One (1) year after date CUMBERLAND GOLF CLUB, iNC., a corporation,
("MAKER"), promIses to pay to the order of LLOYD J. MARKLE and RUTH N. MARKLE, his
wife, ("HOLDER") the sum of Fifty Thousand ($50,000,00) Dollars, without offset, on or before
the first day of October. 1996, with Interest on said sum at the rate of eight (8%) percent per
annum, Maker shall pay interest on this loan quarterly, the first payment to be due ninety (90)
days from the date of execution of this Note, and on Octobar 1, 1996, On non-payment when
due, if this Note Is placed in the hands of an attornay for collection, Maker agrees to pay as a
reasonable attorney's fee ten (10%) percent of the amount due and owing on this Note. Maker
shall have the right to prepay this Note in whole at any time or in part from time to time without
penalty or premium, provided, that any such partial prepayments shall be applied by the holder
as follows: first to accrued and unpaid Interest and second to the reduction of principal
installments In order of maturity, To secure payment of this Note, Maker hereby authorizes,
irrevocably, the Prothonotary, Clerk of Court, or any Attorney of any Court of Racord to appear
for it In such Court, at any time before or after maturity and confess a Judgment against it In
favor of any holder of this Note with or without the filing of an Averment of Default, with release
of errors, without stay of execution, and for such amount as may appear to be unpaid thereon,
together with charges, attorney's fees and costs as herein provided, and Maker hereby waives
and releases all benefit and relief from any and all appraisement, stay, or exemption laws of any
State, now In force or hereafter to be passed.
