MOTION TO CONSOLIDATE
AND REQUEST FOR SPECIAL CONCILIATION
AND NOW, comes the Plaintiffs, Mechanicsburg Oven, Inc.;
Capital Ovens, Inc., successor in interest to Mechanicsburg Oven,
Inc., and Victor P. Smith, Jr., d/b/a Smith Management Group, by
and through their attorneys, Jones, Gregg, Creehan & Gerace, LLP,
and files this Motion to Consolidate and Request for Special
Conciliation, averring in support thereof the following:
1. Plaintiffs, Mechanicsburg, Oven, Inc., Capital Oven,
Inc., successor in interest to Mechanicsburg Oven, Inc., and Victor
P. Smith, d/b/a Smith Management Group (hereinafter "Mechanicsburg,
et al."), believes and therefore avers that the various actions set
forth above arise directly from a single occurrence, the collapse
of a roof on or about January 21, 1994, at the Windsor Park
Shopping Center, located at 5216-5258 East Simpson Ferry Road,
Mechanicsburg, Pennsylvania 17055.

2. As a result of the aforesaid roof coll.1pl.lo,
Mechanicsburg, et al., who owned and operated .1 franchise
restaurant known as the "Italian Oven of Mechanicsburg" as well as
the numerous other tenants with places of business in the Windsor
Park Shopping Center, have sustained significant real and personal
property damage, lengthy interruption of business and extensive
loss of income and profit.
3. The aforesaid roof collapse and resultant damages
have engendered the above actions by Mechanicsburg, et al. and the
other Windsor Park tenants. The above actions have been filed in
both Cumberland and Philadelphia Counties.
4. A substantial number of the same parties are
Defendants or Additional Defendants in the above actions.
5. By this party's best estimate, the above actions
involve approximately fifty (50) parties and their respective
attorneys.
6. In light of the multitude of parties, the various
above actions will necessarily involve countless pleadings, cross-
claims, numerous Interrogatories and other discovery, numerous
depositions, and a potential number of proeedural and substantive
motions, all of which will require literally thousands of hours of
attorney time, judicial resources and enormous costs and expenses
to all the parties involved.
7, In order to avoid duplication of discovery and
trial, as well as to eliminate the unnecessary costs, delay and
expenses which will incur from separate proceedings, Mechanicsburg,

et al., requests that the above actions be consolidated [or
purposes of discovery and trial.
B. Moreover, before all parties before the court expend
valuable judicial resources, costs and expenses, the Plaintiffs,
Mechanicsburg, et al., believe that the scheduling of an early
conciliation hearing for all counsel for the purpose of simplifying
and expediting the filing of pleadings, the exchange of written
discovery, the scheduling of deposition guidelines, and the
exploring of possible settlement procedures would advance the
interests of all parties as well as promote the interest of
judicial economy.
WHEREFORE, Plaintiffs, Mechanicsburg Oven, Inc.; capital
Ovens, Inc., Victor P. Smith, d/b/a Smith Management Group, request
an appropriate Order directing consolidation of the following
actions:
