COMPLAINT
COMES, the Plaintiff, Hopewell Township Board of Supervisors, by and through
their Solicitor, Sally J. Winder, Esquire, and does file the following Complaint in
response to the Rule to File a Complaint issued in conjunction with the Appeal from
District Justice Judgment entered in this matter.
1. The Plaintiff is a duly organized and existing Second Class Township
acting through the authority of its Board of Supervisors in enforcing duly adopted
Ordinances of the Township, with a principal office at 415 Three Square Hollow Road,
Newburg, Cumberland County, Pennsylvania 17240.
2. The Defendants are Rodney L. Yentzer, Carol M. Yentzer, Rodney L.
Yentzer, II, and Jeffrey A. Yentzer, sui juris adult individuals having an address of 1146
South Pitt Street, Carlisle, Cumberland County, Pennsylvania, and Doublin Gap
Motocross, Inc., having an address of 100 Reasner Lane, Newburg, Hopewell Township,
Cumberland County, Pennsylvania 17240.
3. It is believed and therefore averred that all of the individually named
Defendants are trading and doing business as Doublin Gap Motocross, Inc. although there
exists no fictitious name or corporate registration with the Pennsylvania Department of
State, Corporations Bureau for Doublin Gap Motocross, Inc.
4. On or about June 29, 2002, the Defendants, Rodney L. Yentzer, Carol M.
Yentzer, Rodney L. Yentzer, II, and Jeffrey A. Yentzer, individually and trading and
doing business as Doublin Gap Motocross, Inc., did knowingly, intentionally, and with no
regard for the existence or requirements of the Township, violate Hopewell Township
Ordinance No. 79-2, hereafter referred to as "the Public Gathering Ordinance", a duly
enacted and existing ordinance of the Township, a copy of which is marked Exhibit "A"
attached hereto and incorporated herein by reference thereto.
5. Defendants both individually and trading and doing business as Doublin
Gap Motocross did violate the Public Gathering Ordinance by holding, managing, and
conducting without a permit, a Motocross racing event which did occur June 29, 2002, at
100 Reasner Lane, Hopewell Township, Newburg, Cumberland County, Pennsylvania,
where the number of persons was greater than 750 as designated in the ordinance and
where there were people on the premises after 1:00 o'clock a.m. and before 6:00 o'clock
a.m. camping at the premises in the vicinity of the racetrack all of which is in violation of
the Public Gathering Ordinance.
6. Defendants both individually and trading and doing business as Doublin
Gap Motocross were aware of the requirements of the Public Gathering Ordinance as they
had previously paid civil penalties for violating the Public Gathering Ordinance and had
previously made application for and obtained a Public Gathering Pe,t~-tit.
7. Defendants individually and trading and doing business as Doublin Gap
Motocross conduct, manage, and operate a published series of American Motorcycle
Association sanctioned races for various age and skill levels of riders and do advertise via
the intemet attracting racers and their families from surrounding States and ail across
Pennsylvania.
8. The Defendants did advertise, conduct, and manage such an evem listed as
June 28- Motocross Practice from 4:00 to 6:00 PM, June 29 and 30-Yamaha All Star
Amateur National, District 6 and 7, District 6 Points Series Event, Sponsored by
Silkolene, Answer, Renthal, Scott, Boyesen, Yamaha Motor Corporation, Factory.

excess of 750 people.
9. Further, Defendants do advertise on the internet and by other means that
over night camping and parking is available at the Motocross grounds. Defendants posted
signs stating "No campfires", thus creating the inference and expectation by attendees and
racers that they are welcome to camp overnight and are free to stay on the grounds as
guests and invitees of the motocross when events are scheduled for multiple days.
10. Defendants further list on the schedule of events made public by posting
and by hand delivery that events are considered to be all day and include overnight
accommodations by listing "sign-in: 8:00 to 10:30 AM" and "Overnight Camping- No
Charge" as evidenced by the flyers a copy of which is marked Exhibit "B" attached hereto
and incorporated herein by ference.
11. As a result of such advertising, and with full knowledge and intention to
do so, Defendants did encourage and allow guests, invitees, racers and their families as
well as observers, to stay at the Motocross grounds overnight June 28, 2002, into the early
morning hours of June 29, 2002, having not first applied for or obtained a Public
Gathering Permit.
12. Defendants did apply for and obtain a Public Gathering Penffit for the date
of June 30, 2002, but when questioned by the Township Supervisors concerning the
preceding day of June 29, 2002, refused to file an application for that day of the weekend
event stating that then he would not be allowed to have camping, or words to that effect.
13. The Township has incurred and will incur legal fees as a result of the
enforcement action taken in this matter by its Solicitor. All legal fees incurred by the
Township in connection with this action are reasonable and at the hourly rate paid by the
Township for all legal work done by the Solicitor outside of attendance at township
meetings at a rate of $100.00 per hour. Thus far, the Township has incurred expenses in
excess of Five Hundred ($500.00) Dollars as payment for reasonable attorney fees.
WHEREFORE, Plaintiff prays this Honorable Court find the Defendants each
individually and as Doublin Gap Motocross, Inc. liable for civil penalties for violation of
the Public Gathering Ordinance of Hopewell Township and for attorney fees incurred by
the Township for enforcement of the Ordinance.
