permanent order.

The mother of the child is Tammy S. Gutshall, currently
residing at 33 Chestnut Street, Newville, Pennsylvania, 17241.
She is single.
The father of the child is Gary L. "ess, currently residing
at 1812 Jumper Street, Cayce, South Carolina, 29033.
"e is single.
4. The relationship of Plaintiff to the child is that of natural
mother.
The Plaintiff currently resides with no other persons.
6. The relationship of Defendant to the children is that of
natural father.
Plaintiff does not know whether Defendant currently resides
with any other persons.
6. Plaintiff has not participated as a party or witness, or in
another capacity, in other litigation concerning the custody of
the child in this or another court.
Plaintiff does not have information of a custody proceeding
concerning the child pending in a court of this Commonwealth.
Plaintiff is not aware of a person not a party to the
proceedings who hus physical custody of the child and claims to
have custody or visitation rights with respect to the child.
7. The best interest and permanent welfare of the child will be
served by granting the relief request becausel
a. Plaintiff Is better ab10 to care for the physical,
emotional, educational and medical needs of the
child;
b, Defendant has not seen the child since birth;
furthermore, he has not contacted Plaintiff to make
inquiry about hiH Hon since birth; and
c. To the best knowledge of Plaintiff, Defendant remains
employed as a truck driver and Is away from home on a
frequent basis and for long periods of time.
8. Each parl'nt who parental rights to the child have not been
terminated and the person who has physical custody of the
child has been named as parties to this action.
WHEREFORE, Plaintiff requests the Court to grant primary legal
and physical custody of the child to her, subject to reasonable
visitation rights for Defendant.

19l5.3-8(b), the undersigned Custody Conciliator submits the
following reportl
1. The pertinent information pertaining to the child who is
the subject of this litigation is as followel
Tyler J. Gutshall, born June 5, 1995.
2. A conciliation Conference was held on January 26, 1996, with
the following individuals in attendance I
The Mother, Tammy S. Gutshall, with her counsel Richard L.
Webber, Jr., Bsquire. The Father was served with notice of a
hearing and did phone Attorney Webber and acknowledge that he
was aware of the hearing. However, the Father was in South
Carolina and he did not attend the hearing. Mother has
instituted a support action against the Father, and Father is
contesting paternity.
3. The Conciliator recommends an Order in the form as attached.
