5, Defendants are owners of the real projlerty which is the subject of said
Mechanics' Lien, situate on Hoover Road, Boiling Springs, Cumberland County,
Pennsylvania,
6, Within four (4) months of the last day of work, Plaintiff filed for record in
the Office of the Prothonotary of the Court of Common Pleas of Cumberland County,
Pennsylvania, a Claim of Mechanics' Lien indexed to number 96-128 M,L,D, on January
10, 1996, on said real property and the improvements thereon; a copy of said claim is
attached hereto, made a part hereof by reference and marked Exhibit "A",
7. A true and correct copy of the Notice of the Filing of the Mechanics' Lien
Claim and the Mechanics' Lien Claim were served upon Defendants on February 5,
1996; a copy of said Affidavit of Service is attached hereto, made a part hereof by
reference and marked Exhibit "B",
8, The total amount of labor and materials supplied to Defendants was
$10,330,72,
9, Defendant Owners made payments totalling $4,260, and there is now due,
owing, and unpaid to Plaintiff the sum of $6,070,72, together with interest thereon
from September 8, 1995, at the rate of one and one-half (1'12%) per cent per month,
10, Plaintiff has been compelled to employ an attomey to prosecute this action,

3, The Claimant contracted with Sherman Hostler, t/d/b/a Hostler Home
Improvements ("Contractor"), who contracted directly with the Owners.

You are hereby notified that E, L. Stoner Excavating is a subcontractor under a contractual
arrangement with your contractor Hostler Home Improvement and has Cumisherllabor
and/or materials in connection with the erection, construction, alteration or repair of an
improvement to ,'our property at Hoover Road, Boiling Springs, Pennsylvania.
The labor and/or materials furnished by the subcontractor consisted of general excavating
and installation of sand mound, The subcontractor's work was completed and the last of the
specified labor and/or materials was furnished by the subcontractor on September 8, 1995.
The amount still due and payable by the contractor to the subcontractor is $6,070,72 plus
1 V..% per month on the unpaid balance.
Unless payment of the amount due is made within 30 days after setvice of this fonnal notice

party is being dilatory, vexatious and obdurate should be pennitted as circumstances changes

THIS AGREEMENT, made and entered into this M day ofQ I! J 1997, by and
between EDWARD L, STONER, tJd/b/aJ E. L. Stoner Excavating, of~wn'hiP' Perry
County, PeMsylvania, (hereinafter "Subcontractor"), PARTY OF THE FIRST PART, and
ALFRED LOGAN and IRENE LOGAN, of Boiling Springs, Cumberland County, PeMsylvania,
(hereinafter "Owners"), PARTIES OF THE SECOND PART.
WHEREAS, Subcontractor filed a Mechanics' Lien Claim on January 10, 1996, and a,
Complaint by Subcontractor Against Owner for Judgment on Mechanics' Lien Claim on
October 31,1996, against the Owners' propeity situate in Boiling Springs, Cumberland County,
Pennsylvania; and
WHEREAS, Owners filed Preliminary Objections of Defendants, Alfred Logan and Irene
Logan, to the Complaint of Edward L, Stoner, tJd/b/a E, L. Stoner Excavating, on or about
November 14, 1996, disputing the claim; and
WHEREAS, Subcontractor filed a Reply to Preliminary Objections of Defendants, Alfred
Logan and Irene Logan, to the Complaint of Edward L, Stoner, tJd/b/a E, L. Stoner Excavating,
on December 3, 1996, and a Petition to Amend Mechanics' Lien Claim on December 3, 1996;
