NOW COME Plaintiffs Robert L. valiton and Dana M.
valiton, husband and wife, by their attorneys Spence, Custer,
Saylor Wolfe & Rose, and file their Complaint whereof the
following is a statement I
1. Plaintiffs Robert L. valiton and Dana M. valiton are
adult individuals, sui jurio, who are husband and wife and who
reside at R.D. iI, Box 213A, Manns Choice, Bedford County, PA
15550.
2. Defendant Western Sizzlin' Steak Houses is a for-
profit entity which does business as Western Sizzlin' Restaurant
at 1205 Harrisburg pike, Carlisle, Cumberland County, PA 17013.
3. Defendant STB Corporation is a for-profit
corporation which does business as Western Sizz1in' Restaurant at
1205 Harrisburg Pike, Carlisle, Cumberland County, PA 17013.

4. At all times relevant hereto, Defendants were
engaged in the restaurant busine.. of selling food to retail
customers at Western sizzlin' Steak Houses throughout the united
States, including the Western Sizzlin' Restaurant at 1205
Harrisburg Pike, Carlisle, PA 17013.
5. On Saturday, February 19, 1994, at about 6130 p.m.,
Plaintiffs were retail customers having dinner at Defendants'
restaurant. Plaintiffs' receipt for their meals is attached
hereto as Exhibit RAR.
6. Plaintiff Robert L. Valiton purchased a salad which
he prepared from ingredients at the salad bar which, unknown to
him, contained small, hard, dark-colored foreign objects.
7. When Robert L. Valiton was eating his salad, he bit
onto a foreign object in the salad and immediately experienced
excruciating pain in his teeth, mouth and jaw.
B. Plaintiffs promptly reported the problem to Ken
Berry, manager of Defendants' restaurant who examined the foreign
objects but could not identify them or explain how they got into
the salad bar ingredients.
9. Manager Berry apologized to Plaintiffs and took the
foreign objects from their table.

COUNT I - NEGLIGENCE
ROBERT L. VALl TON VS. DEFENDANTS
10. Plaintiffs incorporate by reference paragraphs 1
through 9.
11. Robert L. Va1iton's injuries were caused by the
negligence and carelessness of Defendants in thatl
a. Defendants failed to prepare the salad bar with
proper diligence and precaution;
b. Defendants failed to properly inspect the
ingredients on the salad bar in order to insure the purity of the
contents thereof;
c. Defendants allowed and permitted foreign objects of
unknown composition to be and exist in the ingredients on the
salad bar.
12. Solely as a result of Defendants' negligence,
Robert L. Valiton suffered injuries to his mouth, teeth and gums
which caused him great physical pain and mental anguish and which
required root canal procedures to tooth .13 on February 25, 1994
and to tooth '14 on March 13, 1994.
13. The injuries to Robsrt L. Valiton's mouth, teeth
and gums are permanent. Ilia teeth continue to be sensitivs to
hsat and cold and he is unable to chew on the left side of his

mouth, all of whioh may oontinue for an indefinite time in the
future.
14. By reaeon of his injuries, Robert L. Valiton has
been prevented from pursuing his daily aotivities and customary
duties and believes that he may be prevented from doing so in the
future.
15. By reason of his injuries, Robert L. Valiton has
been unable to follow his usual employment, and will be unable to
follow the same for an indefinite time in the future, thereby
losing the income which would have come to him through employment.
16. Solely because of Defendants' conduct, Robert L.
Valiton has been obliged and probably will in the future be
obliged to expend various sums of money for medicine and medical
and dental attention for treatment of his injuries.
17. Pursuant to Pa.R.C.P. 1305, Plaintiffs intend to
offer the following documents in evidence, copies of which are
attached hereto as exhibits I
Exhibit "B" - Memorial Hospital of Bedford County
Emergency Department Record dated February 19, 1994.
Exhibit "C" - Memorial Hospital of Bedford County
Itemized Bill in the amount of $119.00.
Exhibit "D" - Report of John P. Livengood, D.M.D. dated
February 3, 1995

Exhibit "E" - Report of John P. Livengood, D.M.D. dated
March 6, 1995.
Exhibit "F" - Statement of John P. Livengood, D.M.D. in
the amount of $752.00.
Exhibit "G" - Six (6) Pharmacy Bills totalling $49.45.
WHEREFORE, Plaintiff Robert L. Valiton demands damages
from Defendants in an amount not in excess of the limits requiring
arbitration referral.
COUNT II - STRICT LIABILITY
ROBERT L. VALITON vs. DEFENDANTS
lB. Plaintiffs incorporate by reference paragraphs 1
through 9 and 12 through 17.
19. The salad ingredients sold by Defendants were
defective and unreasonably dangerous to the consumer publio in
that they contained a foreign object or objects which posed a
serious threat of causing injury to their customere.
20. The salad ingredients eold by Defendants were in
the same condition at the time they were consumed by Robert L.
Valiton ae they were when they left the control of Dsfendants in
that they were unsafe and unfit for consumption by members of the
public.
21. The salad ingredients were used for their intended
purpose in that they were consumed by Robert L. Valiton.

22. As a direct and proximate result of the consumption
of the salad, Robert L. Valiton was injured as above set forth.
23. Defendants are strictly liable for Robert L.
Valiton's injuries and damages which resulted from consumption of
the defective, dangerous and hazardous salad.
WHEREFORE, Plaintiff Robert L. Valiton demands damages
from Defendants in an amount not in excess of the limits requiring
arbitraticn referral.
COUNT III - DANA M. VALITON vs. DEFENDANTS
LOSS OF CONSORTIUM
24. Plaintiff Dana M. Va lit on incorporates by reference
paragraphs 1 through 23.
25. As a result of the injuries to her husband, Dana M.
Valiton has been and will continue to be deprived of her husband's
aid, comfort, services, society companionship and affection, all
to her great detriment and loss.
WHEREFORE, Plaintiff Dana M. Valiton demands damages
from Defendants in an amount not in exoess of the limits requiring
arbitration referral.

Dear Sirsl
Patient Robert Valiton was sesn in our offics on 2-21-94 with
sensitivity sod pain to maxillary left quadrant with possible
past history of trauma. On examination teeth '13 and '14
were ssnsitive to percussion and palpation. A root cansl
was perfot:med on tooth 113 (maxillary left second premolar)
on 2-25-94. Pain still persisted and on 3-14-94 a root canal
was perfot:med on tooth 114 (maxillary left first molar).
Restorations were perfot:med on both teeth on 4-13-94.
Patient was seen recently on 1-30-95 on follow-up. The patient
experisnced alight aenaitivity to mastication on tooth '13
but prognosis is favorable, If pain persists on tooth '13
for three to six montha, an apicoectomy may be planned but
not anticipated,

In response to your letter of February 14, 1995, this is to
inform that Mr. Robert Va1iton was seen on February 21, 1994,
with dental injuriea of testh 113 and 114 as previously stated
due to biting on a foriegn object at a Western sizzlin Reatau-
rant on Saturday, February 19, 1994. Detailed information
was provided in a letter of February 3. 1995.

COMPLAINT JOINING ADDITIONAL DEFENDANT
AND NOW, Defendant STB corporation, by Its attorneys, Thomas, Thomas &
Hafer, flies this Complaint Joining Parkway Provision company t1d/b/a Parkway Food
Service and H.B, Hunter company, Inc. as Additional Defendants for the following
reasons:
1. Defendant STB corporation Is a corporation that does business as
Western Slzzlln' Restaurant at 1205 Harrisburg Pike, Carlisle, Cumberland county,
Pennsylvania, 17013.
2, Additional Defendant Parkway PrOVision company, Inc., t1d/b/a parkway
Food Service Is a corporation that does business at 1115 Garden street, Greensburg,
Pennsylvania, 15601.
3. Additional Defendant H.B. Hunter company, Inc. Is a corporation that
does business at 1512 Brown Avenue, Norfolk, Virginia, 23504.
4. On December 26, 1995, Plaintiffs Instituted this action against
Defendant STB In the Court of common Pleas of Cumberland county. A copy of
Plaintiffs' complaint Is attactled hereto and marked Extllblt A.

5. On February 21,1996, Defendant STB flied Its Answer and New Matter
to Plaintiffs' complaint, a copy of which Is attached hereto and marked Exhibit B.
6. on February 20, 1996, Defendant STB flied a Praecipe for a Writ of
summons Joining Parkway provision company, Inc. and H.B. Hunter Company, Inc.
as Additional Defendants In this action.
7. On or about February 19, 1994 at the time and place alleged In
Plaintiffs' complaint, Plaintiffs were customers having dinner at Defendant STB'S
restaurant.
B. On or about said date and place, Plaintiff Robert vallton alleges that
he prepared a salad from Ingredients at Defendant's salad bar and upon eating the
salad, bit Into a small, hard object.
9. If Plaintiff Robert Vallton bit Into an object. Defendant STB believes and
therefore avers that It was actually an olive pit or portion of an olive pit, a natural
part of the Ingredients of the salad bar.
10. Defendant STB purchased the pitted olives for the salad bar, belieVing
that the olives contained therein were free of pits and therefore totally edible.
11. Defendant STB had purchased the olives, that were Included In the
salad bar, from Additional Defendant Parkway. a food distributor,
12. The olives used at the salad bar were produced, sold and distributed
by Additional Defendant H.B. Hunter company.
13. If the olives were defective and unreasonably dangerous In that they
contained an object, which Is specifically denied, then Additional Defendants are
strictly liable for the Plaintiffs' Injuries and damages.
14. Additional Defendant H.B. Hunter was negligent In that It:
a. Failed to properly Inspect the olives prior to bottling;
b. Failed to take proper precautions In processing the olives to
prevent foreign objects or olive pits to remain In ttle product; and

c, Failed to warn of the presence of olive pits or foreign objects
on Its product.
15. Any liability on tile part of Defendant STB was wholly secondary and
passive, and the liability of Additional Defendants was primary and active,
16, If It Is determined that Plaintiffs are entitled to recover any or all of
the damages set forth In their complaint, which Is specifically denied, then
Additional Defendants are solely liable to Plaintiffs, Jointly liable to Plaintiffs or
liable over Defendant STB for contribution, Indemnification, or both.
WHEREFORE, Defendant STB corporation respectfully requests your
Honorable Court to dismiss Plaintiffs' Complaint and enter jUdgment In Its favor.
In the alternative, If It Is determined that Plaintiffs are entitled to recover, the
Defendant STB requests that judgment be entered solely against Additional
Defendants, In the further alternative, If It Is determined that Plaintiffs are entitled
to recover against Defendant STB, which Is speciFically denied, then Defendant STB

NOW COME plaintiffs Robert L. valiton and Dana M.
Valiton, husband and wife, by their attorneys Spence, Cu.ter,
Saylor Wolfe & Rose, and file their Complaint whereof the
following is a etatementl
1. Plaintiffs Robert L. valiton and Dana M. valiton are
adult individuals, sui juris, who are husband and wife and who
reside at R.D. '1, Box 2l3A, Manns Choice, Bedford County, PA
15550.
2. Defendant Western Sizzlin' Steak Bouses i. a for-
profit entity whioh does business as Western Sizzlin' Re.taurant
at 1205 Harrisburg Pike, Carlisle, Cumberland County, PA 17013.
3. Defendant STB corporation is a for-profit
oorporation which does business as Western Sizzlin' Restaurant at
1205 Harrisburg pike, Carlisle, Cumberland County, PA 17013.

4. At all times relevant hereto, Defendants were
engaged in the restaurant business of selling food to retail
customers at Western Sizzlin' Steak Houses throughout the united
States, inoluding the Western Sizzlin' Restaurant at 1205
HArrisburg pike, Carlisle, PA 17013.
5. On Saturday, February 19, 1994, at about 6130 p.m.,
Plaintiffs were retail customers having dinner at Defendants'
restaurant. Plaintiffs I receipt for their meals is attached
hereto as Exhibit "A".
6. Plaintiff Robert L. Valiton purchased a salad which
he prepared from ingredients at the salad bar ~It.ich, unknown to
him, contained small, hard, dark-colored foreign objects.
7. When Robert L. Valiton was eating his salad, he bit
onto a foreign object in the salad and immediately experienced
excruciating pain in his teeth, mouth and jaw.
s. Plaintiffs promptly reported the problem to Ken
Berry, manager of Defendants' restaurant who examined the foreign
objects but could not identify them or explain how they got into
the salad bar ingredients.
9. Manager Berry apologized to Plaintiffs and took the
foreign objects frcm their table.

COUNT I - NEGLIGENCE
ROBERT L. VALl TON VS. DEFENDANTS
10. Plaintiffs incorporate by referenoe paragraphe 1
through 9.
11. Robert L. Valiton' s injuries were caused by the
negligence and carelessness of Defendants in thatl
a. Defendants failed to pre pars the salad bar with
proper diligence and precautic~;
b. Defendants failed to properly inspect the
ingredients on the salad bar in order to insure the purity of the
oontents thersof;
c. Defendants allowed and permittsd foreign objeots of
unknown compositicn to be and exist in the ingredients on the
salad bar.
12. Solely as a result of Defendants' neqligence,
Robert L. Valiton suffered injuries to his mouth, teeth and gums
which caused him great physical pain and mental anguish and which
required root canal procedures to tooth H13 on February 25, 1994
and to tooth 814 on March 13, 1994.
13. The injuries to Robert L. Valiton's mouth, teeth
and gums are permanent. His teeth continue to be sensitive to
heat and cold and he is unable to chew on the left side of his

mouth, all of which may oontinue for an indefinite time in the
future.
14. By reason of his injuries, Robert L. Valiton has
been prevented from pursuing his daily aotivities and customary
duties and believes that he may be prevented from doing so in the
future.
15. By reason of his injuries, Robert L. Valiton has
besn unable to follow his usual employment, and will be unable to
follow the same for an indefinite time in the future, thereby
losinQ the income which would have oome to him through employment.
lG. Solely beaause of Defendants' conduct, Robsrt L.
Valiton has been obliged and probably will in the future be
obliQed to expend various sums of money for medicine and medical
and dsntal attention for treatment of his injuries.
17. pursuant to Pa.R.C.P. 1305, Plaintiffs intend to
offer the following documents in evidence, copies of which are
attaohed hereto as exhibits I
Exhibit "B" - Memorial Hospital of Bedford County
Bmergsncy Department Record dated February 19, 1994.
Exhibit "C" - Memorial Hospital of Bedford County
Itemized Bill in the amount of $119.00.
Exhibit "D" - Report of John P. Livengood, D.H.D. dated
February 3, 1995

March 6, 1995.
Exhibit "F" - statement cf John P. Livengood, D.M.D. in
the amount of $752.00.
Exhibit "G" - Six (6) Pharmacy Bills totalling $49.45.
WHEREFORE, Plaintiff Robert L. Valiton demands damages
from Dsfendants in an amount not in excess of the limits requiring
arbitration referral.
COUlIT II - STRICT LIABILITY
ROBERT L. VALITON vs. DEFENDANTS
lB. Plaintiffs inccrporate by reference paragraphs 1
through 9 and 12 through 17.
19. The salad ingredients sold by Defendants were
defeotive and unreasonably dangerous to the consumer public in
that they contained a foreign object or objects which posed a
serious threat of causing injury to their customers.
20. The salad ingredients sold by Defendants were in
the same condition at the time they were consumed by Robert L.
Valiton as they were when they left the control of Defendants in
that they were unsafe and unfit for consumption by member. of the
public.
21. The salad ingredisnts were used for their intended
purpose in that they were consumsd by Robert L. Valiton.

22. As a direct and proximate result of the consumption
of the salad, Robert L. Valiton was injured as above set forth.
23. Defendants are strictly liable for Robert L.
Valiton's injuries and damages which resulted from consumption of
the defective, dangerous and hazardous salad.
WHEREFORE, Plaintiff Robert L. Valiton demands damages
from Defendants in an amount not in excess of the limits requiring
arbitration referral.
~OUNT III - DANA M. VALITON vs. DEFENDANTS
LOSS OF CONSORTIUM
24. Plaintiff Dana M. Val1ton iMorporate/l by reference
paragraphs 1 through 23.
25. As a result of the injuries to her husband, Dana M,
Valiton has been and will continue to be deprived of her husband's
aid, comfort, services, society companionship and affection, all
to her great detriment and loes.
WHEREFORE, plaintiff Dana M. valiton demands damages
from Defendants in an amount not in excess of the limits requiring
arbitration referral.

Dear Sirsl
Patient Robert Valiton was seen in our office on 2-21-94 with
sensitivity and pain to maxillary left quadrant with possible
past history of tra\Jna. On examination teeth 113 and 114
were sensitive to percussion and palpation. A root cal\lll
was performed on tooth 113 (maxillary left second premolar)
on 2-25-94. Pain still persisted and on 3-14-94 a root cal\lll
was performed on tooth 114 (maxillary left first molar).
Restorations were performed on both teeth on 4-13-94.
Patient was seen recently on 1-30-95 cn fcllow-up. The patient
experienced slight sensitivity tc mastication cn tooth '13
but prognosis is favorable. If pain persists on tooth '13
for three to six months, an apiccectomy may be planned but
not anticipated.

5. On Saturday, February 19, 1994, at about 6130 p.~.,
1'1aintiffs were retail customers havinq dinner at Defendants'
re.taurant.
Plaintiffs' receipt for their meals 11 attached
hereto a. Exhibit "A".
6. plaintiff Robert L. Valiton purcha.ed a salad which
he prepared fro~ inqr~dients at the 8al~d bar which, unknown to
him, contained small, hard, dark-colored foreign objeot..
1. When Robert L. Valiton was eating his salad, he bit
I onto a foreign object in the salad and illllllediately experienced
, excruciating pain in his teeth, mouth and jaw.
8. plaintiUs promptly reported the problem to Ken
Berry, manaqer of Defendants' restaurant who examined the foreign
objeots but could not identify them or explain how they got into
the salad bar ingredients.
9. Manager Berry apologized to plaintiffs and took the

been unable to follow his usual employment, and will be unable to
follow the sAllIe for an indefinite time in the future, thereby
lo.inq the income which would have come to him through employment.
16. Solely because of Defendants' conduct, Robert L..

obliged to expend varicus sums of money for medicine and medical

the defective, dangerous and hazardous salad.

AND NOW, comes the Additional Defendants by and through their
attorneys, Griffith, Strickler, Lerman, Solymos & Calkins, and Lisa
M, DiBernardo, Esquire and files this Answer, New Matter and
Crossclaim, and states as follows I
1, Admitted upon information and belief.
2, Admitted in part; Denied in part, It is admitted that
Additional Defendant Parkway provision Company, Inc" t/d/b/a
Parkway Food Service, is a corporation that does business at 1115
Garden Street, Greensburg, Pennsylvania 15601.
It is denied,
however, that all of Additional Defendant Parkway'e business
ventures are conducted at the above location, and strict proof
thereof is demanded at the time of trial.

a belief as to the truth or veracity of the allegations contained

a belief as to the truth or veracity of the allegations contained
in paragraph 11 of aTe corporation's Complaint and the same are

Defendants are without knowledge or information sufficient to form
a belief as to the truth or veracity of the allegations contained
in paragraph 12 of aTe corporation's Complaint and the same are
denied and strict proof thereof is demanded at the time of trial.
13. Denied. The allegations raised in paragraph 13 state a
conclusion of law to which no response is required. To the extent
a responDe is deemed necessary, it is specifically denied that the
olive(s) in question were defective and unreasonably dangerous in
that they contained an object, and that as a result, Additional
Defendants are, therefore, strictly liable for the Plaintiff's
injuries and damages and strict proof there is demanded at the time
of trial.
14. Denied. It is specifically denied that Additional
Defendant IL e. Hunter Company, Inc. was negligent in that it I
a. Failed to properly inspect the olives prior to
bottling I
b. Failed to take proper precautions in processing the
olives to prevent foreign objects or olive pits to remain in the
product I and
c. Failed to warn of the presence of olive pi ts or
foreign objects in its product I
and, accordingly, strict proof there is demanded at the time
of trial.
15. Denied. The allegation raised in paragraph 15 states a
conclusion of law to which no response is required and strict proof
thereof is demanded at the time of trial. To the extent a response
is deemed necessary, it is specifically denied that Additional
Defendants have any liability for Plaintiff's alleged injuries and
strict proof thereof is demanded at the time of trial.
16. Denied. The allegation raised in paragraph 16 states a
conclusion of law to which no response is required and strict proof
there is demanded at the time of trial. To the extent a response
is deemed necessary, it is specifically denied that Additional
Defendants are solely liable to Plaintiffs, jointly liable to
Plaintiffs or liable over to Defendant aTe for contribution,
indemnification or both and strict proof thereof is demanded at the
time of trial.
WHEREFORE, Additional Defendants respectfully request that
this Honorable Court dismiss Additional Defendant's Complaint and
enter judgment in their favor.
NEW MATTER
17. Additional Defendants' responses to paragraphs 1 through
16 above are incorporated herein by reference as though set forth
in full.
lB. Plaintiff's injuries and damages, which are specifically
denied, were not caused by any acts, omissions or breaches of duty
of Additional Defendants, but were caused in whole or in part or
were contributed to by the negligence, fault, or want of care of
Plaintiff himself, or Defendant.
19. No defective or unreasonably dangerous salad ingredients
were sold, distributed, or packaged by Additional Defendants to the
consumer public.
20. Additional Defendants are not liable for Plaintiff 's
alleged injuries since they had no actual or constructive knowledge
that the product sold, distributed, or packaged contained olive
pits or portions of olive pits.
21. The conduct of Additional Defendants was not a
substantial factor in causing Plaintiff I s alleged injuries and
damages, if any.
22. Additional Defendants are not liable for Plaintiff's
alleged injuries and damages, since the object into which Plaintiff
allegedly bit was a natural part of the ingredients of the salad
bar, and not a foreign object.
23. If any defective or unreasonably dangerous salad
ingredients were sold or distributed by Additional Defendants,
which is specifically denied, Additional Defendants never received
notice, actual or constructive, of such condition existing at that
time or of Plaintiff's alleged injuries until the filing of
Plaintiffs' Complaint.
24. Defendant's Complaint fails to state a claim upon which
relief can be granted against Additional Defendants.
25. At all times relevant hereto, Additional Defendants sale
of food products to Defendant complied with the applicable
provisions of the Uniform Commercial Code.
26. Any and all olive products which may have been sold to
Defendant by Additional Defendants would pass without objection in
the trade.
27. Any and all olive products which may have been sold to
Defendant by Additional Defendants were of fair and average quality
within the description.
2B. Any and all olive products which may have been sold to
Defendant by Additional Defendants were fit for the ordinuy
purposes for which such products were to be used.
29. Any and all olive products which may have been sold to
Defendant by Additional Defendants were of even kind and quality
within and among each unit.
30. Any and all olive products which may have been sold to
Defendant by Additional Defendants were adequately contained and
packaged, as required.
31. The food product in question, if sold by Additional
Defendants, which is specifically denied, was in no way modified,
altered or changed by Additional Defendants.
32. Plaintiff I s injuries and damages, if any, were
foreseeable.
33. Plaintiffs I injuries and damages, if any, were caused
solely and directly as a result of the negligence of Defendant in
that Defendant I
a. Failed to use due care in inspecting food products
for eventual service to customers to ensure that the food product
did not contain foreign or inedihle matter likely to cause injury
during the process of human ingestionl
b. Failed to use due care in inspecting the food
product prior to eventual service to customers to ensure that it
did not contain dangerous and inedible matter which Plaintiff and
other subsequent consumers would not reasonably expect to find in
the food served/
c. Failed to properly supervise its employees so as to
ensure that the food products supplied were free from foreign or
inedible matter (natural or unnatural) likely to cause injury to
the Plaintiff and other subsequent consumers/
d. Failed to properly supervise its employees so as to
ensure that the food products supplied did not contain inedible
matter which the Plaintiff and other subsequent consumers would not
reasonably expect to find therein/
e. Knew or should have known that the ingestion by
Plaintiff and other subsequent consumers of foreign or inedible
matter mixed in with the food products supplied carried a high
probability of injury/
f. Failed to warn Additional Defendants, Plaintiff and
other subsequent consumers that the food product supplied contained
or was likely to contain inedible matter capable of causing injury/
g. Failed to exercise due care in inspecting, handling,
cleaning, supplying food and food products to Plaintiff and other
subsequent consumers;
h. Failed to utilize/employ a "policing" system
whereby its employees examined its food items, checking the
quality and nature of the food products offered to its customers
for consumption so as to ensure that no f.oreign (be it natural or
unnatJral) objects were present which could cause injury to the
Plaintiff and other coneumers during human ingestion/ and
i. Failed to Wal"n its consumers of the presence of
foreign inedible matter, natural or unnatural, likely to cause
injury to the Plaintiff and other subsequent consumers.
WHEREFORE, Additional Defendants demand judgment in its favor
and against Defendants on all claims as set forth in Defendants'
Complaint.

34. Additional Defendants I response to paragraph 1 through
33 above are incorporated herein by reference as though set forth
in full.
35. Liability on the part of Additional Defendant is
specifically denied. If the averments contained in Defendant I s
Complaint to Join Additional Defendants are established, said
averments being specifically denied, then the injuries and damages
complained of were caused solely or in part by Defendant aTB
Corporation.
36. In the event of a finding of liability against Additional
Defendants, which liability j s specifically denied, Additional
Defendants hereby assert their full rights to indemnification and
contribution against Defendant aTB Corporation on the basis that
Defendant aTB Corporation is liable over or jointly and severally
liable to the Plaintiffs on their cause of action.
37. Defendant aTB Corporation has been joined herein to
protect the rights of indemnity of Additional Defendants, and a
claim by Additional Defendants against Defendant for contribution/
indemnity is made hereby.
WHEREFORE, Additional Defendants respectfully demand judgment
in their favor and against Plaintiffs. In the event any award is
