoved her with his bodf pushing her into a stove, grabhed her by the throat, and covered her mouth with hiR hand. When the plaintiff waR able to Rtruggle free from his grip, the defendant forcefUlly pushed her with hia body shoving her and the table against which she was leaning into a wall. The defendant then followed the plaintiff into another room where she went to avoid abuse, The defendant grabbed her from her chair onto the floor, grabbed her and ripped the front of her shirt, and grabbed her bra ripping it. The defendant threatened the plaintiff s8fing that he could reallf hurt her and eould kill her. Having asked the defendant to leave, and the plaintiff went Into another room and when she heard B dOOl' click she thought, the defendant had left the residence. The defendant flew Into the bedroom where the plaintiff W8S, pUBbed the plaintiff in the shoulders with both hands cauBlng her to fall Into boxes in a closet. Aa a result of this incident, the plaintiff had bruises on her face, throat, arms, and legB. b. On or about December 12, 1996, the defendant used 2 , " hia body to block the plaintiff from leaving the residence. When she attempted to push him aalde and open the door, the defendant grabbed her by the hair and pulled back Inside the residence. c. On several different occaslona since February 1994, the defendant haa pushed nnd grabbed the plaintiff causing her to fear for her safety. In or about February 1994, the defendant threw a steak knife at the plaintiff and It landed on the floor next to the plaintiff causing her to fear for her saf~ty. 5. The plaintiff believes and therefore avers that ahe is in immediate and present danger of abuse from the defendant and that she is In need of protection from such abuse. 6. The defendant, William R. Thomas, II, is enjoined from physically abusing the plaintiff, victoria L. Thomas, and from placing her in fea~ of abuse. 2. The defendant is enjoined from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications, except for the limited purpose of facilitating custody arrangements. 3. The defendant is ordered to refrain from harassing and stalking the plaintiff and from harassing the plaintiff's relatives. 4. The defendant is prohibited from entering the plaintiff's place of employment, 5. The defendant is prohibited from removing, damaging, destroying or selling any property owned by the plaintiff or jointly owned by the parties. 6. The defendant is excluded from the plaintiff's residence located at 317 S. York street, Mechanicsburg, cumberland County, Pennsylvania, and any other residence the plaintitt may establish, except tor the limited purpose ot transterring custody during which times the dstendant shall remain in his vehicla. 7. This Order shall remain in ettect tor a period of one year or until moditied or terminated by the court. The Order can ba extended beyond its original expiration date if the Court tinds that the detendant has committed anot.her act of abuse or has engaged in a pattern or practice that indicates continued risk ot harm to the plaintift. 8. This Order may subject the defendant to: i) arrest under 23 Pa.C,B. 56113; ii) a private criminal complaint under 23 Pa.C.B. 56113,1; iii) a charge of indirect criminal contempt under 23 Pa.C.B. 56114, punishable by imprisonment up to six months and a fine of $100.00-$1,000.00; and iv) civil contempt under 23 Pa.C.B. 56114.1, Resumption of co-residence on the part ot the plaintiff and defendant shall not nullify the provisions of the court order. 9. The Kiddle.ex Township Police Department shall be provided with a certified copy of this Order by the plaintiff'S attorney and may enforce this Order by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence ot a police officer. In the event that an arrest is made undor this section, the defendant shall be taken without unnecessary delay betore the court that issued the order. When that court is unavailable, the defendant v. The Father shall have par.tial physical custody of the Children on June 14, 1997 ft"om 9:00 a.m. until the Children's paternal grandfather picks up the Children for a week long visit later on the SSlllt!l dIly. The Father shall also have partial custody of the Children on saturday June 21, 1997 from 8:00 a.m. when the Father shall pick up the Children from the Mother's place of employment, until 6:00 p.m. Thereafter, the Father shall have custody of the Children on one day each weekend from 9:00 a.m. until 6:00 p.m., alternating between Saturday and Sunday, beginning with Saturday June 21, 1997. on every fourth Saturday when the Mother works, the Father shall pick up the Children at 8:00 a.m at the Mother's place of employment. On all other weekends, the Mother shall take the Children to the Father's residence at 9:00 a.m. on either the saturday or sunday morning in accordance with the alternating schedule. 3. The Father shall have partial custody of the Children for one overnight period, from Saturday, August 9, 1997 at 9:00 a.m. until Sunday, August 10, 1997 at 6:00 p.m. The Mother shall have custody of the Children for the entire weekend of August 16 through August 17, 1997, 4. The parties shall share or alternate custody of the Children on holidays as follows: A. Christmas: In every year, the Father shall have custody of the Children on Christmas Eve from 2:00 p.m. until 9:00 p.m. and the Mother shall have custody of the Children from Christmas Eve at 9:00 p.m. through Christmas Day. B. New Years Day: The Father shall have custody of the Children on New Years Day in even numbered years and the , Mother shall have custody of the Children on New '{ears Day in odd numbered years. C. Easter I ~'he Father shall have custody of the Children on saturday during Easter weekend in oven nUtr/Jered years and on Easter Sunday in odd numbered years.
