COMPLAINT TO OUIET TITLE
Plaintiff, by and through their counsel, Reager & Adler, PC,
hereby institute an action to quiet title pursuant to Pennsylvania
Rule of Civil Procedure 1061 et sea., and in support thereof assert
as follows:
1. Al-Don Properties is a Pennsylvania general partnership
with an office at 660 Edgegrove Road, Hanover, Adams County,
Pennsylvania (hereinafter referred to as "Plaintiff").
2. Consolidated Rail Corporation is a corporation with an
office at 2605 Interstate Drive, Suite 365, Harrisburg, Dauphin
County, Pennsylvania (hereinafter refet'red to as "Defendant").
3. Plaintiff is the owner of certain property located in
Cumberland County (hereinafter "premises") pursuant to a Quit Claim
Deed by American National Can Company, the Grantor therein, dated
December 1, 1995, recorded in the Cumberland County Recorder of
Deeds Office at Deed Book 132, Page 320, a copy of the legal
description to said Premises is attached hereto as Exhibit "A",
4. The Premises was originally conveyed by American National
Can Company, successor in title to American Can Company, to

Defendant, successor in title to Reading company, pursuant to a
Deed dated November 10, 1952, recorded in the Cumberland county
Recorder of Deeds Office at Deed Book 15, Volume E, Page 387 which
is attached hereto as Exhibit "B".
5 . The use of the premises and the tracks which were
previously situated thereon was for a railroad car offset storage
site by Defendant.
6. The main roadbed from which access to the premises is
gained is not affected.
7. The following limitation appeared in the Habendum section
of the Deed to the Premises referenced in Paragraph 4 above:
[Ulpon the following condition, to wit; that said plot of
land shall be used by the party of the second part for
the construction and operation of railroad tracts and
related facilities, and this conveyance is made upon the
express condition that if the said plot of land shall
ever cease to be used by the party of the second part for
the aforesaid railroad purposes, then the said plot of
land shall revert to the party of the first part as if
this conveyance had not been made.
8. In 1986 Defendant ceased construction, operation and use
of the railroad tracks and related facilities lying in the
Premises.
9. In 1987 Defendant removed the storage tracks and switch
for the main railroad line used by Defendant and situated on the
Premises.
10. Defendant has ceased to use the Premises for railroad
purposes.

11. Defendant's actions set forth in Paragraphs 8, 9 and 10
above constitute and work a reversion of the Premises unto the
Grantor therein or its successors in interest, Plaintiff.
12. As the Premises is not nor has it ever been a roadbed
right-of-way, the notification requirement under 66 Pa.C.B.A. 52709
regarding the disposition of real property previously used as a
railroad right-of-way is not applicable.
13. As the Premises is not nor has it ever been a railroad
right-of-way, there will b~ no interference with the purpose of 16
U.S.C.A. 51247(d) of the National Trails System Act regarding the
abandonment and discontinuance of railroad right-of-ways and the
use of such railroad right-of-ways as recreational tr~ils.
WBIRIPORI, Plaintiff prays your Honorable Court for relief as
follows:
(a) JUdicial determination that the Plaintiff, AI-Don
Properties, a general partnership, has fee simple title in and to
and is the legal owner of the Premises that is the subject matter
of this proceeding described in Paragraph 3 above;
(b) A final decree and order forever barring Defendant, its
successors and assigns, from asserting any right, lien, title or
interest in the Premises described in Paragraph 3 above
inconsistent with the title, interest and claim of the Plaintiff as
set forth in this Complaint;
