1. Plaintiff i. William C. smith, an individual who re.ide.
at 21 Ea.t Kaller street, MechanicsDurg, Pennsylvania, 17055.
2. Defendant i. Young L. Kim, an individual who r..id.. at
8318 Ba.t King. Gat. Road, Springfield, Virginia, 22153.
3. On October 31, 1994, the plaintiff waa operat1nljJ a van on
the pUblic roadways located within I.emoyn- Borouqh, cuaberland
county, pennsylvania.
4. On October 31, 1994, while operat1nq said van, the
plaintiff entered upon the entrance ramp to Interstate 83, where he
came to a stop, in order to yield the right of way to oncoming
traffic alon9 Interstate 83.
5. At the same time and qoneral location, the Defendant,
Young I.. Kim, was operating another van, and also entered the same
entrance ramp, travelling behind the vehicle driven by plaintiff.
6. "S the plaintiff was motionless and yielding the right of
way to oncoming traffic, the Defendant caused his van to collide
with the rear of Plaintiff'S van, causing the damages and injuries
hereafter set forth.
7. "S a result of the collision between the two vehicles,
the plaintiff was thrown violently about within the interior of his
vehicle and suffered cortain injuries as a result therefrom.
8. The Defendant was negligent in the operation of his
vehicle, in the following respects I

(a) In tailing to bring hi. vehicle to a atop betore it
collided with the rear of Plaintift'a vehicle,
(b) In driving at an unaate and exceaaive apeed and at
a apeed which would not permit him to atop within the aaaured
clear di.tance ahead/
(c) In failing to yield the right ot way to Plaintiff'.
vehicle, and,
(d) In operating hie vehicle at such time as the
vehicle was defective and unfit for use on the pUblic
roadways, including but not limited to having defective
brakes, which would not allow it to stop in time before
colliding with Plaintiff's vehicle.
9. As a result of the collision caused by the negligence of

the Defendant, the Plaintiff suffered certain physical injuries to
his body, including but not limited to pain in his neck and back,
lIIuscle strains and sprains, and other physical injuries to his
person.
10. As a result of the injuries suffered as aforesaid, the
Plaintiff was prevented from pursuing his usual occupation and
avocations, to hie detriment and loss.

DIAGNOSIS: N~ck and shoulder pain
Dear Dr, Ruthl
This patient has been receiving treatments since F.bruary 22,
1995. The rehabilitation program now consists of moist heat,
strengthening exercises, McKenzie exercises and a home program.
Please see evaluation of February 22, 1995 for patient's initial
status,
CURRCNT STA.TUS:
William reports lifting a case of soda with increased pain in the
posterior neck region. Pain level has decreases since yesterday,
but continues to be rated at 2/10, Neck range of motion is within
normal limits, except right sidebend to 34" and left sidebend to
280, Pain is evident in the lower cervical region with both
motions. Neck strength appears within normal limits after slight
pain. He appears to be improving with exercise.
COMMENTS I
William is continuing with a home exercise program. He may
benefit from continued physical therapy for strengthening and
conditioning activities.
If you have any questions regarding your patient'S treatment,
please call me at 795-6740. Thank you for this referral.

This is in ~efer~nce to William Smith (Chartff 101603) of 21
East ~eller Street, Mec~anicsburg, Pennsylvania, who~ T initially

~r, Smith is a 33-year-~ld Rentleman Renerally in ~ood health
who was involverl in an autonobile accinent approximately five
~onths a~o, His van that he was driving in was rear-ended by
another full size van, ;his accident happened on October 31,
19Q4, He states t~at his hean was first thrown back and he
reported that ,e later found his glasses at the back of the
van, His head was then thrown fo~ward, Ke devel0ged neck pain
ann oain into the left t=anezius muscle and he has had oain
and tend~r~ess since that ~ime, Me ,as been treated co~servatively
with anti-inflam~atory a,ents, muscle relaxants and physical
theraov. Me states he is sonewhat better but continues ta have
~ome ti~htnes5 in the mid-portion of. the cervical spine and
to the left of the midline in the trapezius muscle, r have
examined this Rentleman today, He does not have any marked
increased PAin with ver~ex conoression, He has reasonably Rood
ran~e of motion of. the !oine,
0n inspection from the ~ac~. he does have some tenseness of
the traoezius muscle an the left eomnaren to the ri~ht. ~~ palpation
the muscle is also tense on the left compared to the ri.ht.
HA is entirelv intact ne~rolo~ically in the uoper extremities.
Peep tendon reflexes, metor strength and sensation a=e all within
normal limits.
T have reoeaten a flexion and extension film of the cervical
soine today and T see no instability of the cervical soine in

at Seidle on December 13, 1994 and T do not see any evidence
of any abnormalities on those films either, save for minimal
de~enerative chan~ee present,
T think this gentleman has suffered a soft tissue strain to
the neck an~ left trapezius muscle. T can detect no neuroloRic
deficit Rnd no instability about the cervical spine, T have
told ~r. ~mith that T think there is a good chance his symptoms
will Rbate but it may take another six months to a year to be
asymPtomatic, He should continue to !{or!~ on stretching eXl!rcisee
for the cervical epinl!!, ffopefully with time his symptoms will
abBte. r have placed him on a short Course of Prednisone to
see whether we can move him up a level in terms of comfort.
Ire does work as a furniture refinisher and does do a fair emount
of heavy !{ork and is !{orking a t the presen t time, r would like
to touch bese with him in about a month to soe whether the Pred-
nisone gave him any beneficial effect,

Mr. Smith is doing much better with his neck. His p~in is
not constant now. He does still get some pain when he does
lifting, J am going to have him continue to work on stretching
exercises and he can slowly increase his activities. He
will return to see me only if he is having difficulties.
