COMPLAINT
AND NOW, comes the Plaintiff, An stadt printing corporation,
by its attorneys/ Blakey, Yost/ Bupp & Schaumann, and files its
complaint, the following of which is a statement:
1. The Plaintiff is An stadt Printing corporation, a
pennsylvania corporation with a mailing address of P.O. Box 1626/
York, Pennsylvania 17405-1626.
2. The Defendant is Atlis Graphics & Design, Inc./ and is
believed to be a Pennsylvania corporation with offices located at
5040 Louise Drive, suite 105/ Mechanicsburg, Cumberland county,
Pennsylvania 17055.
3. By its own Purchase Order No. 1710-3299 dated July 27/
1995/ the Defendant contracted with the Plaintiff whereby the
Plaintiff would produce and print a brochure-type publication
known as the "James Lee Burke" job for the Defendant. A true and
correct copy of the Purchase Order is attached hereto as Exhibit
A and incorporated herein by reference.
4. The agreed upon price for the work totalled $5/341.09/
plus shipping.
5. On August 2, 1995, Defendant agreed to accept the work
performed by plaintiff, with certain corrections and changes
noted on a "proof" submitted to Defendant by plaintiff. A true
and correct copy of the Proof is attached hereto ae Exhibit Band
incorporated herein by referenco.
7. On or about August 25, 1995, the plaintiff shipped
12,100 c~pies of the finished product to Defendant, and Defendant
accepted said copies upon delivery without exception or
complaint.
8. The total price for the work performed by the plaintiff,
including the corrections and changes accepted by Defendant, as
well as shipping charges, was $6,263.48 as stated on an invoice
submitted to Defendant by plaintiff on september 6, 1995. A true
and correct copy of the invoice is attached hereto as Exhibit C
and incorporated herein by reference.
9. Payment under the invoice was due 1n full within thirty
days.
10. To date, Defendant has failed and/or refused to make
any payments on account of the invoiced amount for the James Lee
Burke job.
11. The invoice pr~vides that a service charge shall accrue
on all unpaid balances at the rate of 1.5\ per month until paid
in full.
12. As of the date of this complaint, Defendant owes
Plaintiff a total of $6,263.48 plus accrued service charges in
the amount of $187.90.
WHEREFORE, Plaintiff demands judgment against the Defendant,
Atlis Graphics' Design, Inc., in the amount of $6,451.38, plus
any additional service charges that accrue under the invoice
terms until the date of jUdgment, plus costs of suit.
