COMES NOW, Petitioners, Wayde W. Wilson and sonya J. Wilson,
by and through their attorney, R. Mark Thomas, Esquire, and
respectfully represents as followsl
1. Petitioners are adult individuals, husband and wife, who
curre~tly reside at 52 Persian Lilac Drive, Etters, Pennsylvania,
17319.
2. Respondent is the Departmsnt of Transportation of the
commonwealth of Pennsylvania.
3. Peti tioners are the owners of two motor vehicles, each of
which is registered in accordance with the laws of the Commonwealth
of Pennsylvania. One of these vehicles is a Jeep station wagon
with a registration number of PDT200, and the other is a chevrolet
sedan with a registration number of XCX892.
4. At all times, Pet! Honers have kept both vehicles insured
through the Allstate Insurance company which is an approved
automobile insurance company under the laws of Pennsylvania.
5. On or about December 22, 1995, Petitioners received two
letters from the Respondent, advising them that the vehicle
registration privilege for each of the above vehicles was being
suspended for three months as authorized under 11786 (0) of the
Vehiole Code.

Petitioners from Respondent are attached hereto and marked
Petitioners' Exhibits "Al" and "A2".
6. Petitioners deny that their automobile insurance coverage
through Allstate was ever terminated, or if it was terminated, it
was terminated due to a mistake on the part of someone other than
the Petitioners.
7. Petitioners at all times made payment on the premiums of
their automobile insurance coverage in a timely fashion.
8. Neither of the Petitioners engaged in any conduct which
would have caused the insurance company to lawfully terminate the
vehicle registration.
9. Petitioners do not understand or know what caused the
lapse in insurance coverage, if any, and therefore, the actions of
the Respondent under these circumstancss are without warrant and
unjust.

AND NOW, comes the Petitioners, Wayde W. Wilson and sonya J.
wilson, by and through their attorney, R. Mark Thomas, Esquire, and
they file this Petition to withdraw Appeal and in support thereof
respectfully represent I
1. On or about December 27, 1995, the Petitioners filed a
Petition for Appeal from the Department of Transportation decision
to suspend Petitioners' vehiole registration privilege.
2. A hearing was scheduled to be held on February 21, 1996
in Courtroom 1, at the cumberland county courthouse, carlisle,
pennsylvania. The Department of Transportation was represented by
George Kabusk, Esquire, of the Office of Legal counsel with the
Pennsylvania Department of Transportation.
3. After hav ing prov ided counsel for the Department of
Transportation with documentation concerning the lapse of insurance
coverage in this matter, the Department of Transportation agreed
that they would unilaterally discontinue the proposed suspension of
the Petitioners' registration.
4. Based on that authorization as provided to me by counsel
for the Department of Transportation, the Petitioners are hereby

withdrawing their appeal.
WHEREFORE, Petitioners pray this Honorable court will mark
this matter as closed and at end and the appeal withdrawn.
