12. As set forth in paragraph 3 herein, Plaintiffs loaned to Defendants the sum of $4,004.50
as evidenced by the Loan Agreement whieh is allached hereto as E"hibit"A".
13. As of December 20,1995, the amount due and owing was $1,696.85,
14. Despite repeated demands by Plaintiff, Defendants have failed and/or refused to pay the
total amount due.
15. Defendants failure to pay the amount due on the loan pursuant to the tenns of the Loan
Agreement is a material breach of the parties' contract.
16. Pursuant to Ihe tenns of the Loan Agreement Plainliff is entitled to receive reasonable
attorney fees plus any court costs from Defendanls if it is necessary for Plaintiff to bring suit to
collect any money due under the Loan Agreement.
17. As a result of Defendants' breach, Plaintiff has suffered damages in the amount of
$1,696.85 plus interllst, allomey fees and costs.
WHEREFORE, Plaintiff demands judgmenl in its favor and against Defendants in the
amount of $1,696.85 together with costs and allomey fees in bringing this action.
