Authority at a public meoting held on Decembor 2", 1995, at the

the Authority's office, a copy of said Resolution being attached
hereto marked "Exhibit I" and incorporated herein by reference

The purpose of this condemnation and this Declaration of
Taking filed incidental thereto is to acquire and secure a parcel
of land in fee simple and certain easements and rights-of-way,
both temporary and permanent, in lands for the construction,
installation, operation, maintenance, repair, renewal and
replacement of a sanitary sewerage system by said Authority,

Attached hereto marked "Exhibit 2" and incorporated herein
is documentation which contains the several descriptions of the
lands, easements and rights-of-way situate in the Township of
silver Spring, Cumberland County, Pennsylvania, necessary to be
obtained for the purposes, as aforesaid, A copy of said
documentation mentioned in said Exhibit 2 will be filed as of the
date of filing hereof in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania, at the Cumberland County
Court House in carlisle, Pennsylvania, in accordance with section
404 of the Eminent Domain Code, Act of June 22, 1964 (Special
session), P,L, 84, Article IV, as amended,

rights-of-way acquired hereby are for the purpose of laying,
constructing, installing, operating, maintaining, repairing,
renewing, enlarging and replacing the aforementioned sanitary
sewerage distribution pipe line and system, and a parcel of land
in fee simple for the construction and maintenance of a sewage
pumping station all as more fully set forth in section 1 of said
Resolution ("Exhibit 1") which said Section is specifically
incorporated herein by reference thereto,

The names of the Condemnees herein are more fully set forth
in "Exhibit 2" attached hereto and incorporated herein by
reference thereto as though fully written herein,

The above named Condemnees are in each case the owners in
fee simple of the lands or interests therein being taken,
appropriated and condemned,

A RESOLUTION
OF THE SILVER SPRING TOWNSHIP AUTHORITY
AUTHORIZING THE SELECTION, CONDEMNATION AND
APPROPRIATION OF CERTAIN INTERESTS IN CERTAIN
LANDS SITUATED IN THE TOWNSHIP OF SILVER
SPRING, CUMBERLAND COUNTY, PENNSYLVANIA, FOR
THE CONSTRUCTION, INSTALLATION, OPERATION,
MAINTENANCE, REPAIR AND REPLACEMENT OF A
SANITARY SEWERAGE SYSTEM, AND AUTHORIZING THE
FILING OF A DECLARATION OR DECLARATIONS OF
TAKING AND ALL NECESSARY ACTION FOR THE
ACQUISITION THEREOF
WHEREAS, SILVER SPRING TOWNSHIP AUTHORITY (hereinafter
called "Authority") has proposed the construction of a sanitary
sewerage system in silver spring TownShip, cumberland County,
pennsylvania (hereinafter called "Township"); and
WHEREAS, it is necessary that the Authority acquires and
secures certain easements and rightS-Of-way in, over, across,
under and through various lands in said Township, cumberland
county, pennsylvania, for the purpose of presently constructing,
installing, operating, maintaining, repairing and ultimately
replacing said sanitary sewerage system; and
WHEREAS, said Authority has developed a plan or plans of
necessary lands, easements and rightS-Of-way which will
accommodate said sanitary sewerage system, portions of which plan
or plans is/are embodied in certain documentation as made by
Hartman & Associates, Inc" (Engineers), which is marked "Exhibit
A" filed with this Resolution and incorporated herein by
reference thereto; and

WHEREAS, the Authority has been unsuccessful in negotiating
the acquisition of certain easements and rights-or-way from the
owner or owners of the land to be affected thereby; and
WHEREAS, in accordance with section 11 of the Municipality
Authorities Act of 1945, Act of May 2, 1945, P,L, 382, as amended
(53 p,S, 314), the Authority is authorized to acquire and secure
such titles, easements, rights-of-way and other interests in and
to the said lands through eminent domain proceedings;
NOW, THEREFORE, on motion duly made, seconded and passed by
this Authority, be and it is hereby
RESOLVED:
SECTION 1: This Authority hereby selects, condemns and
appropriates those premises set forth in the documentation
("Exhibit A") attached hereto and incorporated herein by
reference thereto, which indicates the lands selected, condemned
and appropriated and the names of the owners of the property
interests condemned as reasonably known to the Authority,
The nature and extent of the titles, easements, rights-of-
way to be acquired under this section 1 are as follows: (a)
permanent easements and free, uninterrupted and unobstructed
rights-of-way in, over, across, upon, under and through the
several premises shown and designated on the aforementioned
Plans, respectively, for the purposes of presently and
perpetually thereafter, laying, installing, constructing,
operating, maintaining, repairing, renewing, enlarging and

replacing a sanitary sewerage collection pipe line, lines and
system and its manholes, valves, accessories and appurtenances
(together with any designated temporary construction easement and
right-of-way to be used in the initial construction of such
lines, etc,), together with all rights of ingress, egress and
regress in, to, over, upon, through, along and from said premises
and lands necessary or convenient for the full and complete use
by the Authority, its successors and assigns, of the said
easement, easements, right-of-way and rightS-Of-way and for the
exercise of said rights and privileges to lay, install,
construct, operate, maintain, repair, renew, enlarge and replace
said sanitary sewerage collection pipe line or lines, and the
manholes, valves, accessories and appurtenances thereto,
including but without limiting the foregoing, the right, power
and privilege to have its officers, agents, employees and/or
contractors go in, over, across, upon, under, through, along and
from said premises and lands to do and perform with or without
maChinery and equipment, any and all acts necessary or convenient
to carry into effect the purposes recited above, to keep the
surface and subsurface of said easement and right-Of-way cleared
of all timber, trees, roots, brush and other obstructions and to
install and maintain gates and/or stiles in any fences crossing
the said easements and rightS-Of-way, and (b) a parcel of land in
fee simple for the construction and maintenance of a sewage
pumping station (see Exhibit A, item 11,A,),

SECTION 2: The Authority and its proper officers are hereby
authorized to file such Declarations of Taking and such other
papers, documents and/or proceedings, including the entry of such
bond as may be necessary or desirable, and to do and perform all
other acts necessary and requisite to carry out the purposes of
this Resolution, and said officers and the Authority's employees
or agents are authorized and empowered to enter upon the lands to
be taken, condemned and appropriated in order to make studies,
surveys, tests, soundings and appraisals,
SECTION 3: The institution of such proceedings, including
the entry of such bond as may be necessary or desirable, and any
damages which may be awarded to the owner or owners of the
premises or lands shall be paid from such funds which may become
available and from time to time appropriated by the Authority for
such purposes,
DULY ADOPTED this 27th day of December, 1995, by the Board
of the Authority in lawful session duly assembled,

KNOW ALL MEN BY THESE PRESENTS, that the SILVER SPRING
'I'OWNSHIP AUTHORITY, a municipality authority organized and
existing under the laws of the Commonwealth of Pennsylvania,
hereinafter called "obligor", is held and firmly bound unto the
COMMONWEALTH OF PEllNSYLV/,NIA, hereinafter called "obligee", for
the use and benefit of the owners of the property or property
interests condemned as hereinafter noted, and other proper
parties in interest, for such amount of damages as the said
owners of the said property or property interests and other
parties in interest shall be entitled to receive after the same
shall have been agreed upon or assessed in ths manner prescribed
by law, by reason of the condemnation by the SILVER SPRING
TOWNSHIP AUTHORITY of certain fee simple land, and easements and
rights-of-way in lands and property interests located in the
Township of Silver spring, Cumberland County, Pennsylvania, more
fully shown and described in "Exhibit A" attached hereto and
attached to the Declaration of Taking of which this Bond is a

thereto.
SEALED with the official corporate Authority seal and duly

WHEREAS, the SILVER SPRING TOWNSHIP AUTHORITY has condemned
the aforementioned property interests and cannot agree with the
owners thereof upon the just compensation to be paid for the
damages sustained by the owners of the property interests as a
result of the condemnation;
NOW, THE CONDITION of this Bond is such that if the SILVER
SPRING TOWNSHIP AUTHORITY, the obligor herein, shall payor cause
to be paid such amount of damages as the said ownera of the
property interests so condemned and the other parties in interest
shall be entitled to receive by reason of such condemnation,
after the same shall have been agreed upon or assessed in the
manner provided by law, then this obligation shall be void;
otherwise, it shall be and remain in full force and effect,

STIPULATION AMENDING SUBJECT MATTER
OF TAKING RE LANDS OF DAVID T. PIPHER
amendment has no effect thereon.
1. On December 28, 1995, SILVER SPRING TOWNSHIP AUTHORITY,
hereinafter called "Authority" filed a Declaration of Taking in
the above captioned action, in which it took certain real estate
interests of DAVID T. PIPHER, hereinafter called "Pipher", said
real estate being located in Silver spring TownShip, Cumberland
County, Pennsylvania.
2. Said real estate interests are more specifically
documented in said Declaration of Taking as property/owner number
11 consisting of three locations and/or interests identified
therein as 11.A, 11.B and 11.C. The locations/interests
contained in 11.B and 11.C remain unchanged, and this stipulated

taking of fee simple title to a generally flag-shaped parcel of
land containing 0,2577 of an acre of unimproved land located at
the northern end of Holly Lane (T-554) as more fully shown on the
map or plan marked "Drawing ll-A" dated Oct. 20, 1995, and
further identified as Parcel 10, construction Sht, No(s). 12,
File No. 95205, attached hereto marked "Exhibit A", for the
purpose of constructing and maintaining a sewage pumping station.
4. Authority and pipher have agreed to relocate the site
for the construction and maintenance of the sewage pumping
station mentioned in paragraph 3 above to a location more fully
shown and described on the map or plan marked "Revised Drawing
ll-A" dated January 24, 1996, revised March 12, 1996, entitled
"Holly Lane Pump station", attached hereto marked "Exhibit B",
said revised site consisting of two parts: (a) the specific area
for the pumping station containing 0.1980 of an acre of land to
be acquired in fee simple, and (b) an access easement over 0.1411
of an acre of land, both being shown and described on "Exhibit B".
5. The parties agree that the lands and interests indicated
in paragraph 4 above and "Exhibit B" shall be substituted for
those contained in paragraph 3 and "Exhibit A". To effect this
substitution, the parties further agree (a) that this stipulation
shall be filed in this action in the Office of the prothonotary
and shall have the effect of amending the Declaration of Taking
heretofore filed, and (b) that a counterpart of this stipulation
shall be recorded in the Office of the Recorder of Deeds in and
for cumberland county, Pennsylvania, to amend the Notice of
Filing of Declaration of Taking as recorded on December 28, 1995,

in Deed Book 133, Page 204, by deleting from the latter those
provisions relating to location/interest 11.A (see paragraph 3
hereinabove) and substituting therefor the provisions contained
in paragraph 4 above and as shown and described in "Exhibit B"
attached hereto. To Gffect the foregoing:
Authority shall be indexed as "grantor" and pipher
shall be indexed as "grantee" with regard to the
deletion of the original location/interest
mentioned in 11.A, and this agreement shall act as
a conveyance of the land described in "Exhibit A"
from Authority to pipher in order to restore full
ownership therein in pipher.

attached hereto.
6. Except for the substitution of locations/interests as
set forth hereinabove, all other provisions concerning the
procedures of taking and resolution of just compensation remain

7. Pipher acknowledged and agrees that the Authority'S
taking now involves tlae revised 11.A as shown on "EXhibit B" and
that Authority has exercised its right of eminent domain with
regard to said revised 1l.A and the land described in "Exhibit
B".
8. Authority acknowledges and agrees that pipher has full

right to seek just compensation for the taking of the interests
indicated hereinaboVs with regard to revised 11.A as shown and
described in "Exhibit B".
9. pipher acknowledges and agrees that he has no right to
just compensation for the land described in original 11.A and
described in "Exhibit A", said land having been relinquished by
Authority back to pipher.
10. pipher hereby grants to Authority right of entry and
possession of the lands described in "Exhibit B".
IN WITNESS WHEREOF, the parties have caused these presents
to be duly executed this I~ day of March, 1996, intending
thereby to legally bind themselves and their respective heirs,
personal representatives, successors and assigns.

DECLARATION OF RELINOUISHMENT
AND NOW, comes SILVER SPRING TOWNSHIP AUTHORITY, hereinafter
called "Condemnor", and files and records this Declaration of
Relinquishment with regard to lands owned by HIRAM c. LEREW and
LILLIAN M, LEREW, husband and wife, hereinafter called
"Condemnees", based upon the following averments:
BACKGROUND
Condemnor was and continues to be the owner and operator of
various municipal sanitary sewerage facilities in the Township of
Silver spring, Cumberland County, Pennsylvania, which it is
presently expanding and extending generally in the area of
Hogestown Road (S.R. 0114) south of Carlisle Pike and inclUding
Woode Drive (T-S8S) east of Hogestown Road. In its original
design, Condemnor intended to inetall sewer facilities along the
eastern side of condemnees' land extending from Woods Drive on
the north to lands now or formerly of David Pipher on the south,

for whloh a 20 feet wide permanent easement with certain
temporary construction rights would be required. Condemnees'
lands are known as 185 Woods Drive,
In exercise of its power of eminent domain, Authority took
action on December 27, 1995, by Resolution to acquire the
neoossary easemont and right-Of-way rights in and through
Condomnoes' land, the precise dimensions of which are contained
on Drawing 14 in "Exhibit A" to said Reeolution. Based upon the
authority of said Resolution and in compliance with the
Pennsylvania Eminent Domain Code (26 P.S. SI-101 et seq.), the
Authority took the easements and rights-of-way (temporary and
permanent) by Declaration of Taking filed on December 28, 1995,
in the above captioned action, and recorded notice thereof in the
Offico of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, on December 28, 1995, in Deed Book 133, Page 204.
Notice of said action was given to Condemnees by certified mail
received by them on December 29, 1995. No preliminary objections
or other pleadings were filed by Condemnees.
Because of engineering design changes, the Authority has
determined that it does not need the easements/righte-of-way in
ond through condemnees' land, and, therefore, relinquishes all of
its interests in Condemnees' lands based upon the following
declaration and in accordance with Section 408 of the Eminent
Domain Code (26 P.S. S 1-408).

WHEREAS, Silver spring Township Authority (hereinafter
called "Authority") is in the process of expanding its sanitary
sewage collection system in the TownShip of silver spring,
cumberland county, Pennsylvania, for which it requires certain
easements and rightS-Of-way in, over, on and thrcugh certain
lands owned by Herl R. Prutzman, widower, hereinafter called
"condemnee"; and
WHEREAS, by Declaration of Taking filed on December 28,
1995, in the above captioned action, Authority exercised its
power of eminent domain to acquire easements and rightS-Of-way
with respect to several properties, inclUding the property of
Condemnee; and
WHEREAS, subsequent to the commencement of said eminent
domain action, Authority and Condemnee arrived at a mutual
settlement of said taking, inclUding the waiver and release of
compensation or damages to Condemnee, which understanding they
desire to document by these presents I

the sum of One ($1.00) Dollar in hand paid by Authority to
Condemnee, receipt of which is hereby acknowledged by Condemnee,

intending to be legally bound hereby, Condemnee hereby waives and
forever relsases Authority, its successors and assigns, of and
trom any and all further damaqes, claims, compensation or other
consideration for the taking of the easement and right-of-way in,
over, on and through Condemnee's land as more fully defined and
limited in the Declaration of Taking filed herein, and Condemnee,
hereby gives and grants right of entry to Authority, its
contractors, agents or assigns, to enter upon his property tor
the purposes set forth in said Declaration of Taking.

WHEREAS, Silver spring Township Authority (hereinaiter,!

called "Authority") is in the process of expanding its sanitary
JUST COMPENSATION SETTLEMENT RELEASE
sewage collection system in the Township of Silver spring,
Cumberland county, pennsylvania, for which it requires certain
easements and rights-of-way in, over, on and through certain
lands owned by Mary E. Myers, widow, hereinafter called
"Condsmnee"/ and
WHEREAS, by Declaration of Taking filed on December 28,
1995, in the above captioned action, Authority exercised its
power of eminent domain to acquire easements and rightS-Of-way
with respect to several properties, including the property of
Condemnee/ and
WHEREAS, subsequent to the commencement of said eminent
domain action, Authority and condemnee arrived at a mutual
settlement of said taking, including the waiver and release of
compensation or damages to condemnee, which understanding they
desire to document by these presents;

NOW, THEREFORE, in consideration of these presents and of
the sum of One ($1.00) Dollar in hand paid by Authority to
Condemnee, receipt of which is hereby acknowledged by Condemnee,
and further in consideration of the benefits of municipal
sswerage bscoming available to Condemnee's property, and
intending to be legally bound hereby, Condemnee hereby waives and
forever releases Authority, its successors and assigns, of and
from any and all further damages, claims, compensation or other
consideration for the taking of the easement and right-Of-way in,
over, on and through Condemnee's land as more fully defined and
limited in the Declaration of Taking filed herein, and Condemnee,
hereby gives and grants right of entry to Authority, its
contractors, agents or assigns, to enter upon her property for
the purposes set forth in said Declaration of Taking,
